The City Clerk's Office, City Hall, accepts applications for any Board andlor Commission at any time, and
that application .stays active for one year from the date of receiot in the Clerk's Office.
At the appropriate regularly scheduled council meeting, applications will be submitted to the City Council
for their review and applicants are encouraged to address the Council stating their reasons for wanting to
serve on this particular commission. Applicants will be advised when the application is being presented.

ELECTRICITY
reason of inadequate maintenance, dilapida-
tion, obsolescence, fire hazard, disaster, dam-
age or abandonment is, for the purpose of this
section, an unsafe use.
All such unsafe electrical systems or
equipment are hereby declared to be public
nuisances and shall be abated by repair, re-
habilitation, demolition or removal in accor-
dance with the procedures set forth in Chap-
ter 1 of the Code of Ordinances. As an alter-
native, the building official or other employee
or official of this jurisdiction as designated by
the governing body may institute any other
appropriate action to prevent, restrain, cor-
rect or abate the violation.
81-3. Electrical code board.
(a) Board established. In order to determine
the suitability of alternative materials
and methods of installation; to provide
for reasonable interpretations of the
electrical code; to serve as an appeal
body for the decisions of the building
official; to advise the city council on all
electrical regulations and procedures;
and to provide for examining applicants
for electrical contractor's registration,
electrical maintenance and journeyman
electrician certificates of competency and
issuing electrical contractor's registra-
tion and electrical maintenance and
journeyman certificates of competency,
there is hereby created the electrical
code board.
(b) Membership. The electrical code board
shall consist of five (5) members appoint.
ed by the city council. Four (4) members
shall have a background or experience in
electrical engineering, electrical contract-
ing, electrical installation or electrical
maintenance, and one (1) member shall
be appointed from the public at large.
(c) Term of office. The term of office of all
board members shall be three (3) years.
(d) Rules and regulations. The board shall
make such rules and prescribe such pro-
cedures as may be reasonably necessary

for its operation, except that such rules
shall include the following:
(1) Board chairperson. The chairperson
of the board shall be a member of
the board elected annually by a
majority of the board.
(2) Secretary of the board. The building
official, or designee, shall be secre-
tary of the board. The secretary
shall arrange for meetings and pre-
pare and keep such minutes and
records and perform such other
clerical work as the board may di-
rect.
(3) Quorum. Three (3) members shall
constitute a quorum. The concurring
vote of three (3) members of the
board shall be necessary to pass any
motion,
(4) Service until appointment of succes-
sor. Upon completion of the term
office, members of the electrical code
board shall continue to serve in
their full capacity until their succes-
sor has been duly appointed.
(5) Meetings. The electrical code board
shall meet at least once every three
(3) months upon call of the chairper-
son, secretary or city manager.
Members of the electrical code board
shall attend at least two-thirds (2/3)
of all scheduled meetings within a
twelve month period. If any member
does not attend such prescribed
number of meetings, it shall consti-
tute grounds for the board to recom-
mend to the city council that said
member be replaced.
(6) Attendance. The attendance of all
members shall be entered on the
minutes by the secretary.
(7) Conformity with open meetings law.
All meetings shall be held in confor-
mance with provisions of the Iowa
Open Meetings Law.
(8) Minutes. The electrical code board
shall file with the city council a copy
of the minutes of each meeting of
the board within ten (10) working
days after such meeting.

shall be subject to specific approval by the City
Council and any project requiring a referendum
as provideu in chapter 403A of the 1979 Code of

City in accordance with such chapter.
(c) The HouRing Commission shall monitor
the Cit.y's housing program and conduct hear-
ings on grievances which arise out of the opera-
tion of such program except in the area of hous-
ing code enforcement.
(d) 'fhe Housing Commission shall undertake
such additional duties. with regard to the HcJUs-
ing Trust Fund, as are specified in Chaptel" 26,

Sec. 15-23. Membership; Vacancies; Quali-
fications:
(a) 1'he Housing Commission shall be com-
prised of 8 membership of ten (10) persons.
(b) Current commissioners whose terms ex-
pire August 17, 1993, shall continue to serve
until such time, or until n successor is duly
appointed. Three (3) commissioners shall be
appointed for an initial term of two (2) years,
and three (3) commissioners shall be appointed
for an initial term of three (3) years. All suhse-
quent nppointmentsshall be for a term of three
(3) years, or until a succeSSOl" is duly appoint.ed.

