The Dubuque Convention & Visitors Bureau on behalf of Superfine, Inc.lJackson Films, Inc., is "requesting use of City-owned property north of Eagle Point Park for the purpose of filming a documentary on July 22, 2005. Corporation Counsel Barry Lindahl, Fire Chief Dan Brown, and Leisure Services Manager Gil Spence have been consulted on this request and, the film company has provided a signed Indemnification Agreement. I concur with the recommendation and respectfully request Mayor and City Council approval. " j __~l \: ..._ _J __ "_.l Dl:;~~E ~YAe-~ MEMORANDUM June 30,2005 TO: Michael Van Milligen, City Manager Randy Gehl, Public Information Officer U- SUBJECT: Request to Film on City of Dubuque Property FROM: Discussion The purpose of this memo is to request City Council approval of the request from the Dubuque Convention & Visitors Bureau on behalf of Superfine, Inc. to film a documentary on City of Dubuque property north of Eagle Point Park on July 22, 2005. This documentary for the Hallmark Channel on heroism will feature an incident that occurred in Dubuque on May 6, 2000, when a boy who had slid down a bluff north of Eagle Point Park was assisted by a passerby. Portions of the documentary will be filmed on the bluff on which the incident occurred. Superfine also plans to film a recreation of the bluff rescue utilizing a licensed stunt coordinator. Corporation Counsel Barry Lindahl, Fire Chief Dan Brown, and Director of Leisure Services Gil Spence have been consulted on this request. We have received a signed Indemnification Agreement from Superfine, Inc. Recommendation I recommend City Council approval of the Indemnity Agreement for use by Superfine, Inc. to film the documentary on City of Dubuque property. INC. This Indemnification Agreement, dated for ref~rence purposes this ~ ~ay of fl.l tv ~ , 2005, is made and entered Into by and between~ City of Dubuque, Iowa (City) and Jackson Films, Inc. (Jackson). WHEREAS, City is the owner of Eagle Point Park and certain property surrounding Eagle Point Park (the Property); and WHEREAS, Jackson desires access to the Property for the purpose of producing a documentary; and WHEREAS, City agrees to grant access to Jackson upon the terms and conditions set forth herein. . NOW, THEREFORE, IT IS AGREED BY AND BETVVEEN THE PARTIES AS FOLLOWS: 1. City hereby grants access to the Property to Jackson for the purpose of producing a documentary on July 21-23,2005. . 2. Jackson shall coordinate its access to the Property with City's representative, Randy Gehl, Public Information Officer, City Hall, 13tti & Central Avenue, Dubuque, Iowa, 52001, (563 589-4110). Jackson's representative for purposes of this Agreement is Lisa Jackson whose address is 102 West 851h Street, Suite #12-8, New York City, NY, 10024, and whose telephone number Is (212) 496-9382. 3. To the fullest extent permitted by law, Jackson shall indemnify and hold harmless City from and against any and all claims, damages, losses and expenses, including but not limited to attorneys fees, arising out of or resulting from Jackson's access to the Property, provided that such claim. damages, losses or expenses attributable to bOdily injury, sickness, disease or death, or injury to or destruction of property including loss of use resulting therefrom, but only to the extent caused in whole or in part by negligence acts or omissions of Jackson. Its officers, agents and employees, or anyone directly or Indirectly employed by Jackson, or anyone for whose acts Jackson is may be liable, regardless of whether or not such claim, damage, losses or expenses caused in part by 8 party indemnified hereunder. 4. The Hallmark Channel is currently filming a documentary on heroism. They are featuring an incident that occurred in Dubuque on May 6, 2000. A 7 year old boy, Jeff Kraft, began to slide down a bluff north of Eagle Point Park. He was assisted to safety by an educator, Jean Burgmeier, who was out for a walk in the area. The documentary is being created by producer Lisa Jackson of: Superfine, Inc. 102 West 85th Street, Suite #12-B New York City, NY 10024 212.496.9382 On June 9-11, 2005 Superfine was in Dubuque for initial interviews and filming with the families involved. They will return to Dubuque July 21-23 and are requesting permission to film a re-creation of the bluff rescue utilizing a licensed stunt coordinator. On June 10th, we walked the incident site with Fire Chief Dan Brown. Dan's review of the site was positive; noting no visible dangers. The likelihood of rattle snakes is low in that area. The site also provides a number of solid trees to which the stunt coordinator can tether ropes. Other sites also considered were Mines of Spain and Valeria Street. The initial location is the preferred site because of the number of solid trees. Park and Recreation Director, Gil Spence, has been advised and has no concerns. Please review and advise if Superfine, Inc may film on the City of Dubuque bluff property north of Eagle Point Park.
