Sealed bids were received for the Dubuque Industrial Center West 3rd Addition/Contract
B - Paving, Drainage and Utilities Project. City Engineer Gus Psihoyos recommends
award of the contract to the low bidder, Horsfield Construction, Inc., in the amount of
$2,299,055.55, which is 12% under the engineer's estimate.
Six alternates were bid on the project. It is recommended that alternates 1, 2, and 3 for
construction of the East Sewer, North Sewer, and North Trail be included in the
awarded contract.
All final construction costs associated with Alternates 1 and 2 will be used to establish
sanitary sewer connection charges for areas served by these collector sewers.
Alternates 4, 5, and 6 for partial paving in 2005 and 2006, all paving in 2006, and for
closing Middle Road to open-cut the sewer, respectively, were included as replacement
alternates. Because both of the paving alternates, for delaying the paving, would
increase the project cost, and because open-cutting the sewer across Middle Road
would cause considerable difficulties to motorists and residents along Middle Road
while only saving the City about $2,000, it is recommended that Alternates 4, 5, and 6
be excluded from the awarded contract.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution authorizes the award of the Dubuque Industrial Center West
3rd Addition/Contract B - Paving, Drainage, and Utilities Project.
BACKGROUND
This project will continue the construction phase of the next expansion of the
Dubuque Industrial Center West, including the connection of the east and west
sections of Chavenelle Road through the McFadden farm. The 150-acre project
area includes the former Bergfeld farm property. IIW has been retained to design
and engineer this project for the City. This second bid package allows for the
installation of sanitary sewer, water main, paving, fiber optic conduit, storm sewer,
and landscaping.
The project is approved in the FY06 Capital Improvement Program. General
obligation bond proceeds for the project are available to fund project expenses
incurred prior to July 1, 2005.
DISCUSSION
Sealed bids were received on June 9, 2005. Horsfield Construction, Inc. submitted
the low bid in the amount of $2,299,055.55. This amount is 12% under the
engineer's estimate. A summary of the bids received is as follows:

RECOMMENDATION
Six alternates were bid on the project. Alternates 1, 2, and 3 for construction of the
East Sewer, North Sewer, and North Trail, respectively, were included in the low bid
as deletable alternates. I recommend that all of these be included in the awarded
contract. The following is a description of these three alternates:
East Sewer
The east sewer alternate would extend the existing sanitary sewer near Nordstrom,
to the west along the new portion of Chavenelle Road. This sewer would serve the
McFadden farm between Middle Road and Chavenelle.
North Sewer
The north sewer alternate would extend sewer service to a portion of the newly-
annexed area along Middle Road.
North Trail
The North Trail alternate would extend the trail network from the northern boundary
of the Bergfeld farm, north to Middle Road.
All final construction costs associated with Alternates 1 and 2 will be used to
establish sanitary sewer connection charges for areas served by these collector
sewers.
Alternates 4, 5, and 6 for partial paving in 2005 and 2006, all paving in 2006, and for
closing Middle Road to open-cut the sewer, respectively, were included as
replacement alternates. Because both of the paving alternates, for delaying the
paving, would increase the project cost, and because open-cutting the sewer across
Middle Road would cause considerable difficulties to motorists and residents along
Middle Road while only saving the City about $2,000, I recommend that Alternates 4,
5, and 6 be excluded from the awarded contract.
Because the Iowa Department of Natural Resources has not issued the permit
necessary for the construction of the sanitary sewer portion of the project, a
provision has been included in the contract that the contractor will not commence
construction of the sanitary sewer portion of the project until the permit is issued.
The provision also requires the contractor to hold the City harmless from any and all
costs, expenses, or damages that be may be sustained by reason of any delay in
the issuance of the permit. The completion date of the contract of June 16, 2006,
will be extended for the sanitary sewer portion of the contract for the period of the
delay between the award of the contract and the issuance of the permit.
Attached you will find a letter from IIW Engineers & Surveyors, PC recommending
the award of the project to Horsfield Construction, Inc. I also recommend that the
contract be awarded to Horsfield Construction, Inc. in the total amount of
$2,299,055.55.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
Whereas, on the 11th day of May, 2005, plans, specifications, form of
contract and estimated cost were filed with the City Clerk of Dubuque, Iowa for
the Dubuque Industrial Center West 3rd Addition/Contract B - Paving, Drainage,
and Utilities Project.
Whereas, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the said plans, specifications, form of contr~ct and estimated cost are
hereby approved as the plans, specifications, form of contract and estimated cost
for said improvements for said project.

