Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing proposed changes to freestanding
sign regulations within the Wacker Plaza PUD.
Staff reviewed the existing sign regulations for the PUD and existing freestanding signage
within Wacker Plaza.
There were several public comments in support of the PUD Amendment and questions
regarding the impact to adjacent properties outside the PUD.
The Zoning Advisory Commission discussed the request, reviewing the existing layout of
the shopping plaza and existing freestanding signs.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request. c;

INTRODUCTION
ID & Associates, on behalf of John Viggers owner of Wacker Plaza and Aarons, a
general retailerf has submitted an application requesting an amendment to the Planned
Commercial District for the property located at 806 Wacker Drive (Wacker Plaza). The
request is to modify the sign regulations to increase the sign area of freestanding signs
and to remove the requirement that two of the five permitted freestanding signs be
center identification signs.
DISCUSSION
Wacker Plaza consists of three multi-tenant strip commercial buildings and two stand-
alone commercial buildings on a six-acre lot with frontage along Dodge Street and
Wacker Drive. Currently, the sign regulations governing the Wacker Plaza PUD permit
five freestanding signsf two of which must be center identification signs, not to exceed
25 feet in height and 100 square feet each. The applicant is asking to remove the
requirement that two of the freestanding signs be center identification signs. Therefore,
five freestanding signs would still be permitted. However, the requirement that two be
center identification signs would be removed allowing individual tenants to advertise on
the available freestanding signage. Also, each freestanding sign is limited to 100
square feet in area. The applicant is asking to change that to 125 square feet to
accommodate a new sign for Aaron's, which is a new tenant.
Currently, there are four freestanding signs on the Wacker Plaza PUD. There is a 98
square foot Advance Auto Parts sign, a 96 square foot Asian King Buffet sign, a 71
square foot Block Buster Video sign and a small (less than 20 square foot) monument
style sign at the right-in/right-out entrance on Dodge Street at the southeast corner of
Wacker Plaza. Each tenant is allowed three wall-mounted signs in addition to the
freestanding signage.
D. Site Plan Provisions.
The site development standards for this PC Planned
Commercial District shall be as follows:
1) The landscaping and screening requirements shall
be established in conformance with the
requirements of Section 4-4 and 4-5 of the Zoning
Ordinance of the ci ty of Dubuque, Iowa. A
landscape area containing permeable and uncovered
surface containing living materials shall be a
minimum of 10% of the combined bui lding coverage
and vehicular use area.
2) All parking aisles and traffic control areas
shall have raised curbing.

date of adoption.
G. Transfer of ownership.
Transfer of ownership or lease of property in this
PC Planned Commercial District shall include in the
transfer or lease agreement, a provision that the

WHEREAS, Richard L. Davis, owner and applicant, has filed
an amended conceptual development plan for certain properties
hereinafter described in accordance with provisions of the PC
Planned Commercial District regulations as set forth in Section 3-
3.80 of the Code of Ordinances, Appendix A thereof, of the City of
Dubuque, Iowa: and
WHEREAS, the Planning and Zoning commission has held a
public hearing on said amended conceptual development plan pursuant
to required published notice: and
WHEREAS, the Planning and Zoning Commission has approved
said amended conceptual plan subject to specific conditions and
restrictions having found that said plan conforms with the review
standards applicable to such plans as set forth in Section 3-
3.80(4) of the Code of Ordinances, Appendix A thereof of the City
of Dubuque, Iowa; and
WHEREAS, the Planning and Zoning commission recommended
the concurrence of the City Council and approval of said amended
conceptual development plan: and .
WHEREAS, the City council has received the recommendation
of the Planning and Zoning Commission and has held its own public
hearing on said amended conceptual development plan pursuant to
required published notice:
WHEREAS, the City Council has approved said amended
conceptual development plan subject to the same specific conditions
and restrictions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That in order to accomplish the purposes of
the PC Planned Commercial District of the Zoning Ordinance of the
City of Dubuque, Iowa, the amended conceptual development, a copy
of which is attached to and made a part hereof, is hereby adopted
and approved for the following described property, to wit:
Lot 1 in Hawkeye Highway 20 Place and to the
center' line of the adjoining public right-of-
way, all in the City of Dubuque, Iowa.
Section 2. That in order to accomplish the purposes of
the PC Planned Commercial District and of the Zoning Ordinance, the
property hereinabove described is subject to the following

The following regulations shall apply to all uses
made of land in the above-described PC Planned
Commercial District:

2) A motel may only be constructed on Out Parcel D.
All necessary parking must be immediately
adjoining the building. No motel parking shall
be shared with retail parking. Such motel shall
be used for lodging only, no restaurant, meeting
rooms or places of assembly.
3) Accessory uses shall be limited to any use
customarily incidental and subordinate to the
principal use.
B. Lot and Bulk Reaulations.
Development of land in the particular PC Planned
Commercial District shall be regulated as follows:
1) All structures shall be a minimum of 40 feet from
the front property line adjoining Dodge Street
and Wacker Drive.
2) No building or structure can exceed 40 feet in
height on the site.
3) A maximum building area of 68,000 sq. ft. will
be permitted on the site.
4) The development shall consist of one main
building and four separate structures, designated
on the conceptual plan as out Parcels A, B, C and
D.

C. Parking Requirements.
1) The off-street parking requirements for the
principal permitted uses for the herein described
PC Planned Commercial District shall be
designated by a bracket-enclosed number next to
the use, as described in Section 4-2.7 of the
Zoning Ordinance of the City of Dubuque. The
main building shall have a parking group number
of [17] and Out Parcels A, B, C and D shall have
the parking group as prescribed by the use of the
structure.
D. Site Plan Provisions.

permits shall be permitted. FOllowing approval of the final site
development plan, no construction may take place except in
substantial conformance with such plan.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT THE NORTHEAST
CORNER OF U.S. HIGHWAY 20 AND WACKER DRIVE BY AMENDING
SECTION E., SIGN REGULATIONS, OF ORDINANCE NO. 40-89 THAT
ESTABLISHED THE PUD PLANNED UNIT DEVELOPMENT DISTRICT FOR
WACKER PLAZA.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by providing for the amendment of Ordinance
No. 40-89, which adopted regulations for the Wacker Plaza Planned Unit Development
District for hereinafter described as Lot 1 of Hawkeye Highway 20 Place, and to the
centerline of the adjoining public right of way, all in the City of Dubuque, Iowa.
Section 2. Pursuant to Iowa Code Section 414.5(2003), and as an express
condition of the reclassification, the undersigned property owner agrees to the fOllowing
conditions, all of which the property owner further agrees are reasonable and imposed
to satisfy the public needs that are caused directly by the zoning reclassification:
