Airport Commission
I have recently been provided with an Attorney General's opinion from 1911 that
indicates that the offices of city council member and library board trustee may be
incompatible offices and thus may not be held by the same person at the same time.
While I do not necessarily agree with that opinion, I have recommended to the Mayor
out of an abundance of caution that a city council member not be appointed to the
Library Board of Trustees as he had proposed.
Because it could be argued that the rationale of the Attorney General's opinion applies
equally to the Airport Commission, and to avoid any claim of potential incompatibility of
those offices, Council Member Nicholson, who is now serving as a member of the
Airport Commission pursuant to city code, is resigning his Airport Commission seat.
I would recommend that the city code section providing for a seat on the Airport
Commission for a city council member be amended.