AWARDING CONTRACT
Whereas, sealed proposals have been submitted by contractors for the
Dubuque Industrial Center West 3rd Addition/Contract B - Paving, Drainage, and
Utilities Project pursuant to Resolution No. and notice to bidders published
in a newspaper published in the City of Dubuque, Iowa on the 17th day of May,
2005.
Whereas, said sealed proposals were opened and read on the 9th day of
June, 2005, and it has been determined that the bid of Horsfield Construction,
Inc. of Epworth, Iowa in the amount of $2,299,055.55 was the lowest bid for the
furnishings of all labor and materials and performing the work as provided for in
the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Horsfield
Construction, Inc., subject to the concurrence by the Iowa Department of
Transportation, and the Manager be and is hereby directed to execute a contract
on behalf of the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.

Dear Gus:
In accordance with owner instructions, bids for the Dubuque Industrial Center West
3rd Addition - Contract B Paving, Drainage & Utilities were opened and read at 2:00
p.m. on June 9, 2005. Six (6) bids were received for this project. A tabulation of
the bids is enclosed.
After reviewing the bids, it was determined the low bid was submitted by Horsfield
Construction, Inc., P.O. Box 305, Epworth, IA 52045 in the amount of
$2,299,055.55.
It is our opinion that Horsfield Construction, Inc. has the experience, workforce, and
equipment to properly complete this contract. Therefore, we recommend award of
the Dubuque Industrial Center West 3rd Addition - Contract B Paving, Drainage &
Utilities to Horsfield Construction, Inc. in the amount of $2,299,055.55.
This bid includes Deletable Alternates 1, 2, and 3 for construction of the East
Sewer, North Sewer, and North Trail, respectively. It is our recommendation that all
of these be included in the awarded contract.
The bid also provided Replacement Alternates 4, 5, and 6 for partial paving in 2005
and 2006, all paving in 2006, and for closing Middle Road to open-cut the sewer,
respectively. Both of the paving alternates, for delaying the paving, would increase
the project cost. The open-cut sewer across Middle Road would save the City
approximately $2,000 while causing considerable difficulties to motorists and
residents along Middle Road. Therefore, it is our recommendation that Alternates 4,
5, and6 be excluded from the awarded contract.
The engineer's estimate for the Dubuque Industrial Center West 3rd Addition -
Contract B Paving Drainage & Utilities project was $2,620,421.00. The low bid of
$2,299,055.55 is $321,365.45 or 12% below the engineer's estimate.

We have reviewed the bids for the nICW -3, Contract B - Paving, Drainage, and Utilities Projects.
Following is a presentatiOll of our observations with regard to the bids:
The bid documents were set up to provide the JOost flexibility to the City while providing a clear and
convenient bidding scenario for contractors. The project includes aU paving, stann se'M%, sanitary sewer,
water roain, lighting, fiber optic conduit, and landscaping to serve all of the upper lots along Chavenelle
Road (Phase I). The project is set up to require substantial completion, including all of the paving. this
fall. with final completion by June I6*- 2005 (BASE BID).

