ORDINANCE NO. 12 -99
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED NORTH OF KENNEDY COURT AND WEST OF
PERU ROAD FROM AG AGRICULTURAL DISTRICT TO R-1 SINGLE-FAMILY
RESIDENTIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property from
AG Agricultural District to R-1 Single-Family Residential District, to wit:
Lot 2 of 1 of 5 and Lot 1 of 1 of 2 of 5 SW 1/4 Section 1, T89N, R2E and
to the center line of the adjoining public right-of-way, all in the City of
Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Total Area: 11.8 acres
Property History: The subject property has been used for agricultural purposes
since its annexation into the City.
Physical Characteristics: The subject property generally slopes to the east and the
western portion of the parcel is well above the grade of Peru Road.
Concurrence with Comprehensive Plan: This area was not designated as part of
the 1995 Comprehensive Plan. The 1990 DMA TS Plan designated the area for
Future Residential. The 1965 Gruen Plan designated the area for Single-Family
Residential.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: The property fronts Peru Road, which carries
approximately 4,300 vehicle trips per day along this stretch.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff do not anticipate any adverse impacts to the environment
provided adequate erosion control is provided during all phases of development.

Adjacent Properties: The surrounding property primarily is developed for single-
family residential. The proposed rezoning is to allow development of the parcel
for single-family development. Staff do not anticipate any significant impact to
adjacent properties.
Staff Analysis: The applicant is requesting that the subject parcel be rezoned from
AG Agricultural District to R-1 Single-Family Residential District. The subject parcel
lies along the west side of Peru Road, north of Kennedy Court. The property
adjacent to Peru Road is at roughly the same grade level; however, it rises sharply
as the property extends to the west away from Peru Road.
The requested rezoning is to allow for development of the parcel for single-family
lots that will be served by a public street accessing Peru Road in the northeast
corner of the site. The requested rezoning to single-family residential is compatible
with the surrounding development as property on both the north and south sides of
the subject parcel currently are developed for single-family homes.
Staff recommend that the Zoning Advisory Commission review Section 6-1. 1 of the
Zoning Ordinance that established the criteria for the review for rezoning requests.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Rod Tschiggfrie spoke in favor of the request, noting he had met with several neighbors
and reviewed the request with them. This will be a single family residential development
with access to Peru Road. Staff reviewed the staff report, reviewing the lot and street
layout.
The Zoning Advisory Commission discussed the request noting that the R-1 District zoning
is appropriate for this area.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request
A simple majority vote is needed for the City Council to approve the request.
