The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
Staff reviewed the subject Final Plat that was previously approved by the Commission
at their June 1st meeting. Subsequently, staff found that the plat title was in error.
Staff noted that the title should have been the 4th Addition, not the 3rd Addition.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted
final plat is unchanged except for the title.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City
Council approves the request.
A simple majority vote is needed for the City Council to approve the reques.t

Plat title correction for Dubuque Industrial Center West.
INTRODUCTION
The Zoning Advisory Commission reviewed and approved a Final Plat of Lot 1 thru 4
and Lot A, 8, and C of Dubuque Industrial Center West 3rd Addition at your June 1
meeting. The City Council approved the same Final Plat at the July 5, 2005 City
Council meeting. City staff subsequently found that the title was in error. It should have
been titled Dubuque Industrial Center West 4th Addition. The attached Final Plat is in all
other respects the same as the previous Final Plat except for the title change.
RECOMMENDATION
Planning Staff recommends that the Zoning Advisory Commission approve the Final
Plat of Lot 1 thru 4 and Lot A, 8, and C of Dubuque Industrial Center West 4th Addition
as it is in substantial compliance with the City of Dubuque Subdivision regulations.

submittal of a preliminary plat.

Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns: The proposed cul-de-sac street will be built to City public street
standards with 37 feet of paving and 66-foot of right-of-way. The proposed public street
will intersect with Chavenelle Road. There are no traffic counts available for either
street at this time.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment provided
adequate erosion control is provided during all phases of development.
Adjacent Properties: Adjacent properties are zoned for either commercial service or
industrial uses, and the proposed development of this property will be compatible with
adjacent properties.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat for Lots 1 thru 4, and Lot A, B, and C of Dubuque
Industrial Center West 4th Addition subdivides an existing portion of the Dubuque Industrial
Center West into three new industrial lots. The three lots will be served by a new public
street to be named Synergy Court that will be built to the City's public street standards of 37
feet of paving and 66-foot of right-of-way.
The Zoning Advisory Commission is being asked to waive the subdivision requirements that
stipulate that a preliminary plat must be submitted whenever a major subdivision is
proposed. Planning staff does not believe a preliminary plat is warranted for this small
change to the Dubuque Industrial Center West. While the original conceptual planl
preliminary plat for Dubuque Industrial Center West did not include this street, the proposed
change is small in nature and only encompasses a total of 26 acres. In addition, both the
Zoning Advisory Commission and the City Council will still review the submitted plat; thus the
review process is no shorter than if a preliminary plat were submitted.
Drainage from the proposed industrial lots will be handled by the existing storm water
detention basin in this portion of the Dubuque Industrial Center West. Water and sewer
mains will be extended as part of construction of the new street to serve the three new lots.
Planning staff recommends that the submitted Final Plat of Lots 1 thru 4 and Lots A, Band C
of Dubuque Industrial Center West 4th Addition be approved as it is in substantial
compliance with the City of Dubuque Subdivision Regulations.

RESOLUTION NO. 380 -05
A RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1 THRU 4, AND
LOTS A, B, AND C OF DUBUQUE INDUSTRIAL CENTER WEST 4th
ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk the Final Plat of Lots 1 thru 4,
and Lots A, B, and C of Dubuque Industrial West 4th Addition in the City of Dubuque;
and
Whereas, upon said Final Plat appears a street to be known as Synergy Court
(Lot A), together with certain public utility and sanitary sewer easements which the
owners by said Final Plat have dedicated to the public forever; and
Whereas, said Final Plat has been reviewed by the Zoning Advisory Commission
and had their approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed, and that a preliminary plat has not
been submitted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-14(d)(2) of the City of Dubuque Subdivision
Regulations requiring the submittal of a preliminary plat is hereby waived.
Section 2. That the dedication of Synergy Court (Lot A) together with
easements for public utilities and sanitary sewer as they appear upon said Final Plat be
and the same are hereby accepted.
Section 3. That the Final Plat of Lots 1 thru 4, and Lots A, B, and C of
Dubuque Industrial Center West 4th Addition is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Final Plat.
Section 4. Sidewalk installation shall be the responsibility of the owner of the
property abutting the public right-of-way, including lots with multiple frontages, as
required by City Code 41-161 through 41-164. The responsibility shall extend to all
successors, heirs and assignees. Sidewalk installation will not be required until the
development of the lot has been completed except as required herein. Sidewalks shall
be five (5) feet in width and installed one (1) foot from the property line. All vacant lots
shall have sidewalks installed upon development of eighty percent (80%) of the
developable lots approved by the Final Plat.
Section 5. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer that all public improvements have been
completed in accordance with the improvement plans and City standard specifications.
Passed, approved and adopted this 15th day of August 2005.