As pet" the City's instructions, the Bid Schedule was set up to allow the City the additional options of
whether or not to include the sewer extension through the McFadden corridor (~TERNATE 1), the
sewer extension north of the site to Middle Road (AL TEBNATE 2), and/or the grass-surfaced trail that
would extend north of the site (ALTERNATE 3). The BASE BID together with ALTERNATES 1
through 3, make up the GRAND TOTAL (BASIS OF AWARD)
The Bid Schedule also provided an opportunity for the contractors to demonstrate to the City how much
money the City could save if the contractors were allowed to postpone part or all of the paVing until the
Spring of 2006 (ALTERNATES 4 AND 5). It was anticipated that, if the contractors were unsure that
they could get the project completed this fall, they could offer a 5credit' in the form of lower prices if
allowed to postpone some or all of the paving until next spring.
One last alternate, ALTERNATE 6, was provided so the City could compare the cost of jacking the
sanitary sewer undet' Middle Road without closing Middle Road, with the cost foc tempotarily closing
Middle Road to open-cut the sewer. The following table presen.ts the various bid scenarios. The two
lowest bidders are shown for reference pmposes:

As shown above, Alternates 4 and 5, the alternates that involve paving in 2006, would serve to increase
the project cost rather than. to save the City IIlOIley as was expected. We have recently heard reports that
the oosts for Portland cement are anticipated to rise significantly in the coming months. This is likely a
reason for the added costs.
The cost for jacking the sewer under Middle Road would be approJdmately $2000 more than closing
Middle Road down to open-cut the sewer. This appears to be minor compared to the great inconvenience
closing the road would cause for the citizens of Dubuque.
Please let us know your decisions regarding the alternates.

INTRODUCTION
The enclosed resolutions authorize the bidding procedure for the second construction
contract for the Dubuque Industrial Center West 3rd Addition Expansion Project.
DISCUSSION
This project continues the construction phase of the next expansion of the Dubuque
Industrial Center West, including the connection of the east and west sections of
Chavenelle Road through the McFadden farm. The 150-acre project area includes the
former Bergfeld farm property. IIW has been retained to design and engineer this
project for the City. This second bid package allows for the installation of sanitary
sewer, watermain, paving, fiber optic conduit, storm sewer, and landscaping.
The project is approved in the FY06 Capital Improvement Program. General obligation
bond proceeds for the project are available to fund project expenses incurred prior to
July 1, 2005.

NOTICE TO BIDDERS OF THE RECEIPT OF BIDS
FOR THE DUBUQUE INDUSTRIAL CENTER WEST 3RD ADDITION
CONTRACT B - PAVING, DRAINAGE & UTILITIES
Sealed proposals will be received by the City Clerk of the City of Dubuque,
Iowa, at the Office of City Clerk in City Hall no later than 2:00 o'clock p.m. on the
9th day of June, 2005, for the construction of the Dubuque Industrial Center West
3rd Addition Contract B - Paving, Drainage & Utilities project.
Proiect Description: The project involves approximately 12,700 LF of
8" through 16" DIP sanitary sewer, 4,800 LF of 12" through 16" DIP water main,
3,900 LF of 15" through 36" RCP storm sewer, 20,000 SY of 9"-thick PCC
pavement, 5,600 LF of 4" with 4-1" HDPE conduit, 24 street lights, and over 200
trees.

deposit of $25.00 for each set of plans and specifications will be required,

Payment to the contractor will be made from funds as may be legally used
for such purposes.
All work herein provided for shall be commenced within ten (10) days after
the Notice To Proceed has been issued, and shall be fully completed by June 16,
2006.
All bids must be submitted on the Bid Proposal Form bound in the
construction documents. Each bid shall be accompanied by a satisfactory Bid
Bond executed by the Bidder and an acceptable surety; or a cashier's or certified
check payable to the City Treasurer, City of Dubuque, drawn on a bank in Iowa
or a bank chartered under the laws of the United States, in the amount of ten
percent (10%) of the bids submitted as security that the bidder will enter into a
contract for doing the work and will give bond with proper securities for the
faithful performance of the contract in the form attached to the construction
documents.
The successful bidder (Contractor) will be required to furnish a
Performance Bond in an amount equal to one hundred percent (100%) of the
contract price. Said bond is to be issued by a responsible surety company
approved and acceptable to the City Council, and shall guarantee the faithful
performance of the contract and terms and conditions therein contained, and

