CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA AS SHOWN ON RIGHT-
OF-WAY PLAT EXHIBIT "A"
Whereas, the City of Dubuque, in consideration of the payment of $2,650.00
purchased City Lot 307 A in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto and by reference made a part hereof; and
Whereas, the State of Iowa has executed patent #4668 conveying said property to
the City of Dubuque, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council of the City of Dubuque, Iowa hereby approves
of, accepts, and consents to patent #4668 from the Iowa Department of Transportation
conveying City Lot 307 A in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "An attached hereto.
Section 2. That the City Clerk be and is hereby authorized and directed to file a
copy of this resolution in the office of the Recorder, in and for Dubuque County, Iowa.

INTRODUCTION
.
The enclosed resolutions provide for the acceptance of Patent Numbers 4667, 4668,
4670, 4671, and 4711 from the Iowa Department of Transportation for properties
along U.S. Highway 61 between 4th and 5th Streets and 11th and 12th Streets.
DISCUSSION
The above patents are for excess U.S. 61 right-of-way parcels which the City
purchased from the Iowa Department of Transportation. The parcels have been
purchased by the City for landscaping public right-of-way and/or public parking
purposes, and include the following lots:

The values of these parcels were established by appraisal and the lots have been
purchased by direct and preferential sale to the City of Dubuque. Copies of the plats
for the six lots and a vicinity map are enclosed. The properties comprise a total of
0.78 acres.
Checks in the total amount of $58,301.00 have been deposited with the Iowa
Department of Transportation, and the State of Iowa has prepared and recorded
patents dated February 17 and December 28, 1998 deeding the properties to the City
of Dubuque.
RECOMMENDA TION
The acquisition of these parcels is consistent with the City's Freeway Corridor Plan
which emphasized creation of public open space zones for landscaping of excess right-
of-way parcels.

I would recommend the adoption of the enclosed resolutions accepting the patents on
behalf of the City of Dubuque.
BUDGET IMPACT
The properties have been acquired through funds from previous year carryovers for this
purpose with a negative balance of $16,301.00. The remaining funding for the project
will be from Fiscal Year 1999 Paving Project funds.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the patents
for the properties.

Whereas, the City of Dubuque, in consideration of the payment of $9,750.00
purchased City Lot 500A in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto and by reference made a part hereof; and
Whereas, the State of Iowa has executed patent #4670 conveying said property to
the City of Dubuque, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council of the City of Dubuque, Iowa hereby approves

Whereas, the City of Dubuque, in consideration of the payment of $4,900.00
purchased City Lot 500D in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto and by reference made a part hereof; and
Whereas, the State of Iowa has executed patent #4671 conveying said property to
the City of Dubuque, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council of the City of Dubuque, Iowa hereby approves
of, accepts, and consents to patent #4671 from the Iowa Department of Transportation
conveying City Lot 500D in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto.
Section 2. That the City Clerk be and is hereby authorized and directed to file a
copy of this resolution in the office of the Recorder, in and for Dubuque County, Iowa.

A RESOLUTION ACCEPTING CONVEYANCE OF CITY LOT 303A IN THE
CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA AS SHOWN ON RIGHT-
OF-WAY PLAT EXHIBIT "A"
Whereas, the City of Dubuque, in consideration of the payment of $41,000.00
purchased City Lot 303A in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto and by reference made a part hereof; and
Whereas, the State of Iowa has executed patent #4711 conveying said property to
the City of Dubuque, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOW.A:
Section 1. That the City Council of the City of Dubuque, Iowa hereby approves
of, accepts, and consents to patent #4711 from the Iowa Department of Transportation
conveying City Lot 303A in the City of Dubuque, Dubuque County, Iowa, as shown on
right-of-way plat Exhibit "A" attached hereto.
Section 2. That the City Clerk be and is hereby authorized and directed to file a
copy of this resolution in the office of the Recorder, in and for Dubuque County, Iowa.

. such filing by Section 428A.2(6) of the Code of Iowa.
CONDITIONS: Authority and consideration for issuance of this patent are stated in the certificate of the
Right of Way Director of the Iowa Department of Transportation filed with the State Land Office as
provided in Iowa Code Section 9G.6 (1995). This conveyance is subject to the conditions imposed by
Iowa Code Sections 306.22, 306.23, 306.24, and 306.25 (1995), including the right of a utility
association, company or corporation to continue in possession of a right of way in use at the time of the
