The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
Janet Faley spoke in favor of the request, noting she would like to acquire Lot 1.
Staff Member Kritz reviewed the staff report, noting that the plat will split one parcel into
two. He noted the location of the flood plain and roadway easement. He said that Lot 1
has no frontage on a public or private street and will be labeled non - buildable. He said
that access to the applicant's property will be through their existing lot. He
recommended approval of the plat.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it is appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Catfish Creek Place subdivides an existing parcel into
two new lots. The Zoning Advisory Commission is reviewing the plat as Lot 1 does not
have frontage on a public or private street.
DISCUSSION
The submitted Plat of Survey of Catfish Creek Place subdivides an existing 5.14 acres
of property into two new lots. The subject property lies between Timber -Hyrst Estates
and Miller Road in the southern portion of the city of Dubuque. Lot 2 complies with City
Subdivision requirements for sufficient lot area and lot frontage. Miller Road has a 40-
foot right -of -way easement through a portion of Lot 2. Lot 1 does not have frontage on
a public or private street. The submitted Plat of Survey designates Lot 1 as non -
buildable. Lot 1 is also completely within the floodplain of the Catfish Creek and the
City's Floodplain Development Regulations will also make it exceedingly difficult to build
on this parcel. Lot 1 will be sold to the owner of Lot 26 Timber -Hyrst Estates, which
does have frontage on Creekwood Drive.
RECOMMENDATION
Staff recommends the submitted Plat of Survey of Catfish Creek Place be approved
subject to waiving lot frontage requirement for Lot 1.

RESOLUTION APPROVING THE PLAT OF SURVEY CATFISH CREEK PLACE IN
CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey Catfish Creek Place in
the city of Dubuque, Iowa ; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where 50 feet of street frontage is required by Section 11 -14 of Title 16
of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 1.
Section 2. That the Plat of Survey Catfish Creek Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Plat of Survey.
