SUBJECT: Final Plat Furuseth's Sixth Subdivision { (L' ~J INTRODUCTION The final plat of Furuseth's Sixth Subdivision is the latest phase in a residential development located south of Dubuque near the 61/151 interchange. The submitted final plat provides for the platting off of 33 new single-family lots. DISCUSSION The preliminary plat for Furuseth's Sixth Subdivision was approved by the City Council at their April 18, 2005 City Council meeting. The submitted final plat provides for the construction of three new private streets and the extension of a fourth. The private streets will be built to Dubuque County standards of 22-foot of paving and 66-foot of right-of-way. The subject property is located within a secondary growth area based on the fringe area agreement. The proposed streets do not comply with the requirements of the fringe area agreement; however, this subdivision was begun before the property was within two miles of the City. Planning staff has no objection to continuing the subdivision street network based on the existing County standard. The submitted final plat does require that the City Council waive the restriction of double frontage lots for Lots 23 and 25. In addition, Lot 15 only provides 40-foot of lot frontage, where 50-foot of lot frontage is required. These waivers were requested and approved as part of the preliminary plat submitted for Furuseth's Sixth Subdivision. RECOMMENDATION Planning staff recommends that the City Council approve the submitted final plat of Furuseth's Sixth Subdivision as it is in substantial compliance with City of Dubuque Subdivision Regulations, subject to waiving Article IV, Design Improvement Standards, except for Section 42-19, lots and Blocks, and allowing lots 23 and 25 to be platted as double frontage lots and lot 15 to have 40 feet of lot frontage, where 50 feet is required. lC/mkr Attachments Prepared by: Laura Carstens, City Planner Address: City Hall, 50 W. 13th St. Phone: 589-4210 RESOLUTION NO. 289 -05 RESOLUTION APPROVING THE FINAL PLAT OF FURUSETHS' SIXTH SUBDIVISION IN DUBUQUE COUNTY, IOWA Whereas, there has been filed with the City Clerk a final plat of Furuseth's Sixth Subdivision; and Whereas, the Final Plat of Furuseth's Sixth Subdivision provides 40 feet of frontage for Lot 15, where 50 feet is required, and that Lots 23 and 25 are double frontage lots, where such lots are prohibited unless one frontage is an arterial street without access rights, as required by Section 42-19(b) of the Subdivision Regulations; and Whereas, the preliminary plat has been examined by the Zoning Advisory Commission and has its approval endorsed thereon; and Whereas, said final plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lots. Section 2. The Final Plat Furuseth's Sixth Subdivision provides 40 feet of frontage for Lot 15, where 50 feet is required, and that Lots 23 and 25 are double frontage lots, where such lots are prohibited unless one frontage is an arterial street without access rights, as required by Section 42-19(b) of the Subdivision Regulations Section 3. That the Final Plat of Furuseth's Sixth Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein named, execute their written acceptance hereto attached agreeing: Furuseth Sixth Subdivision Page 2 a) To construct street improvements and storm sewers in accordance with improvement plans approved by Dubuque County and certified upon completion by a professional engineer licensed by the State of Iowa. b) To maintain the street improvements and storm sewers constructed as part of Furuseth's Sixth Subdivision until such time as a homeowners association is formed and is responsible for maintenance of the same. Section 3. That in the event Leslie I. and Patricia F. Furuseth fail to execute the acceptance within 180 days after the date of this Resolution, the provisions hereof shall be null and void and the approval of the plat shall not be effective. Impact of Request on: Utilities: The subject subdivision will be served by private septic systems for each lot and shared private wells for water service. Traffic Patterns: The proposed subdivision expansion includes five new streets. The subdivision also includes an existing street named Wild Life Ridge. There are no traffic counts available for private streets. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control is provided during all phases of development of the property, and that the septic systems and private wells are installed and maintained in compliance with County and State requirements. Adjacent Properties: Staff anticipates that the most likely impact to adjacent property will be the increased number of vehicle trips generated by the proposed additional single-family lots when fully developed. Recommended Conditions on Plat: None. Staff Analysis: The submitted subdivision is a continuation of Furuseth's 5th Subdivision and is comprised of 33 single-family lots. The plat provides for the construction of three new streets and the extension of a fourth. This subdivision began in Dubuque County prior to being within two miles of the city of Dubuque. The City of Dubuque's annexation and development of the Dubuque Technology Park along U.S. 61 brought this subdivision within two miles of the city limits. The City Council reviewed and approved previous final plats for this subdivision in August 1998 and May 2000. The submitted final plat for Furuseth's 6th Subdivision continues the existing single- family development by platting off an additional 33 single-family lots. Lots 32 and 33 are not being developed at this time because a portion of each lot is within a designated flood hazard area. This submitted final plat provides for the further subdivision of property in two portions of the subdivision. One will be served by an extension of Morning Dove Lane and include the construction of two courts to be named West Morning Dove Court and East Morning Dove Court. The second area of the subdivision Subdivision Staff Report - Furuseth's 6th Subdivision Page 3 is further to the south and includes a new cul-de-sac street to be named Turkey Valley Lane. All streets will be built to the County standards for residential streets of 22 feet of paving and 66 feet of right-ot-way. The subject property is located within a secondary growth area based on the Fringe Area Development Policy adopted by the City in March 2004. The proposed streets do not comply with the requirements of the Fringe Area Development Policy. However, this subdivision, as was previously noted, began betore this property was within two miles of the city. City staff has no objection to continuing the subdivision's street network based on the existing County standard. The submitted final plat does require that the City Council allow lots 23 and 25 to be platted as double frontage lots. The City's Subdivision Regulations prohibit thru lots unless one of the streets the lot fronts on is an arterial street that does not allow any access to it. The City Council could waive the restriction on thru lots and restrict access tor lots 23 and 25 to only West Morning Dove Court. The other waiver being requested of the City Council is that lot 15 only provides 40-foot of lot frontage on the proposed Turkey Valley lane, where 50 feet of frontage is required. This lot is termed a flag lot. There is a narrow access provided to the street for access with the bulk of the lot located behind another lot. Generally these types of lots are discouraged as it places one residence behind another, and eliminates some of the privacy of a rear yard. lot 15, as platted, is located behind lot 14 of this subdivision and lot 19 of Furuseth's 5th Subdivision.
