Solicitation And Acceptance Of Donations: The Commission may solicit and otherwise accept donations and gifts of money, personal and real property and personal services. All such donations and gifts as received shall be- come the property of the City for the general use of support of park and recreation programs of the City unless such items have been desig- nated by the donors for specific purposes. MeI;J1bership, Appointment: (a) The Commission shall be comprised of a membership of seven (7) persons who shall be appointed by the City Council for terms of three (3) years. Four (4) members of the Commission shall constitute a quorum for the transaction of business. All action of the Commission shall be by resolution and the affirmative vote of at least four (4) members shall be necessary for the adoption of any resolution. (b) The expiration date for all terms of office shall be June 30 of the appropriate year. (c) Membership on the Commission shall be limited to persons who are residents of the City. (d) Vacancies caused by death, resignation or otherwise on the Commission shall be promptly filled by the City Council for the unexpired term of office. (1976 Code, S 27-21; Ord. 63-94, S 3, 11-7-1994) Sec. 34-27. Attendance: (a) Members of the Commission shall attend at least two-thirds (1"13) of all regularly sched- uled and held meetings within any twelve (12) month period. If any member does not attend Supp. No. 29 such prescribed number of meetings, it shall be grounds for the Commission to recommend to the City Council that the position be declared vacant and a replacement appointed. (b) The attendance of all Commission mem- bers shall be entered upon the minutes of aU meetings by the secretary. (1976 Code, S 27-22) Sec. 34-28. Compensation: All members of the Commission shall serve without compensation except for reimbursement of necessary expenses. (1976 Code, S 27-23) Sec" 34-29. Organization: (a) The officers of the Commission shall he a chairperson, a vice chairperson and a secretary. All officers shall be members of the Commis- sion. (b) At the initial meeting of the Commission and at the first meeting in July of each year, the Commission shall elect the above identified , officers to serve one year terms of office. All officers shall be eligible to serve successive terms of office. (1976 Code, S 27.24) Sec. 34-30. Meetings: (a) The Commission shall meet not less than bimonthly, after four thirty o'clock (4:30) P.M. on a regularly scheduled day. Membership; Terms; Officers: (a) The Commission shall consist of seven (7) members appointed by the City Council. In its appointments, the Council shall endeavor to achieve a broad representation of the subcommunities and public interests which can take advantage of dedicated channels to benefit the residents of Dubuque. The Council shall appoint only residents of the City and shall give preference to applicants who are actively inter- ested in promoting community cable program- ming who. possess, or are willing to acquire, video production background, and who will relate to the spectrum of informational and cultural needs of cable viewers of Dubuque. The Cable Franchise AdmiIiistrator and any- one who is an owner, shareholder, employee 'or agent of the franchise holder shall be ineligible to serve as a member of the Commission. The membership may include a maximum of two (2) government officers and employees. :\Iembers of the Commission who represent subcommunities utilizing dedicated channels shall not be deemed to have a conflict of inter- est in the use of the equipment and facilities provided for that purpose solely because of their membership on the Commission. (b) The term of each member shall be for three (3) years, with three (3) such terms expir- ing each June. excopt those of the initial ap- pointoes only, three (3) appointments shall have one year terms and three (3) appointments shall have two (2) year terms. If a vacancy occurs be foro the expiration of a torm. the appoint. mont shall be for tho unexpired portion of that term. Meetings; Procedures: (a) The members shall meet as needed to conduct the business of the Commission, 'but not less frequently than once each calendar quarter. A quorum of five (5) 'members shall be required for members to conduct the business of the Commission. All meetings and proceedings of the Commission shall conform with applica- ble open meeting requiremen~. (b) The Commission shall file with the City Council a copy of the minutes of each regular and special meeting within ten (10) days after such meeting. Electrical code board. (a) Board established. In order to determine the suitability of alternative materials and methods of installation; to provide for reasonable interpretations of the electrical code; to serve as an appeal body for the decisions of the building official; to advise the city council on all electrical regulations and procedures; and to provide for examining applicants for electrical contractor's registration, electrical maintenance and journeyman electrician certificates of competency and issuing electrical contractor's registra- tion and electrical maintenance and journeyman certificates of competency, there is hereby created the electrical code board. (b) Membership. The electrical code board shall consist of five (5) members appoint- ed by the city council. Four (4) members shall have a background or experience in electrical engineering, electrical contract- ing, electrical installation or electrical maintenance, and one (1) member shall be appointed from the public at large. (1976 Code, ~ 23-2) Sec. 30-3. Board Of Trustees-Compensa- tion: Members of the Board described in Section 30-1 of this Chapter shall receive no compensa- tion for their services. (1976 Code, ~ 23-3) ~ Board Of Trustees-Terms Of Members; Filling Of Vacancies: t- ~ Each member of the Board described in Sec- tion 30-1 of this Chapter shall hold office for four \ 4-) years and until such member's succes- sor is appointed and qualified. The term of office of any member shall commence July 1 in the year in which the member is appointed. Vacancies occurring on the Board through death. resignation or permanent removal trom the City shall be filled by the Mayor with toe appro....al of the City CounCil, but such appoint- ments shall be made to fill out the unexpired term for which the appointment is made. Board Of Trustees-Powers And Duties Generally: (a) The Board of Library Trustees described in Section 30-1 of this Chapter shall have and Supp. );0. 33 LIBRARY 1867 ~ 30-5 exercise the following powers: (1) To meet and organize by the election of one of their number as president of the Board, and by the election of a secretary and such other officers as the Board may deem necessary; (2) To have charge, control and SUpel'VlS10n of the public library, its appurtenances and fixtures, and rooms containing the same, directing and controlling all the affairs of such library; (3) To employ a librarian, such assistants and employees as may be necessary for the proper management of said library, and fix their compensation; but, prior to such employment, the compensation of such librarian, assistants and employees shall be fixed for the term of employment by a majority of the members of said Board voting in favor thereof; (4) To remove such librarian, assistants or employees by a vote of two-thirds (2/3) of such Board for misdemeanor, incompe- tency or inattention to the duties of such employment; (5) To select and make purchases of books, pamphlets, magazines, periodicals, pa- pers, maps, journals, furniture, fixtures, stationery and supplies for such library; (6) To authorize the use of such libraries by nonresidents of the City and to fix charg- es therefor; (7) To make and adopt, amend, modify or repeal bylaws, rules and regulations, not inconsistent with law, for the care, use, government and management of such library and the business of said Board, fixing and enforcing penalties for the violation thereof; (8) To have exclusive control of the expendi- tures of all taxes levied for library pur- poses as provided by law, and of the expenditure of all monies available by
