Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing that the plat facilitates the settling of an estate. Staff reviewed the submitted final plat noting that no additional homes will be built as a result of the replatting There were no public comments. The Zoning Advisory Commission discussed the request, noting that the final plat will not adversely impact adjacent property. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, subject to waiving Section 42-19(b) Blocks & Lots waiving lot frontage for Lots 1, 2 and 3. A simple majority vote is needed for the City Council to approve the request. SUBJECT: Final Plat Butler's Hill 2nd Addition, Dubuque Cpunty INTRODUCTION The submitted final plat of Butler's Hill 2nd Addition is a minor final plat located along Derby Grange Road in Dubuque County. The submitted final plat re-subdivides three existing parcels into three lots with a new configuration. Access to the properties are currently provided by way of an access easement. DISCUSSION The submitted final plat re-subdivides three existing lots off of Derby Grange Road into three new parcels. No additional single-family homes are being constructed. Rather, the area is being re-subdivided to facilitate a future change in ownership. RECOMMENDATION Planning staff recommends approval of the final plat of Butler's Hill 2nd Addition as it is in substantial compliance with City of Dubuque Subdivision Regulations subject to waiving lot frontage requirements for Lots 1 , 2 and 3. City Planner Address: City Hall. 50 W. 13th St Telephone: 589-4210 RESOLUTION NO. 213 -05 RESOLUTION APPROVING THE FINAL PLAT BUTLER'S HILL, SECOND ADDITION IN DUBUQUE COUNTY, IOWA Whereas, there has been filed with the City Clerk a Final Plat Butler's Hill, Second Addition in Dubuque County, Iowa; and Whereas, said Final Plat has been examined by the Zoning Advisory Commission and its approval endorsed there; and Whereas, said Final Plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 3. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lots. Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1, Lot 2 and Lot 3 to have 0 feet of frontage, where 50 feet of lot frontage is required. Section 3. That the Final Plat Butler's Hill, Second Addition is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said plat of survey.
