Van Milligen, City Manager SUBJECT: Clarke College - Pedestrian Crossing Improvements on Clark Drive Clarke College has requested improvements to the student and pedestrian crossing corridor on Clark Drive between the Atrium building and the Kehl Center. Based on City Council Action of May 16, 2005, Clarke College and City Engineering staff have developed construction documents for the proposed streetscape design. The street improvements will function as a traffic-calming measure while reducing traffic speeds and provide pedestrian crossing in the area. Clarke College is funding the construction and taking responsibility for extraordinary snow removal and maintenance costs. Van Milligen, City Manager Robert Schiesl, Civil Engineer RD S SUBJECT: Clarke College - Pedestrian Crossing Improvements on Clarke Drive INTRODUCTION Clarke College has indicated a request to improve the student and pedestrian crossing corridor on Clarke Drive between the Atrium building and the Kehl Center. Based on City Council action on May 16, 2005, the College has prepared construction documents which provide for the construction of bump-out and drop-off areas and will incorporate decorative colored concrete and the installation of historic street lights. The proposed improvements are intended to compliment the streetscape appearance of Main Street. The College feels that the street improvements will function as a gateway for the campus and will function as traffic calming measures while reducing traffic speeds and provide a safer pedestrian crossing in the area. DISCUSSION Engineering staff has worked collectively with Clarke College to develop the construction documents for the proposed streetscape design. Concerns regarding storm water drainage and winter snow removal issues have been addressed by the attached agreement between the City and Clarke College. This agreement outlines that Clarke College will be fully responsible for all costs associated with the proposed streetscape improvements which include the construction of storm water drainage improvements, as well as the installation, ownership and maintenance of the historic street lights. The agreement also requires Clarke College to perform snow removal operations in the bump-out and drop-off areas during the winter months. ACTION TO BE TAKEN Based on the approved streetscape design plan attached hereto, I respectfully request your concurrence with the proposed improvements for the pedestrian crossing corridor on Clarke Drive between the Atrium building and the Kehl Center and seek your approval to authorize the City Manager to execute the attached agreement. cc: Gus Psihoyos, City Engineer Ronald Turner, PLS Gene Kirschbaum, Vice President, Clarke College Mike Portzen, Portzen Construction, Inc. AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND CLARKE COLLEGE Ip This Agreement, dated for reference purposes this v. --- day of 2005, by and between the City of Dubuque (City) and Clarke Whereas, Clarke College is the owner of real property abutting Clarke Drive, a public street, in the City of Dubuque, Dubuque County, Iowa; and Whereas, Clarke College desires to construct certain improvements in the Clarke Drive public right of way; and Whereas, City is willing to allow Clarke College to construct such improvements in the public right of way but only upon the terms and conditions set forth herein. Now, therefore, in consideration of a mutual covenant set forth herein, City and Clarke College agree as follows: 1. City hereby grants to Clarke College permission to construct decorative lighting, wiring, and appurtenances in the public right of way along Clarke Drive and Clarke College agrees to construct, remodel and maintain decorative lighting, wiring, and appurtenances in accordance with plans submitted by it and approved by City's Engineering Department attached hereto as Exhibit A and to the Engineering Department Standards and Specifications and at no cost to City. 2. Clarke College shall be responsible for all 'snow removal in the street between the "bump out" areas of curbing constructed by it along Clarke Drive as necessary to provide safe pedestrian and vehicular traffic. 3. Clarke College shall pay to City the extra cost of any colored concrete as may be necessary from time to time for City to repair Clarke Drive abutting the Clarke College property or any underground utilities on or in Clarke Drive abutting the Clarke College property. 4. If Clarke College constructs a storm sewer on its property, such storm sewer shall be constructed in accordance with plans submitted by it and approved by City's Engineering Department and to the Engineering Department Standards and Specifications and at no cost to City. 5. Clarke College shall, prior to construction of the storm sewer, grant to City an easement for access to the storm sewer on Clarke College property. 6. City shall defend, indemnify and hold Clarke College, its officers, agents and employees harmless from and against any claim arising out of the negligence of City, its officers, agents or employees, in the performance of this Agreement by City.
