The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Associate Planner Kyle Kritz reviewed the proposal, noting that the submitted final plat
subdivides the Dubuque Industrial Center West into four additional building lots served by a
new public street to be named Synergy Court. The Zoning Advisory Commission is being
asked to waive the requirement for submittal of a preliminary plat.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the plat is consistent
with existing development of the industrial park, and is in compliance with the
Comprehensive Plan
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, waiving the requirement for a preliminary plat (Section 42-14[d][2]).
A simple majority vote is needed for the City Council to approve the request.

Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns: The proposed cul-de-sac street will be built to City publiC street
standards with 37 feet of paving and 66-foot of right-of-way. The proposed public street
will intersect with Chavenelle Road. There are no traffic counts available for either
street at this time.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment provided
adequate erosion control is provided during all phases of development.
Adjacent Properties: Adjacent properties are zoned for either commercial service or
industrial uses, and the proposed development of this property will be compatible with
adjacent properties.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat for Lots 1 thru 4, and Lot A, 8, and C of Dubuque
Industrial Center West 3rd Addition subdivides an existing portion of the Dubuque Industrial
Center West into three new industrial lots. The three lots will be served by a new public
street to be named Synergy Court that will be built to the City's public street standards of 37
feet of paving and 66-foot of right-of-way.
The Zoning Advisory Commission is being asked to waive the subdivision requirements that
stipulate that a preliminary plat must be submitted whenever a major subdivision is
proposed. Planning staff does not believe a preliminary plat is warranted for this small
change to the Dubuque Industrial Center West. While the original conceptual plan!
preliminary plat for Dubuque Industrial Center West did not include this street, the proposed
change is small in nature and only encompasses a total of 26 acres. In addition, both the
Zoning Advisory Commission and the City Council will still review the submitted plat; thus the
review process is no shorter than if a preliminary plat were submitted.
Drainage from the proposed industrial lots will be handled by the existing storm water
detention basin in this portion of the Dubuque Industrial Center West. Water and sewer
mains will be extended as part of construction of the new street to serve the three new lots.
Planning staff recommends that the submitted Final Plat of Lots 1 thru 4 and Lots A, 8 and C
of Dubuque Industrial Center West 3rd Addition be approved as it is in substantial
compliance with the City of Dubuque Subdivision Regulations.

RESOLUTION NO. 292-05
A RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1 THRU 4, AND
LOTS A, B, AND C OF DUBUQUE INDUSTRIAL CENTER WEST 3RD
ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk the Final Plat of Lots 1 thru 4,
and Lots A, B, and C of Dubuque Industrial West 3rd Addition in the City of Dubuque;
and
Whereas, upon said Final Plat appears a street to be known as Synergy Court
(Lot A), together with certain public utility and sanitary sewer easements which the
owners by said Final Plat have dedicated to the public forever; and
Whereas, said Final Plat has been reviewed by the Zoning Advisory Commission
and had their approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Synergy Court (Lot A) together with
easements for public utilities and sanitary sewer as they appear upon said Final Plat be
and the same are hereby accepted; and
Section 2. That the Final Plat of Lots 1 thru 4, and Lots A, B, and C of
Dubuque Industrial Center West 3rd Addition is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Final Plat. The Mayor hereby is authorized to behalf of the
City of Dubuque.
Section 3. Sidewalk installation shall be the responsibility of the owner of the
property abutting the public right-of-way, including lots with multiple frontages, as
required by City Code 41-161 through 41-164. The responsibility shall extend to all
successors, heirs and assignees. Sidewalk installation will not be required until the
development of the lot has been completed except as required herein. Sidewalks shall
be five (5) feet in width and installed one (1) foot from the property line. All vacant lots

shall have sidewalks installed upon development of eighty percent (80%) of the
developable lots approved by the Final Plat.
Section 4. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer that all public improvements have been
completed in accordance with the improvement plans and City standard specifications.
Passed, approved and adopted this 5th day of July, 2005.
