Dear Ms. Schneider:
Pursuant to our plans to develop the Institutional District as presented and approved at the
City Council meeting of February 21,2005, we are requesting the City Council include
and consider as part of their next meeting agenda our request to vacate and sell city
property as indicated in the attached Exhibit A. This property would include the
following:
-Parcels A-I and A-2 along N. Orandview Avenue to be purchased by
Grandview University LLC.
-Parcel B that includes a portion of Stewart St. to be purchased by
Grandview University LLC.
.Parcel D an alleyway to be purchased by The Finley Hospital.
-Parcel C to be purchased by The Finley Hospital.
We have been working with city personnel to ensure that we cover and are in agreement
regarding the details of this project, including the relocation of utilities to accouunodate
construction of a Hartig USA Drug Store and The Kehl Diabetes Center.

SUBJECT: Vacating Petition
In response to a request from Finley Hospital President and CEO John Knox and Hartig
Drug Stores President Dick Hartig, City Engineer Gus Psihoyos is recommending that
the City vacate a portion of Stewart Street, a portion of Grandveiw Avenue and portions
of adjacent alleys between Delhi Street and University Avenue.
I concur with the recommendation and respectfully recommend that a public hearing be
set for July 18 2005.

Finley Hospital. Engineering feels it may be beneficial to realign the remaining
100 feet of curb along North Grandview from the Dubuque Bank & Trust
driveway to the Delhi intersection to provide a better street transition. This
approximate cost of $5,000.00 is proposed to be at the City expense.
The property to be vacated has been valued at $4.56 per square foot, for a total
of $140,388.72. Performance and two-year maintenance bonds will be required
for sanitary sewer and watermain location costs prior to the recording of the
deeds.
RECOMMENDATION
The City has no plans for the utilization of a portion of Stewart Street, a portion of
North Grandview Avenue, and portions of adjacent alleys between Delhi Street
and University Avenue to be vacated since the petitioners have agreed to
relocate the affected utilities.
I would recommend that the areas indicated by Lot 2 Grandview University
Place, Lot 2 of 1 of Rigi Subdivision No.2, Lot A, Lot B, Lot C, and Lot 0 all of
Loetscher and Truebs Subdivision in the City of Dubuque, Dubuque County,
Iowa as shown on the attached plats to be vacated, and that a public hearing be
set for the disposition of the City's interest in the subject area on July 18, 2005. I
would further recommend that the purchase price be established at $140,388.72,
plus design and relocation of all utilities, street modifications along North
Grandview Avenue from University Avenue to the north side of the Dubuque
Bank & Trust's driveway, platting, publication and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the disposal of the property through adoption of
the enclosed resolutions and ordinances.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOTS
C AND D OF LOETSCHER AND TRUEBS SUBDIVISION IN THE CITY OF
DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, the Grandview University LLC and The Finley Hospital have
requested the vacating of a portion of Stewart Street and adjacent alleys south of
University Avenue; and
Whereas, IIW Engineers & Surveyors, PC has prepared and submitted to
the City Council a plat showing the vacating of a portion of Stewart Street and
adjacent alleys south of University Avenue and assigned lot numbers thereto,
which hereinafter shall be known and described as Lots C and 0 of Loetscher
and Truebs Subdivision in the City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined
that this portion of Stewart Street and adjacent alleys south of University Avenue
is no longer required for public use, except for utility easements as noted, and
vacating and sale of said portions of alleys and streets known Lots C and 0 of
Loetscher and Truebs Subdivision in the City of Dubuque, Dubuque County,
Iowa should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in
Lots C and 0 of Loetscher and Truebs Subdivision in the City of Dubuque, Iowa.
Section 2. That the conveyance of Lots C and 0 of Loetscher and
Truebs Subdivision the City of Dubuque, Iowa to The Finley Hospital be
contingent upon the payment of $43,251.60 plus platting, publication and filing

engineered, constructed, and inspected at the expense of Grandview University
LLC and The Finley Hospital, in accordance with the City of Dubuque Standards

manner as prescribed by law.

The letter is written to inquire about the possibility of purchasing a portion of city
street and alley abutting my properties located on Stewart Street. We plan to
use this property to expand parking on the Finley campus and erect a new
pharmacy and a diabetes center.
We have contacted the Engineering Department and they have indicated a
favorable condition for the vacating, but may need easements reserved for
utilities. We understand that the vacated area would need to be surveyed and
platted at our expense and a fee paid for the parcel plus publication and filing

Dear Ms. Schneider:
Pursuant to our plans to develop the Institutional District as presented and approved at the
City Council meeting of February 21,2005, we are requesting the City Council include
and consider as part of their next meeting agenda our request to vacate and sell city
property as indicated in the attached Exhibit A. This property would include the
following:
-Parcels A-I and A-2 along N. Grandview Avenue to be purchased by
Grandview University LLC.
-Parcel B that includes a portion of Stewart St. to be purchased by
Grandview University LLC.
-Parcel D an alleyway to be purchased by The Finley Hospital.
-Parcel C to be purchased by The Finley Hospital.
We have been working with city personnel to ensure that we cover and are in agreement
regarding the details of this project, including the relocation of utilities to accommodate
construction of a Hartig USA Drug Store and The Kehl Diabetes Center.
