Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed project and the location of
the addition to Catherine Byrne Hall and a new 179 -space parking lot.
Staff reviewed the staff report, reviewing the proposed project, the requirements for an ID
amendment, the revised location of the access to the proposed parking lot, and the results of
staff's on- street parking survey.
There was one public comment regarding the extent of the Institutional District boundaries.
The Zoning Advisory Commission discussed the request, reviewing the size of the parking lot
and required screening.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

Project Description
January 23, 2012
The following is a description of projects to be implemented within the overall Master Plan at Clarke
University during the 2012 / 2013 calendar year. The main project involves an addition to and partial
renovation of Catherine Byrne Hall (CBH). In addition, a new surface parking lot will be constructed to
the north of CBH across Clarke Drive.
1. CBH Science Addition
A new 44,120 gross square foot addition will be constructed east of CBH with a direct link to the
existing building on three levels. The addition will be comprised of three stories above grade
plus a new mechanical penthouse. The addition will include new classrooms, teaching and
research laboratories for science instruction as well as 7 faculty offices. The east end of the
existing building will be partially renovated to accommodate the new addition. These
renovations will convert existing classroom and lab space into renovated laboratories and
include 5 additional faculty offices. The addition will require the removal of 26 parking spaces in
the terraced parking area east of CBH to accommodate the new footprint.
2. New Surface Parking Lot
A new surface parking lot will be constructed on the north side of Clarke Drive. The parking lot
will provide 179 parking stalls.

Purpose: To amend the ID Institutional District for Clarke University to allow the
construction of a new science addition to Catherine Byrne Hall and construction of a
new 179 space parking lot at the northwest corner of Clarke Drive and Clarke Crest
Drive.
Property History: The area designated for Science Addition has been utilized for off -
street parking since construction of Catherine Byrne Hall. The area designated for the
new parking lot has been utilized primarily as open space and an existing single - family
home owned by Clarke University.
Physical Characteristics: The subject property for the proposed Science Addition
slopes to the east while the property for the proposed parking lot also slopes toward the
northwest corner of Clarke Drive and Clarke Crest Drive.
Conformance with Comprehensive Plan: The 2030 Future Land Use Map
designates the property for institutional use. The proposed project implements the
Comprehensive Plan's Land Use and Urban Design Goals: 1.5, 1.8, 5.3, 6.2, 7.2, 7.3,
9.1, 9.2, and 9.4.

Staff Analysis:
Streets: Access to the proposed Science Addition will be from an existing access
from Clarke Drive. The proposed parking lot will have a new access on Clarke
Drive approximately 100 feet west of Clarke Crest Drive.
Sidewalks: There are existing sidewalks along Clarke Drive and Clarke Crest
Drive. These sidewalks will remain as part of the development of the Science
Addition and parking lot.
Parking: A total of 179 parking spaces are proposed for the parking lot to be
constructed at the northwest corner of Clarke Drive and Clarke Crest Drive. Staff
found that an average of 15 cars were parked on Clarke Crest Drive with peak
demand during weekday morning hours. An average of 20 cars were parked on
Clarke Drive with the peak period again occurring during the weekday morning
hours. The proposed 179 space parking lot is more than adequate to provide
sufficient off - street parking for motorists utilizing the two city streets outside the
campus area for parking.
Lighting: New outdoor lighting will require use of cut -off luminaries to reduce the
lighting effect to adjacent properties.
Signage: No signage has been proposed as part of the new Science Addition.
Bulk Regulations: As shown on the attached conceptual plan.
Permeable Area ( %) & Location (Open Space): The proposed science addition to
Catherine Byrne Hall will be built over an area that is primarily an impermeable
surface. The proposed off - street parking lot at the northwest corner of Clarke Drive
and Clarke Crest Drive will remove 1.5 acres of permeable area. Storm water
control will be reviewed as part of the site plan for both the building addition and
parking lot.
Landscaping /Screening: A detailed landscape plan will be required as part of the
submittal of the site plan for the Science Addition and the new parking lot.
Landscaping will be provided around the proposed Science Addition. The
proposed off - street parking lot will also be required to provide landscaping adjacent
to residential properties and abutting public streets in compliance with the Unified
Development Code Design Standards for parking lots.
Phasing of development: Clarke University is proposing to begin construction in
the spring of 2012 subject to approval of this Institutional District Amendment.

