RESOLUTION ANNEXING CERTAIN PROPERTY TO THE CITY OF DUBUQUE, IOWA
Whereas, Ronald and Joann Ludwig , as owners of approximately 20 acres of property lying
outside the corporate limits of the City of Dubuque, Iowa, have voluntarily petitioned for annexation of
said territory to the City of Dubuque, as shown in Exhibit A; and
Whereas, Lawrence and Katherine Ludwig, as owners of approximately 19,8 acres of property
lying outside the corporate limits of the City of Dubuque, Iowa, and Edward D. Tschiggfrie, as contract
buyer of said property, have voluntarily petitioned for annexation of said territory to the City of Dubuque,
Iowa, as shown in Exhibit A; and
Whereas, Chapter 368 of the Code of Iowa authorizes the extension of city limits in situations of
this character by the adoption of a resolution after notification as required by State regulations; and
Whereas, the future growth and development of the City of Dubuque, Iowa, make it desirable
that said property be made a part of the City of Dubuque, Iowa.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the territorial limits of the City of Dubuque, Iowa, be, and they are hereby
extended, to include property legally described as Lot 2 of Lot 1 of the SE 1/4 of the SE 1/4 of Section 2
in Township 89 N Range 2E of the 5th P.M., and Lot 1 of Lot 1 of the SE 1/4 of the SE 1/4 of Section 2
in Township 89 N Range 2E of the 5th P.M. in Dubuque County, Iowa.
Section 2. That the territory hereby annexed shall become a part of the Third Ward, Twelfth
Precinct of the City of Dubuque, Iowa.
Section 3. That the City Clerk shall file this resolution, all Exhibits and the petition for voluntary
annexation with the City Development Board of the State of Iowa.

The Dubuque City Council will hold a public hearing on a request for voluntary
annexation of 39.8 acres of territory into the Dubuque corporate limits. The public
hearing will be held:

They plan to develop their properties for residential uses and to connect to City water

Physical Characteristics: The properties are served by a private gravel driveway that
extends to Peru Road. The northern 20 acres slopes to the northwest. The southern
19.8 acres drains to the southwest, with the high point of the property being near the
northeast corner of the site.

Conformance with Comprehensive Plan: The 1995 Comprehensive Plan did not
include these properties as a potential growth area on the Future Land Use Map.
Annexation and residential development of these properties, however, are consistent
with the goals and objectives established for the Land Use and Urban Design Element
and the Housing Element of the Comprehensive Plan. The Comprehensive Plan

includes goals to facilitate annexation and rezoning for planned and orderly growth
outside the City's boundaries at the time the Plan was adopted.
Impact of Request on:
Utilities: Existing utilities in the area can be extended to and are capable of
handling anticipated development of the subject properties.
Traffic Patterns/Counts: Access to this area will be provided by a stubbed out
public street from Peru Road through the adjacent development proposed by Ed
Tschiggfrie. Access to the properties currently is provided from Peru Road by a
private lane owned by Lawrence and Katherine Ludwig. Access to existing streets
in the adjoining county subdivisions is not proposed.
Public Services: Existing public services are adequate to serve the proposed
development.
Environment: No adverse impact to the environment is anticipated if adequate
erosion control measures are provided during all phases of construction and
appropriate storm water control is provided as part of this development.

Adjacent Properties: The surrounding property is primarily agricultural, single-
family residential and mobile homes. The proposed rezoning would continue the
residential development pattern,
CIP Investments: None proposed.
Staff Analysis and Recommendation: The subject properties are in Dubuque
County. Ronald and Joann Ludwig have requested annexation of the northern 20 acres
concurrent with rezoning to R-1 Single Family Residential. Ed Tschiggfrie is the
contract buyer for the southern 19.8 acres from Lawrence and Katherine Ludwig. Mr.
Tschiggfrie and the Ludwigs have requested annexation contingent on rezoning to PUD
Planned Unit Development with a PR Planned Residential designation. The PUD
proposal is for a combination of single and multi-family residential dwellings. It includes
a small portion of what will be Alpine Heights Mobile Home Park to the south.

The City recently modified its annexation zoning policy to allow the property owner to
request annexation and rezoning at the same time. The joint processing of the
rezoning and annexation applications allows the property owner to know whether
he/she has approval to rezone prior to annexation into the City of Dubuque. The
Zoning Advisory Commission is required to review the rezoning request through their
standard public hearing process, which they did on February 4, 1999. The City Council
then will review both the annexation and the rezoning requests at a public hearing,
having received the Commission's recommendation.

The requested R-1 rezoning and PR Planned Residential rezoning are compatible with
the surrounding single family residential subdivisions and Terrace Heights Mobile Home
Park. In addition, Alpine Heights Mobile Home Park was approved recently by the City
Council to the south of these properties.
Access from Peru Road to both properties would be improved from the private gravel
driveway to a paved public street to be built to collector street standards. The street
right-of-way is proposed to exceed the standard width, allowing the pavement to be
widened if necessary for future growth.
The subject properties were not identified as growth areas for the 1995 Comprehensive
Plan. However, growth areas were characterized as vacant, developable land that
could be served by City utilities. The Comprehensive Plan anticipated that the identified
growth areas might not be the only areas for growth, and includes goals regarding
annexation and rezoning of land for residential uses.
Staff recommends that the City Council approve the annexation request. The proposal
provides the City with additional land for growth, and with the ability to control that
growth through City regulations.

RESOLUTION ANNEXING CERTAIN PROPERTY TO THE CITY OF DUBUQUE, IOWA
Whereas, Ronald and Joann Ludwig , as owners of approximately 20 acres of property lying
outside the corporate limits of the City of Dubuque, Iowa, have voluntarily petitioned for annexation of
said territory to the City of Dubuque, as shown in Exhibit A; and
Whereas, Lawrence and Katherine Ludwig, as owners of approximately 19,8 acres of property
lying outside the corporate limits of the City of Dubuque, Iowa, and Edward D. Tschiggfrie, as contract
buyer of said property, have voluntarily petitioned for annexation of said territory to the City of Dubuque,
Iowa, as shown in Exhibit A; and
Whereas, Chapter 368 of the Code of Iowa authorizes the extension of city limits in situations of
this character by the adoption of a resolution after notification as required by State regulations; and
Whereas, the future growth and development of the City of Dubuque, Iowa, make it desirable
that said property be made a part of the City of Dubuque, Iowa.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the territorial limits of the City of Dubuque, Iowa, be, and they are hereby
extended, to include property legally described as Lot 2 of Lot 1 of the SE 1/4 of the SE 1/4 of Section 2
in Township 89 N Range 2E of the 5th P.M., and Lot 1 of Lot 1 of the SE 1/4 of the SE 1/4 of Section 2
in Township 89 N Range 2E of the 5th P.M. in Dubuque County, Iowa.
Section 2. That the territory hereby annexed shall become a part of the Third Ward, Twelfth
Precinct of the City of Dubuque, Iowa.
