KENNEDY ROAD. Whereas, Ordinance 61-89 was adopted on December 12, 1989 by the City Council amending the PC Planned Commercial District located at 255 John F. Kennedy Road; and Whereas, Shopko, 255 John F. Kennedy Road, has requested an amendment to the PUD Ordinance regulating freestanding signage allowed in the PC Planned Commercial District located at 255 John F. Kennedy Road. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: . Section 1. That Appendix A (the Zoning Ordinance) is hereby amended by repealing Section 2.E.(1) of Ordinance 61-89 and enacting a new Section 2.E.(1) in lieu thereof, as follows: E. Sian Reaulations. 1) One freestanding on-premise sign shall be permitted with a maximum area of 350 square feet and a maximum height of 40 feet. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. FROM: SUBJECT: Shapka Text Amendment INTRODUCTION Kieffer and Co., Inc. has submitted an application requesting an amendment to the Planned Commercial District for the property located at 255 John F. Kennedy Road (former Venture Store) on behalf of Shopko. The request is to modify the sign regulations to allow for additional area on freestanding signs. The subject Planned Commercial District was last amended December 12, 1989. DISCUSSION Shopko will be occupying the former Venture Store building. The signage package proposed by Shopko is typical of that found at their other stores. They would like to install a pylon (freestanding) sign that will read "Shopko" with the wording "Pharmacy" and "Optical" located just below the Shopko lettering. This sign is proposed to be 350 square feet. The present ordinance allows two freestanding signs up to 300 square feet in area. They also propose 3 wall signs; two reading "Shopko" (different sizes for each) and one reading "Pharmacy/Optical". These signs will total approximately 518 square feet and are permitted by the present ordinance. Attached is a copy of the existing sign regulations for the Commission's review. The applicant has submitted a two-page letter, synopsis of the type of signs that would be installed, a site plan showing the approximate location of the existing freestanding sign, as well as the proposed sign, and an elevation of the proposed slgnage. A. Use Regulations. B. Lot and Bulk Regulations. Development of land in the particular PC Planned COlll8ercial District shall be regulated as follows: 1) All structures shall be a minimum of 60 feet from the front property line adjoining J. F. Kennedy Road. No building or structure can exceed 40 feet in height on the site. 2) . 3) A maximum building area of 84,000 sq. ft. will be permitted on the site. C. Parking Requirements. 1) The off-street park ing requ irements for the principal permitted uses for the herein described PC Planned Commercial District shall be a minimum of 1 space for each 250 sq.- ft. of floor area accessible to the general public. The parking area shall be improved to City standards. D. Site Plan Provisions~ The site development standards for this PC Planned Commercial District shall be as follows: . 1) The screening requirements shall be established in conformance with the requirements of Section 4-4 and 4- 5.4 of the Zoning Ordinance of the City of Dubuque, Iowa, except that no screening shall be allowed 18 feet from the accesses on J. F. Kennedy Road. 2) The traffic control area across from the Wacker Drive entrance and the north and south ends of all parking lanes shall have raised curbing with raised curbing required around the perimeter of the parking area. L Signs. The following regulations shall apply to all signs in this particular PC Planned Commercial District, as follows: . , Ordinance No. .Page 3 -89 . 1) Two free-standing on-premise signs shall be permitted with a maximum area of 300 sq. ft. each and a maximum height of 40 feet. One free-standing signs shall be allowed per frontage. 2) The wall-mounted on-premise signage area shall be 10% of each north, south and west building facade, maximum of 700 sq. ft. per building, 2 signs per building facade. Wall- mounted signs may be located on any wall below eave or parapet line. 3) Directional signs shall be permitted at 6 sq. ft. per sign panel, either wall-mounted, projecting or free-standing with a maximum height of ten feet. . F. Time Limitation. The conceptual development plan shall be valid for a period of three years, provided a final site development plan is submitted within one year of the date of adoption. G. Transfer of Ownership. Transfer of ownership or lease of property in this PC Planned Commercial District shall include in the transfer or lease agreement, a provision that the purchaser or leasee acknowledges awareness of the conditions authorizing the establishment of this district. Section 3. That a final site development plan shall be approved by the City Development Planner if found to be in conformance with the approved conceptual development plan. If found to be in conformance with said plan, the issuance of building permits shall be permitted. Discussion The applicant spoke in favor of the request noting the size and location of the proposed sign and the rationale for the request. Staff reviewed the request noting what is allowed by the current ordinance and the amount proposed in this amendment request. Staff also reviewed a letter in favor of the request from an adjacent property owner. The Zoning Advisory Commission discussed the request inquiring why the "pharmacy/ optical" language could not be included and still comply with the 300 square foot requirement. The Commission discussed options other than that proposed, including reducing the area of the freestanding signage and also limiting them to only one freestanding sign where they previously were allowed two signs. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request with the condition to allow one freestanding sign only, up to 350 square feet in area, and a maximum height of 40 feet. A single majority vote is needed for the City Council to approve the request.
