Van Milligen, City Manager SUBJECT: Widening of Asbury Road at the Northwest Arterial (CIP 300221: Asbury Road Widening) On June 6, 2005, the City Council accepted the Widening of Asbury Road at the Northwest Arterial Project, as completed by Portzen Construction, Inc. in the final contract amount of $63,545.60. This project included a $500 per day incentive, up to $5,000, for every day the project was completed prior to November 24, 2004. Based on the time completion of the work, Portzen Construction, Inc. was entitled to an additional $4,500 compensation incentive. However, that amount was not included in the final contract amount approved by City Council. City Engineer Gus Psihoyos recommends the City Council approve an Amended Resolution accepting the Widening of Asbury Road at the Northwest Arterial Project and approving the final contract amount of $68,045.60, which includes the additional $4,500 incentive compensation to Portzen Construction, Inc. Van Milligen, City ManA~ Gus Psihoyos, City Engineer fl ~ TO: SUBJECT: Widening of Asbury Road at the Northwest Arterial (CIP 300221: Asbury Road Widening) INTRODUCTION The enclosed resolution provides for amending the Resolution No. 239-05 adopted by the City Council on June 6, 2005, accepting the Widening of Asbury Road at the Northwest Arterial Project. BACKGROUND This project provided for the widening of Asbury Road to facilitate the construction of additional through lanes for westbound traffic on the north side and for eastbound traffic on the south side of Asbury Road east of the Northwest Arterial. The additional traffic lanes provide two through lanes on each of the four legs of the intersection. The scope of the work was expanded to include additional grading for the proposed sidewalk construction along the north side of Asbury Road. DISCUSSION On June 6, 2005, the City Council approved Resolution No. 239-05 accepting the Widening of Asbury Road at the Northwest Arterial Project. This project was completed by Portzen Construction, Inc. of Dubuque, Iowa. The resolution also approved the final contract amount of $63,545.60, which was a 7.4% increase from the original contract amount of $59,165.50. The project included a $500 per day incentive up to $5,000 for every day the project was completed prior to November 24, 2004 and a $1,000 per day penalty for work not completed by that date. Based on the time completion of the work, Portzen Construction, Inc. was entitled to an additional $4,500 compensation incentive. However, that amount was not included in the final contract amount approved in the original Resolution No. 239-05. RECOMMENDATION I recommend that the City Council adopt the attached resolution amending Resolution No. 239-05 accepting the Widening of Asbury Road at the Northwest Arterial Project and approving the final contract amount of $68,045.60 which includes the additional incentive compensation to Portzen Construction, Inc. in the amount of $4,500. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution amending Resolution No. 239-05 accepting the Widening of Asbury Road at the Northwest Arterial Project and approving the final contract amount of $68,045.60 which includes the additional incentive compensation to Portzen Construction, Inc. in the amount of $4,500. Turner, PLS cc: Dawn Lang, Budget Director Bob Green, Water Plant Manager RESOLUTION NO. 293-05 AMENDING RESOLUTION NO. 239-05 ACCEPTING THE WIDENING OF ASBURY ROAD AT THE NORTHWEST ARTERIAL ROAD PROJECT AND APPROVING THE FINAL CONTRACT AMOUNT Whereas, the contract for the Widening of Asbury Road at the Northwest Arterial Road Project (the Project) has been completed and the City Manager has examined the work and filed a certificate stating that the Project has been completed according to the terms of the contract and the plans and specifications and the City Manager has recommended that the Project be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Manager is approved and the Project is hereby accepted and the final contract amount of $68,045.60 is hereby approved. Section 2. The City Treasurer is hereby directed to pay to the contractor from the Fiscal Year 2005 Street Construction Fund the contract amount of $68,045.60 less any retained percentage provided for therein as provided in Iowa Code Chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