(c) Vacancy caused by death, resignation or
otherwise on the Commission shall be promptly
:filled by the City Council for the unexpired
term of office.
(d) At least three (3) members of the Commis-
sion shall be selected specifically on the basis of
experience in real estate development, banking,
finance, accounting, funds management or other
related areas of expertise.
(e) One member of the Commission shall be a
person who is a recipient of tenant-based rental
a8sistance under section 8 of the United States
Housing Act of 1937 (42 use 14371) whose
name appears on a lease of section 8 pl"operty
and who is eighteen (18) years of age or older. If
such member ceases to be a recipient of rental
assistance under section 8, the term of BUch
.member shall be deemed terminated and a new
member who meets the reQuirements of this
subsection (e) shall be appointed for the re-

Sec. 16-24. Meetings:
(a) The Housing Commission shall hold at
least one official meeting per month.
(b) Members of the Commission shall attend
at least two-thirds (S/a) of all regularly sched-
uled and held meetings within a twelve (12)
month period. If any member does not attend
such a prescribed number of meetings, it shall
constitut.e grounds for the Commission to rec-
ommend to the City Council that said member
be replaced. The attendance of all members
shall be entered upon lhe minutes of all meet-

ARTICLE I. IN GENERAL
Sec. 27-1. DefinitioDS1:
When used in this chapter, the following
terms shall have the meanings ascribed herein
unless the context otherwise requires:
Commission: The Dubuque human rights
commission created by article II of this chapter.
Court: The Iowa district court in and for
Dubuque County.
Covered Entity: An employer, employment
agency, labor organization, or joint labor man-
agement committee.
Direct 'Threat: A significant risk to the health
or safety of others that cannot be eliminated by
reasonable accommodation.
Disability: With respect to a person:
(1) A physical or mental impairment which
. substantially limits one or more of such
person's major life activities, and the
condition of a person with a positive
human immunodeficiency virus test re-
sult, a diagnosis of acquired immune
deficiency syndrome, a diagnosis of ac-
quired immune deficiency syndrome
related complex, or any other condition
related to acquired immune deficiency
syndrome. The inclusion of a condition
related to a positive human immunodefi-
ciency virus test result in the meaning of
"disability" under the provisions of this
chapter does not preclude the application
of the provisions of this chapter to condi-
tions resulting from other contagious or
infectious diseases;
(2) A record of having such an impairment;
or
(3) Being regarded as having such an im-
pairment, but such term does not include
current, illegal use of or addiction to a
controlled substance as defined in section
102 of the controlled substances act (21
USC 802) or chapter 204 of the Iowa
Code.
Drug: A controlled substance, as defined in
schedules I through V of section 202 of the
controlled substances act.
Employee: An individual employed by an
employer.
Employer: The state or any political subdivi-
sion, board, commission, department, institu-
tion, or school district thereof, and every other
person employing employees within the state.
Employment Agency: Any person undertaking
to procure employees or opportunities to work
for any other person or any person holding such
person or itself to be equipped to do so.
Familial Status: One or more individuals
(who have not attained the age of 18 years)
being domiciled with:
(1) A parent or other person h8;ving legal
custody of such individual or individuals;
(2) The designee of such parent or other
person having such custody, with the
written permission of such parent or
other person; or
(3) The protections afforded against discrim-
ination on the basis of familial status
shall apply to any person who is. preg-
nant or is in the process of securing legal
custody of any individual who has not
attained the age of eighteen (18) years.
Labor Organization: Any organization which
exists for the purpose in whole or in part of
collective bargaining, of dealing with employees
concerning grievances, terms or conditions of
employment, or of other mutual aid or protec-
tion in connection with employment.
Person: An individual, partnership, associa-
tion, corporation, legal representative, trustees,

