INTRODUCTION
The purposes of this memorandum are to provide information and recommend a course
of action regarding previous Board authorization to immediately increase the full -time
complement of workers that the City of Dubuque provides by contract to the Agency.
BACKGROUND
At your last business meeting on February 131h, as part of the FY13 -FY22 budget
consideration and adoption process, you approved the immediate hiring of and
compensation for a full -time maintenance worker. This action was a direct outcome of
the Landfill Operations Analysis Report submitted to you earlier in the meeting by Foth's
Brian Harthun and Warren Shuros.
DISCUSSION
Staff is ready to move ahead with said hiring but proffers a recommended change
regarding same. But first of all, please know that a qualified and experienced candidate
already works for the Agency /City — Seasonal Equipment Operator Dan Decker. Mr.
Decker has worked for the Agency as a seasonal employee for over ten years. He is
staff's choice to fill the position. However, due to Iowa Civil Service law, he cannot be
immediately hired as a full -time worker unless his previous status as an equipment
operator is recognized and compensated for. Also, since the classification of Landfill
Maintenance Worker is entirely new to the City organization, no one can be hired for the
position before a protracted Civil Service process is completed.
A Landfill Maintenance Worker would be compensated under the City's current
Teamster contract at $19.76 /hour. A Landfill Equipment Operator would be
compensated at $20.18 /hour — or $874 /year more. While Iowa Civil Service law would
allow Mr. Decker to start work tomorrow for the City /Agency as a Landfill Equipment
Operator, that same law would require the City to go through the laborious process of
putting together a job description, writing an exam, giving the exam, grading the test
results, and interviewing candidates - along with the many other Civil Service
Commission approval steps /meetings along the way. Based on staff's recent
experience with the similarly -new Landfill Equipment Operator job classification, we
would not expect to have a Landfill Maintenance Worker hired before October.
ACTION STEP
The Directors are requested to give consideration to changing the direction previously
provided staff last month regarding additional staffing and authorize that the additional
full -time position be a Landfill Equipment Operator instead of a Landfill Maintenance
Worker.

RE: Extension of Waste Delivery Contract

Section 1 of the Waste Delivery Contract provides that "Upon written notice to the
Hauler of not less than 90 days, this Contract may be extended for two additional one -
year periods at the sole discretion of the Agency."
The purpose of this letter is to notify you that the Board of Directors of the Dubuque
Metropolitan Area Solid Waste Agency has voted unanimously to extend the Waste
Delivery Contract with your city for an additional one -year term commencing July 1,
2012 through June 30, 2013.
In the case that a new waste delivery contract is accepted by both parties prior to June
30, 2013, it would supersede the current, extended agreement.
