Van Milligen, City Manager SUBJECT: 1104 Riverview Assessment DATE: December 16, 2011 Dubuque bierd All-America City 1 2007 The property located at 1104 Riverview has been a problem property for a few years. Building Services Manager Rich Russell has provided information regarding the City's efforts to have the property rebuilt or demolished after a fire on April 28, 2008 that significantly damaged the structure. Due to a lack of response from the property owner, Building Services caused the structure to be demolished. Building Services Manager Rich Russell recommends City Council approval to assess $11,915.36 to the property at 1104 Riverview, for demolition, water service removal, weed removal and publication of notice in the Telegraph Herald. Van Milligen MCVM:jh Attachment cc: Barry Lindahl, City Attorney Cindy Steinhauser, Assistant City Manager Rich Russell, Building Services Manager Masterpiece on the Mississippi TO Michael C Van Milligen, City Manager FROM Rich Russell, Building Services Manager DATE December15,2011 SUBJECT 1104 Riverview Assessment Dubuque had NI- America City 'I 1 1 I' 2007 INTRODUCTION The property located at 1104 Riverview has been a problem property for a few years The time line below summarizes the City's efforts to have the property rebuilt or demolished Due to a lack of response from the property, Building Services caused the structure to be demolished and requests that the associated costs be assessed to the property DISCUSSION The following is a recent timeline on the enforcement efforts at the property located at 1104 Riverview Prior to 2008 property was owned by Larry &Cheryl Connolly This was their primary residence The Building Services Department had been working to bring this property into compliance Mr Connolly had been doing extenswe work without any permits On April28, 2008 the property sustained significant damage in a fire On May 9, 2008 Mr Connolly was sent a letter from our office requesting the property be secured and if property is to be habitable again, explaining what needed to be done to bring it back into compliance Mr Connolly responded, stating that the insurance company was to make a determination within 10 days, whether the building would be considered a total loss or if the Connelly's would rebuild At some point, Mr Connolly passed away and the home was deeded to his son, Antonio Connolly The insurance settled with the Connelly's Building Services attempted to contact the insurance company because we were told there was money held over for demolition in the amount of $10,000 00 When we finally located the agent, he informed us the City was to make a request for the money within a certain time frame, and that deadline had passed JezzZasada made numerous attempts to locate Antonio Connelly, to no avail The house had been boarded up some time ago by Housing Department, but has since all been removed JeffZasada requested bids to demo the property on June 8, 2010 and received two, one for $31,320 00, the other for $31 ,488 00 The land, at the time, was valued at 6,300 00 On August 13, 2010 Jeff made personal contact with Antonio Jeff gave Antonio 30 days to secure property and 90 days to either rebuild or demo property Jeff recommended he contact the contractors working on the B branch houses The deadlines passed with no progress being made and no updates from the owner In December 2010, Jeff again made contact with Antonio He told Jeff he has no funding to do any work on property Jeff informed him the City would be pursuing demolition of the property and assess the costs Jeff again received two bids to have the property deconstructed One bid is for $11,030 00 and the other for $8790 00 These bids do not include water and sewer disconnection or backfilling a portion of foundation The City offered to purchase the property and pay all liens with the intent to sell the property to a contractor that had expressed interest in rebuilding Antonio agreed to sell, but his mother Cheryl had first right of refusal She would not return the paperwork In September 2011, we sent notifications out to last known address for Antonio and Cheryl Connelly and we published notice in the TH for any interested parties After not receiving any responses we moved forward and had the low bidder demolish the structure down to the foundation The foundation remains in place to hold back retaining walls on neighboring properties The final cost that we are requesting approval to assess to the property are summarized as follows THAd$3036 Ted Stack's Construction $8950 00 City of Dubuque (weed removal) $ 70 00 Drew Cook (water service removal) $2865 00 TOTAL $11915 36 Attached are copies of all receipts and a copy of the notice published in the Telegraph Herald RECOMMENDATION I recommend that the costs of demolition and related work be assessed to the property described as Lot 1 -1 -37 Althausers Subdivision (PIN 1013431012) ACTION TO BE TAKEN Assesment of the costs to the property at 1104 Riverview Prepared by cc Jeff Zasada for Rich Russell Jeff Zasada Inspector II Crenna Brumwell, Assistant City Attorney 14071CCAtPda II oPPp/MOtn,2N I nn CC C:evd V irrin Lpn lll.