shall guarantee the prompt payment of all materials and labor and protect and
save harmless the City of Dubuque, Iowa, from claims and damages of any kind
caused by the operations of the Contractor.
The successful bidder (Contractor) will also be required to furnish a
Payment Bond that will guarantee the prompt payment of all subcontractors,
suppliers, materials, labor and protect and save harmless the City of Dubuque,
Iowa, from claims and damages of any kind caused by the operations or non-
payment on behalf of the Contractor.
The successful bidder (Contractor) will also be required to furnish a
Maintenance Bond that will guarantee the material, workmanship and the
maintenance of the improvement(s) constructed for a minimum period of two (2)
years from and after its completion and acceptance by the City Council.
The Contractor and approved subcontractors will be provided a Sales Tax
Exemption Certification to purchase, or withdraw from inventory, materials
furnished under for this project.
No bid submitted by any Contractor which contains a condition or
qualification shall be recognized or accepted by the City Council and any letter or
communication accompanying the bid which contains a condition or qualification
upon the bid which has the effect of qualifying or modifying any provision of the
specifications in any manner will be rejected by the City Council as not
responsive.
All proposals must be made on blanks furnished by the City Engineer and
each bidder will be required to state his prices for doing all the items in each
section on which he makes a bid and for all things necessary to make a complete
job.
The Bidder's attention is directed to the City of Dubuque's Affirmative
Action Program which is included in the Contract Specifications and the
provisions thereof and hereby made a part of the Contract Documents by
reference and incorporated therein.
The Contractor, when requested by the City of Dubuque, will furnish a
statement of his financial and practical qualifications as provided for in the
General Requirements of the Specifications.
By virtue of statutory authority, a preference will be given to products and
provisions grown and coal produced within the State of Iowa and to Iowa
Domestic Labor.
The City Council reserves the right to reject any and all bids or to waive
any technical ties and irregularities.

CONSTRUCTION SCHEDULE AND LIQUIDATED DAMAGES
Work herein provided for shall be commenced within the (10) days after notice to
proceed has been issued and shall be fully completed by June 16, 2006.
For each calendar day that any work shall remain uncompleted beyond the
completion schedule, $600.00 per calendar day will be assessed, not as a
penalty but as predetermined and agreed liquidated damages. The contractor
will be separately invoiced for this amount, and final payment will be withheld
until payment has been made of this invoice.
The assessment of liquidated damages shall not constitute a waiver of the City's
right to collect any additional damages which the City may sustain by failure of
the contractor to carry out the terms of his contract.
An extension of the contract period may be granted by the City for any of the
following reasons:
1. Additional work resulting from a modification of the plans.
2. Delays caused by the City.
3. Other reasons beyond the control of the Contractor, which in the City's
opinion, would justify such extension.

SUBJECT:
INTRODUCTION
The enclosed resolutions authorize the bidding procedure for the second construction
contract for the Dubuque Industrial Center West 3rd Addition Expansion Project.
DISCUSSION
This project continues the construction phase of the next expansion of the Dubuque
Industrial Center West, including the connection of the east and west sections of
Chavenelle Road through the McFadden farm. The 150-acre project area includes the
former Bergfeld farm property. IIW has been retained to design and engineer this
project for the City. This second bid package allows for the installation of sanitary
sewer, watermain, paving, fiber optic conduit, storm sewer, and landscaping.
The project is approved in the FY06 Capital Improvement Program. General obligation
bond proceeds for the project are available to fund project expenses incurred prior to
July 1, 2005.
