The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the existing lot layout and access to
the property.
Staff reviewed the submitted plat, noting that one new building lot will be created (Lot 2) and
that the County is requiring that Sanders Lane be increased in size from 40-foot right-of-way
to a 66-foot right-of-way to provide access to Lot 2. Staff noted that Lot 1 will not have the
required 50 feet of lot frontage because access is via an easement.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the existing residence
on Lot 1 is accessed by an existing access easement and access to Lot 2 will be brought up
to County private street standards.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, waiving the lot frontage requirements for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 270-05
RESOLUTION APPROVING THE PLAT OF SURVEY STIERMAN GARDENS IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey Stierman
Gardens in Dubuque County, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval endorsed there; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 3. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks
and Lots.
Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1 to have 0 feet of frontage, where 50 feet of lot frontage is required.
Section 3. That the Plat of Survey Stierman Gardens is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of
the City of Dubuque, Iowa upon said plat of survey.

INTRODUCTION
The submitted plat of survey of Stierman Gardens subdivides an existing parcel of land
into two lots. Lot 1 has an existing farmhouse on it and Lot 2 is being graded to allow
construction of a new single-family home. The subject property is located within two
miles of the City of Dubuque and is being reviewed jointly by both the City and County
of Dubuque. The Zoning Advisory Commission is being asked to waive the lot frontage
requirement for Lot 1.
DISCUSSION
The submitted plat of survey subdivides an existing parcel into two lots. Lot 1 is
substandard in terms of not having any frontage on a public or private street. Lot 2 has
frontage on Sanders Lane, which is an existing platted private right-of-way 40 foot in
width. At the County's request, Sanders Lane has been platted to serve Lot 2 as a 66-
foot right-of-way. Lot 1 will be served by an existing 20-foot wide right-of-way easement
that currently serves the existing single-family home on Lot 1. Access to the new home
to be built on Lot 2 will be from Sanders Lane.
RECOMMENDATION
Planning staff recommends that the submitted Plat of Survey for Stierman Gardens be
approved as the submitted plat of survey is in substantial compliance with City of
Dubuque Subdivision Regulations subject to waiving lot frontage for Lot 1 and waiving
Article IV - Design Improvement Standards of the Subdivision Regulations except for
Section 42-19, Blocks and Lots.
