Van Milligen, City Manager FROM: Jerelyn O'Connor, Neighborhood Development Specialist RE: Arts and Culture Grant Program for Special Projects Grant Agreements Introduction The purpose of this memorandum is to request City Council approval of the grant agreements for the FY 2005 Arts and Culture Grant Program for Special Projects. Background The Arts and Cultural Affairs Advisory Commission solicited applications for the grant program in February, 2005. The Commission received thirteen grant applications. The requests totaled $87,676. The Commission reviewed and ranked the applications based on the established criteria. Discussion In May, the Commission transmitted their recommendations for funding to the City Council. On May 16, the Council approved grant awards for the following organizations: Dubuque Co. Historical Society Fly-By-Night Productions Dubuque Symphony Orchestra Dubuque Museum of Art Dubuque History Museum Musical Cabaret Magic of Mozart Festival Handz on Gallery Enhancement $12,000 $10,000 $ 5,000 $ 3,000 Corporation Counsel Barry Lindahl and Budget Director Dawn Lang have reviewed the grant agreements for City Council consideration. Action The action requested is for City Council approval of the attached grant agreements. FY 2005 ARTS AND CULTURE GRANT PROGRAM FOR SPECIAL PROJECTS AGREEMENT BETWEEN CITY OF DUBUQUE AND DUBUQUE COUNTY HISTORICAL SOCIETY This agreement is made and entered to, by and between the City of Dubuque, Iowa, hereinafter "City" and the Dubuque County Historical Society, hereinafter "Grantee." Effective date is June 16, 2005. Expiration date is June 30, 2006. 1. Purpose City hereby makes a grant on behalf of the grantee of up to $12,000 for the purpose of providing funding the Dubuque History Museum Project as outlined in the grantee's Arts and Culture Grant Program application. Grantee agrees that the grant application and grantee assurances are by reference part of this agreement. 2. Time of Performance The term of this Agreement shall be from June 16, 2005, through June 30, 2006. 3. Fundinq City shall pay grantee $12,000 for the project detailed in the grant application. 80% of this amount will be paid by the City after execution of this agreement by both parties and upon receipt of a requisition for such sum from the grantee. The balance of the grant amount will be paid to the grantee after closeout and acceptance of the grantee's final report. Grantee will provide documentation of project expenditures, required local match, and activities completed. 4. Audit and Evaluation Inasmuch as the funds to be provided Grantee by City are public funds, Grantee agrees that it will maintain books of account in accordance with generally accepted accounting standards together with necessary documentation to support all expenditures. 5. Discrimination In carrying out its program, Grantee shall not discriminate against any employee or applicant for employment because of race, creed, color, sex, age, national origin, religion, or disability. Grantee shall take affirmative action to insure that applicants for employment are employed and that employees are treated during employment without regard to their race, creed, color, sex, age, national origin, religion, or disability. Such action shall include, but not be limited to, the 1 following: employment, promotion, demotion or transfer; rates of payor other forms of compensation; and selection for training, including apprenticeship. Grantee agrees and will undertake whatever affirmative measures are necessary so that no person shall on the grounds of race, color, religion, national origin, sex, age, degree of handicap or disability be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activities funded in whole or in part with any of the funds made available to Grantee under the terms of this Agreement. 6. Interest of Members. Officers. or Employees of the City of Dubuque. Members of the Dubuque City Councilor Other Public Officials No member, officer or employee of City, or its designees or agents, no member of the Dubuque City Council and no other public official of the City who exercises any function or responsibilities with respect to the program during his tenure, shall have any interest, direct or indirect, in this contract or the proceeds thereof, for work to be performed in connection with the program assisted under this Agreement. 7. Assiqnability Grantee shall not assign or transfer any interest in this Agreement without the prior written approval of City. Michael C. Effective date is June 16, 2005. Expiration date is June 30, 2006. 1 . Pu rpose City hereby makes a grant on behalf of the grantee of up to $10,000 for the purpose of providing funding the Musical Cabaret Project as outlined in the grantee's Arts and Culture Grant Program application.
