The enclosed resolution provides for the acceptance of the Dubuque Packing Company
Memorial (Memorial).
BACKGROUND
On June 6, 2011, the City accepted a donation from Chuck Stoltz, former Chairman and
President of the Dubuque Packing Company (the Pack), for an informative tribute
memorial located at the southwest corner of 16th and Sycamore Streets, just north of the
Bee Branch Creek Restoration Project. Mr. Stoltz worked with Brannon Monument Co.
to create a tribute that would serve as a "remembrance of this significant community
icon" and to recognize the "thousands of people who made their living at the Dubuque
`Pack ". The Memorial consists of three (3) granite panels depicting a: collage of
various Pack products and operational aspects; narrative of the Pack's history, growth,
and impact; and an aerial of the plant site. (Note attachment.)
Per Council approval, the City was to build, own, and maintain the Memorial.
DISCUSSION
The Dubuque Packing Company Memorial was been built by Brannon Monument Co. of
Dubuque, Iowa, in the final contract amount of $42,470.00, which was 15.1% below the
project estimate of $50,000.
RECOMMENDATION
I recommend that the City Council accept the Dubuque Packing Company Memorial as
a public improvement and the Stoltz donation of $42,470.00 to complete the Memorial.
BUDGET IMPACT
The initial cost of $42,470.00 of the Dubuque Packing Company Memorial was charged
to the Bee Branch Creek Restoration Project (CIP 7201654); however, Mr. Stoltz has
reimbursed the City for the entire project amount.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution to accept the public
improvement and the Stoltz donation of $42,470.00 for the Dubuque Packing Company
Memorial.

RESOLUTION NO. 75 -12
ACCEPTING THE DUBUQUE PACKING COMPANY MEMORIAL AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Dubuque Packing Company
Memorial (the Project) has been completed and the City Engineer has examined the
work and filed a certificate stating that the Project has been completed according to the
terms of the Public Improvement Contract and that the City Engineer recommends that
the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor
from the Bee Branch Creek Restoration Project appropriation for the contract amount of
$42,470.00 less any retained percentage provided for therein as provided in Iowa Code
chapter 573, and to pay such retainage only in accordance with the provisions of Iowa
Code chapter 573.

performed in compliance with the terms of the Public Improvement Contract, and that
the total cost of the completed work is $42,470.00.