Utilities: Existing utilities are adequate to handle the proposed project.
Traffic Patterns /Counts: Based on recent Engineering Department counts, there
are approximately 4,625 average daily trips on Clarke Drive.
Public Services: Existing public services are adequate to serve the proposed
development
Environment: No adverse impact to the environment is anticipated if adequate
erosion control is provided during all phases of construction. In addition, storm
water control will be necessary as part of the development to alleviate negative
impacts on the environment caused by water runoff and soil erosion.
Adjacent Properties: The proposed Science Addition should have limited impact
on surrounding residential properties. The Science Addition is located on an
existing portion of the university campus and will be of a scale and design that
compliments the existing campus area. The new parking lot will provide additional
off - street parking spaces for students currently utilizing public on- street parking.
The proposed parking lot will be required to be landscaped but will present a
visual change to residents on the east side of Clarke Crest Drive.
CIP Investments: None proposed.
Staff Analysis: Clarke University is proposing the construction a 44,120 square foot
Science Addition that will be constructed on the east side of Catherine Byrne Hall with a
direct link to the existing building on three levels. The addition will be three stories
above grade plus a new mechanical penthouse. The new surface parking lot will be
constructed on the north side of Clarke Drive west of Clarke Crest Drive and will provide
179 additional off - street parking spaces. Attached to this staff report is a campus plan
showing location of the new addition, location and layout of the new parking lot, and
elevation drawings of the new addition.
The subject property is currently zoned ID Institutional District. The Institutional District
regulations require that substantial on- campus expansions be reviewed by the Zoning
Advisory Commission and City Council as an Institutional District Amendment.
The Catherine Byrne Hall Science Addition will include new classrooms, teaching and
research laboratories for science instruction as well as seven faculty offices. The
proposed addition addresses existing needs as well as allowing for future growth in the
University's programs. While it is difficult to assign a specific number of additional trips
generated by the proposed Science Addition, staff does not anticipate that the increase
in trip generation will exceed the capacity of Clarke Drive, which currently carries
approximately 4,625 average daily trips.

The addition to Catherine Byrne Hall will result in the removal of 26 existing parking
spaces in the terraced parking area east of the addition. The proposed new surface
parking lot located at the northwest corner of Clarke Drive and Clarke Crest Drive
provides for 179 parking spaces, a net gain of 153 spaces at the east end of the
campus.
City Engineering staff reviewed the proposed location of the access drive for the new
parking lot, and recommended that access be shifted to the west. The new location
meets established standards for spacing of accesses. A revised conceptual layout is
included in the packet that illustrates the new access location.
Planning staff conducted a parking survey to determine the average number of vehicles
parking on City streets outside the campus boundaries. Principally, this area included
two streets — Clarke Crest Drive and Clarke Drive east of the campus. The average
number of vehicles parked on the two street sections surveyed was 35 vehicles.
Planning staff also surveyed the three large existing parking lots on the Clarke
University campus. These lots are located east of Catherine Byrne Hall, another one
located east of the student activity center adjacent to the R. C. Wahlert Sports
Complex, and the third located on the west side of the campus. Staff found that these
parking lots, while heavily used, are never fully occupied during the two -week survey
period. Typically, the parking lot by the R. C. Wahlert Sports Complex and the parking
lot east of Catherine Byrne Hall were the most utilized with over 80% of the spaces
typically occupied. The large parking lot on the west end of the campus typically had
somewhat less usage because of its proximity to campus buildings and was found to be
occupied at an average level of 70 %.
The proposed layout of the parking lot, as shown on the conceptual layout provided by
Clarke University is in substantial compliance with requirements of the Unified
Development Code (UDC) Design Standards for parking lots. Specifically, the parking
lot is setback from both Clarke Drive and Clarke Crest Estates a minimum of 10 -foot as
required by the UDC. In addition, the parking stall layout is compliant, except that two
additional islands are needed to break up the long parking rows on the east and west
sides of the parking lot.
Landscaping along Clarke Crest Drive and Clarke Drive will be required as part of the
Unified Development Code. These requirements will be applied as part of the site plan
review for the project.
Planning staff recommends that the Zoning Advisory Commission review Sections 5-
22(D) that establishes the criteria for review of institutional district amendments.

