ORDINANCE NO. 16 -99 AN ORDINANCE AMENDING CHAPTER 34 OF THE CITY OF DUBUQUE CODE OF ORDINANCES, PARKS AND RECREATION, BY RENAMING CERTAIN PARKS AND ESTABLISHING CERTAIN NEW PARKS; AND BY AMENDING AND RENUMBERING SEC. 34-67 RELATING TO THE USE OF BICYCLES, MOTORCYCLES, ETC. IN PARKS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Section 34-52(d) of the City of Dubuque Code of Ordinances is amended to read as follows: (d) The consumption or use of beer is prohibited in the following-named parks: Jackson Park, Grant Park, Washington Park, Burden Park, Madison Park, Allison-Henderson Park, Jefferson Park, Hilltop Park, Oakwood Park, Falk Park, E.B. Lyons Prarie\Woodland Preserve, Flat Iron Park, Nicholas J. Sutton Swimming Pool, Comiskey Park, Gay Park, Avon Park, Caledonia Park, Waller- Cooper Park, Cleveland Park, Valley High Park, Hillcrest Park, Valentine Park, pinard Park, Rocco Buda Jr. Park, Sunnyslopes Park, Marna Ridge Children's Forest, Medical Associates Greenbelt, Heritage Trail, Elmwood Green Park, Granger Creek Nature Trail, Southern Park and Usha Park. Section 2. Section 34-67(e) of the City of Dubuque Code of Ordinances is renumbered and amended to read as follows: Sec. 32-251. Use of bicycles, motorcycles, etc. in parks. (a) The use of bicycles, motorcycles, motor scooters, go-carts, cars, trucks and other motor- driven vehicles other than those vehicles engaged in authorized park maintenance and security in any park, recreation facility, or trail may be prohibited by the Park and Recreation Commission. (b) It shall be unlawful for the operator of any . . car, truck, motorcycle or any other type vehicle to stop, stand or park upon any roadway or in any parking areas in any park, recreation facility, or trail in such manner as to obstruct the flow of traffic. (c) It shall be unlawful for any person or persons to play games, catch, throwing of frisbees or other objects, gathering in groups on any roadway or parking areas in any park, recreation facility, or trail as to obstruct the flow of traffic. (d) It shall be unlawful to park any car, truck, motorcycle or other type of vehicle along any roadway or area in any park or recreation facility that is posted prohibiting such parking. (e) It shall be unlawful for any car, truck, motorcycle or any other type of motorized vehicle to drive on and/or park on any grass area, sidewalk or trail in any park, recreation facility, or trail except with the express permission of the Leisure Services Manager's designee. . Section 34-74(h) of the City of Dubuque Code of Ordinances is amended to read as follows: (h) The following parks and park and recreation facilities shall be open for use by the public from seven o'clock (7:00) A.M. to ten o'clock (10:00) P.M. daily: . Section 34-54. Pets have not been allowed in parks at all. This proposed change allows for pets in parks that are leashed and attended. An increased number of people are walking with their pets, and as trails are added to the system, we expect the trend to continue. The no pets ordinance has been difficult to enforce because of the reaction from the park user to being told the pet in their car can not get out of the car in the park. Section 34-67(e) was amended to include trails and renumbered to 32-251 (moved to the traffic code). It is moved to the traffic code because the process of filing charges under that section of the code is much simpler and quicker for individuals under the age of 18. . . Presently, individuals over 18 years old are issued a traffic citation but those under 18 are issued a juvenile complaint and affidavit plus the parents must be notified. The park rangers fill out the affidavit then call the information in to the Law Center. A secretary at the Law Center types the affidavit and the ranger is notified to stop at the Law Center to sign. Contacting the parents can also be time consuming because often times they are difficult to locate. Under the park . code of ordinances, page two section, this offense is not considered a traffic charge so it would not show on the individual's driving record. We believe having the offense show on the driving record would be a deterrent. When moved to the traffic code a traffic citation can be issued for all age levels. This is a simple traffic ticket and would show on the individual's driving record. All the other revisions are proposed to add new parks and areas to the code. Those areas include: Elmwood Green Park, Granger Creek Nature Trail, Heritage Trail, Marna Ridge Children's Forest, Medical Associates Greenbelt, Pinard Park, Rocco Buda Jr. Park, Southern Park, Sunnyslopes Park, Usha Park and Valentine Park. (a) The use of bicycles, motorcycles, motor scooters, go-carts, cars, trucks and other motor- driven vehicles other than those vehicles engaged in authorized park maintenance and security in any park, recreation facility, or trail may be prohibited by the Park and Recreation Commission. (b) It shall be unlawful for the operator of any car, truck, motorcycle or any other type vehicle to stop, stand or park upon any roadway or in any parking areas in any park, recreation facility, or trail in such manner as to obstruct the flow of traffic. (c) It shall be unlawful for any person or persons to play games, catch, throwing of frisbees or other objects, gathering in groups on any roadway or parking areas in any park, recreation facility, or trail as to obstruct the flow of traffic. (d) It shall be unlawful to park any car, truck, motorcycle or other type of vehicle along any roadway or area in any park or recreation facility that is posted prohibiting such parking. (e) It shall be unlawful for any car, truck, motorcycle or any other type of motorized vehicle to drive on and/or park on any grass area, sidewalk or trail in any park, recreation facility, or trail except with the express permission of the Leisure Services Manager's designee. Section 4.
