Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed the submitted Pat of Survey, noting that Lot 2-9 is designated as non-
buildable, due to fact there is only 375 square feet of lot area and because it will provide
access to Emberwood Drive.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that except for Lot 2-9
not having sufficient lot area, the Plat of Survey is in substantial compliance with the
City Subdivision Regulations.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot area requirement for Lot 2-9 and waiving
Article IV, Design Improvement Standards, except Section 42-19, Blocks and Lots.
A simple majority vote is needed for the City Council to approve the request.

Iowa.
INTRODUCTION
The submitted plat of survey is located in Dubuque County off of Highway 386, better
known was John Deere Road. The subject parcel is located near the end of Diesel
Drive, a cul-de-sac on the west side of John Deere Road.
DISCUSSION
The submitted Plat of Survey is being reviewed by the Zoning Advisory Commission as
it is within two miles of the city of Dubuque. Plats of Survey within two miles of the City
of Dubuque are jointly reviewed between the County and the City. The Zoning Advisory
Commission is being asked to waive the lot area requirement for Lot 2 of 9 as it only
contains 375 square feet, where 5,000 square feet is the minimum lot size. Lot 2 of 9 is
only used as an access to Lot 1 of 9 from Emberwood Drive. The submitted Plat of
Survey has designated Lot 2 of 9 as non-buildable.
RECOMMENDATION
Planning Staff recommends that the Plat of Survey of Lot 1 of 9 and Lot 2 of 9
Ridgeway Park in Dubuque County, Iowa be approved as it is in substantial compliance
with the City of Dubuque Subdivision Regulations, subject to waiving the lot area
requirement for Lot 2 of 9 and waiving Article IV, Design Improvement Standards, of the
Subdivision Regulations, ebCcept for Section 42-19, Blocks and Lots.

RESOLUTION NO. 323-05
RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1-9 AND LOT 2-9 OF
RIDGEWAY PARK IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey Lot 1-9 and
Lot 2-9 of Ridgeway Park in Dubuque County, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval endorsed there; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 3. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks
and Lots.
Section 2. That Section 42-19(b} of the Subdivision Regulations is waived to
allow Lot 2 of 9 to have 375 square fee of area, where 5,000 feet of lot area is required,
because said lot is designated as a non-buildable lot and is for access purposes only.
Section 3. That the Plat of Survey Lot 1-9 and Lot 2-9 of Ridgeway Park is
hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said plat of survey.
