City Engineer Gus Psihoyos recommends award of the contract to the low bidder, Skyline Trucking & Storage, Inc., in the amount of $75,270.55, which is 36.92% under the engineer's estimate. Van Milligen, City Man~~ Gus Psihoyos, City Engineer A~ TO: SUBJECT: Pennsylvania Avenue - Radford Road Sidewalk Installation Project (Capital Improvement Projects: 010C89 and 350042) INTRODUCTION The enclosed resolution authorizes the award of the construction contract for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project. DISCUSSION On November 15, 2004 City Council approved the installation of sidewalks on the north side of Pennsylvania Avenue from Iowa 32 (Northwest Arterial) to Radford Road, the east side of Radford Road from Pennsylvania Avenue to the Asbury city limits, and from Middle School property, northerly, on the west side of Radford Road to the Asbury city limits. This assessable project consists of 5,114.5 lineal feet of sidewalk installation on Pennsylvania Avenue and Radford Road. This installation will also include excavation, grading, seeding and traffic control work. As of May 10, 2005, 11 property owners installed their respective sidewalks and the City has a commitment from seven other property owners that their sidewalks will be completed prior to the June 6, 2005 deadline. This reduction will drastically reduce the total cost of the project. The Middle School property was not included as part of the assessment. The Dubuque Community School District approved sidewalk installation at its April 11, 2005 board meeting, with a completion date no later than June 6,2005. The project is scheduled to be completed by August 15, 2005 to provide for the August 26,2005 student orientation at the Eleanor Roosevelt Middle School. Since the sidewalk is an integral part of the overall sidewalk network for safe passageway for students to the new Middle School, staff has included an incentive bonus for the contractor to complete all work prior to the specified completion date of August 15, 2005. For each calendar day that all work is fully completed prior to the specified completion date of August 15, 2005, one percent (1 %) of the actual construction costs will be given, to a maximum of five percent (5%) of the actual construction costs, as an incentive to complete the project ahead of schedule. However, if the City at any time extends the completion date for any reason, no incentive shall be paid, unless the City in its sole discretion elects to pay an incentive. For each calendar day that any work shall remain uncompleted beyond the specified completion date of August 15, 2005, $1,000 per calendar day will be assessed, not as a penalty but as predetermined and agreed liquidated damages. The Contractor will be separately invoiced for this amount, and final payment will be withheld until payment has been made of this invoice. If the City extends the completion date, liquidated damages shall be calculated from the extended completion date. The assessment of liquidated damages shall not constitute a waiver of the City's right to collect any additional damages which the City may sustain by failure of the contractor to carry out the terms of the contract. Sealed bids for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project were received on May 10, 2005. Skyline Trucking & Storage, Inc. of Zwingle, Iowa, submitted the low bid in the amount of $75,270.55. This amount is 36.92% under the engineer's estimate. ACTION TO BE TAKEN I recommend that the City Council adopt the attached resolution awarding the Pennsylvania Avenue - Radford Road Sidewalk Installation Project to Skyline Trucking & Storage, Inc. in the amount of $75,270.55. Whereas, notice of hearing on plans, specifications, form of contract, and estimated cost was published as required by law. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the said plans, specifications, form of contract and estimated cost are hereby approved as the plans, specifications, form of contract and estimated cost for said improvements for said project. Schneider, CMC City Clerk RESOLUTION NO. 231-05 AWARDING CONTRACT Whereas, sealed bid proposals have been submitted by contractors for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project, pursuant to Resolution No. and notice to bidders published in a newspaper published in the City of Dubuque, Iowa on the 22nd day of April, 2005. Whereas, said sealed proposals were opened and read on the 10th day of May, 2005, and it has been determined that the bid of Skyline Trucking & Storage, Inc. of Zwingle, Iowa, in the amount of $75,270.55 was the lowest bid for the furnishings of all labor and materials and performing the work as provided for in the construction documents. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the contract for the above improvement be awarded to Skyline Trucking & Storage, Inc. and the Manager be and is hereby directed to execute a contract on behalf of the City of Dubuque for the complete performance of the work. BE IT FURTHER RESOLVED: That upon the signing of said contract and the approval of the contractor's bond, the City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful bidders. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the proposed Resolution of Necessity described above is hereby: ~ Adopted, without amendment, and all objections filed or made having been duly considered are overruled.