ORDINANCE NO. 27 -12
AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY PROVIDING FOR THE
APPROVAL OF AN AMENDED CAMPUS DEVELOPMENT PLAN FOR THE CLARKE
UNIVERSITY ID INSTITUTIONAL DISTRICT TO ALLOW CONSTRUCTION OF A
SCIENCE ADDITION AND ASSOCIATED PARKING LOT AT THE INTERSECTION OF
CLARKE DRIVE AND CLARKE CREST DRIVE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, be amended by providing for the approval of an amended campus
development plan for Clarke University ID Institutional District, a copy of which is on file
with the City of Dubuque Planning Services Department.
Section 2. Institutional District Regulations.
A. Use Regulations
The following regulations shall apply to all uses made of land in the
above - described ID Institutional District:
1. Principal permitted uses shall be limited to:
a. Offices for administrative personnel or other institutional
employees and affiliates.
b. Churches, libraries, and museums.
c. Classrooms, laboratories, lecture halls, and similar places of
institutional assembly.

d. Off- street parking and loading.
e. Recreational or athletic facilities for the primary use and
benefit of institutional residents or affiliates.
f. Single-family, two - family or multi - family dwellings for the
housing of institutional residents or affiliates.
2. Accessory Uses. The following uses shall be permitted as
accessory uses in the above- described ID Institutional District.
a. Located entirely within a principal building, bookstores, or
bars seating not more than seventy -five (75) persons at one
time and located not closer than two hundred feet (200')
from the nearest Residential or Office Residential District.
b. All uses customarily incidental to the principal permitted
uses in conjunction with which such accessory uses
operated or maintained, but not to include commercial use
outside the principal building.
3. No conditional uses shall be allowed.
B. Lot and Bulk Regulations
Development of land in the ID Institutional District shall be regulated as
follows:
The proposed Catherine Byrne Hall Science Addition and new parking
lot shall be constructed in substantial conformance with the attached
amended campus development plan.
C. Performance Standards
The development and maintenance of uses in this ID Institutional
District shall be established in conformance with Section 5 -22 of the
Unified Development Code and the following standards:
1. The storm water control shall be designed and built in accordance
with city regulations subject to review and approval by the City of
Dubuque Engineering Department.
2. That appropriate erosion and sediment control will be installed
prior to commencement of any land disturbing activity related to
the subject project, including all required state and city permits
related to erosion control.

3. New outdoor lighting shall utilize 72- degree cut -off luminaries.
4. Landscaping shall be provided in compliance with Article 13 of the
Unified Development Code.
5. All utilities, including telephone and cable television, shall be
installed underground.
6. Final site plans shall be submitted in accordance with Articles 12
and 13 of the Unified Development Code.
D. Parking Requirements
The off - street parking requirements for the principal permitted uses for
the herein described ID Institutional District shall be regulated as
follows.
1. The number, size and layout of off - street parking shall be in
substantial compliance with the amended campus plan.
2. The design of the parking lot shall comply with Article 13 of the
Unified Development Code.
3. Any significant expansion or reduction in the number of off - street
parking spaces must be reviewed by Planning Services staff for
compliance with the adopted Institutional District regulations.
E. Sign Regulations
The sign regulations shall be the same as that which are allowed in the
ID Institutional District as established in Article 15 of the Unified
Development Code.
F. Additional Standards
That all previously approved campus development plans are hereby
amended to allow for the attached campus development plan.
G. Transfer of Ownership
Transfer of ownership of property in this ID Institutional District requires
rezoning of the property to an appropriate zoning district.
H. Modifications
Any modifications of this Ordinance must be approved by the City
Council in accordance with zoning reclassification proceedings of
Article 9 • of the Unified Development Code.

Section 3. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