Public Accommodation: Each and every place,
establishment, or facility of whatever kind,
nature, or class that caters or offers services,
facilities, or goods for a fee or charge to non-
members of any organization or association
utilizing the place, establishment, or facility;
provided, that any place, establishment, or
facility that caters or offers services, facilities,
or goods to the nonmembers gratuitously shall
be deemed a public accommodation if the ac-
commodation receives any governmental sup-
port or subsidy. "Public accommodation" shall
not mean any bona fide private club or other
place, establishment, or facility which is by its
nature distinctly private, except when such
distinctly private place, establishment, or facili-
ty caters or offers services, facilities, or goods to
the nonmembers for a fee or charge or gratu-
itously, it shall be deemed a public accommoda-
tion during such period.
"Public accommodation" includes each state
and local government unit or tax supported.

under this chapter.

facility or facilities involved in the ac-
tion; the number of persons employed at
such facility; the effect on expenses and
resources, or the impact otherwise of

such action upon the operation of the
facility;
(3) The overall financial resources of the
covered entity; the overall size of the
business of a covered entity with respect
to the number of its employees; the num-
ber, type, and location of its facilities;
and
(4) The type of operation or operations of the
covered entity, including the composi-
tion, structure, and functions of the work
force of such entity; the geographic sepa-
rateness, administrative or fiscal rela-
tionship of the facility or facilities in
question to the covered entity.
Reasonable Accommodation: May include:
(1) Making existing facilities used by em-
ployees readily accessible to and usable
by individuals with disabilities; and
.
(2) Job restructuring, part time or modified
work schedules, reassignment to a va-
cant position, acquisition or modification
of equipment or devices, appropriate
adjustment or modifications of examina-
tions, training materials or policies, the
provision of qualified readers or inter-
preters, and other similar accommoda-
tions for individuals with disabilities.
Undue Hardship: An action requiring signifi-
cant difficulty or expense. In determining
whether an accommodation would impose an
undue hardship on a covered entity, factors to
be considered include:
(1) The nature and cost of the accommoda-
tion needed under this chapter;
(2) The overall financial resources of the
facility or facilities involved in the provi-
sion of the reasonable accommodation;
the number of persons employed at such
facility; the effect on expenses and re-
sources, or the impact otherwise of such
accommodation upon the operation of the
facility;

Sec. 30-1. Board Of Trustees-Composition:
The Carnegie-Stout Free Public Library of the
City shall be under the control and direction of
the Board of Library Trustees. Such Board shall
consist of seven (7) members who shall be ap-
pointed by the Mayor with the approval of the

Sec. 30-2. Board Of Trustees-Eligibility
For Membership:
Citizens and residents of the City, male or
female, over the age of eighteen (18) years, are
alone eligible for membership on the Board
mentioned in Section 30-1 of this Chapter.

Members of the Board described in Section
30-1 of this Chapter shall receive no compensa-

(a) The Board of Library Trustees described
in Section 30-1 of this Chapter shall have and

exercise the following powers:
(1) To meet and organize by the election of
one of their number as president of the
Board, and by the election of a secretary
and such other officers as the Board may
deem necessary;
(2) To have charge, control and supervision
of the public library, its appurtenances
and fixtures, and rooms containing the
same, directing and controlling all the
affairs of such library;
(3)
To employ a librarian, such assistants
and employees as may be necessary for
the proper management of said library,
and fix their compensation; but, prior to
such employment, the compensation of
such librarian, assistants and employees
shall be fixed for the term of employment
by a majority of the members of said
Board voting in favor thereof;
(4)
To remove such librarian, assistants or
employees by a vote of two-thirds (''/,) of
such Board for misdemeanor, incompe-
tency or inattention to the duties of such
employment;
(5) To select and make purchases of books,
pamphlets, magazines, periodicals, pa-
pers, maps, journals, furniture, fixtures,
stationery a~d supplies for such library;
(6) To authorize the use of such libraries by
nonresidents of the City and to fix charg-
es therefor;
(7) To make and adopt, amend, modify or
repeal bylaws, rules and regulations, not
inconsistent with law, for the care, use,
government and management of such
