Property History: The Siegerts have requested annexation concurrent with rezoning to C-3 General Commercial District. The property has been in agricultural use for decades. The property was split diagonally with the construction of Highway 20. Physical Characteristics: The property is vacant farm land on both sides of Highway 20. Topography is gently rolling, with the land south of Highway 20 sloping to the South Fork of Catfish Creek. Flood plain exists along the creek. Access is limited to farm access on Highway 20, to allow passage between the north and south portions of the property. Concurrence with Comprehensive Plan: The Land Use and Urban Design, Infrastructure and Economic Development elements of the Comprehensive Plan include goals and objectives related to the need to annex and provide utilities to future growth areas for commercial development. The Future Land Use Map identifies this property as potential growth areas 1 8 and 1 9, and recommends a mix of commercial and industrial uses with controlled access and "gateway" design. . REZONING STAFF REPORT Page 2 . Impact of Request on: Utilities: The property can be served adequately from a 12-inch water main along Highway 20 and an 8-inch sanitary sewer interceptor to be extended in 1999 along the South Fork of Catfish Creek. Traffic Patterns/Counts: The property's Highway 20 access presently is limited to a farm access. Future access likely will be by frontage roads, with no direct access to Highway 20. Average daily traffic counts along this section of Highway 20 is estimated to be 17,820. The Iowa Department of Transportation (lOOT) has hired the consulting firm of HDR Engineering, Inc. to conduct a Highway 20 corridor study from Devon Drive to Swiss Valley Road. This study is to consider the reconstruction of Highway 20 to provide a free flow of traffic with no traffic signals. Improvements that will be considered may include addition of interchanges, modifications to existing intersections and frontage roads, and conversion of two-way frontage roads to one-way. The study is scheduled to be completed in late 1999. . Public Services: Response times for City police, fire and emergency services will be the same as or less than response times of County and volunteer services. The City has identified that an additional or relocated fire station may be needed in the future as the community develops to the west. The City also has identified that annexation will require an additional snow removal route. Environment: Erosion control, storm water management, and flood plain controls will be required during and after site development. A portion of the property lies in the flood plain of Catfish Creek. Adjacent Properties: On the north side of Highway 20, the City's site development standards will buffer existing and future residential uses. South of Highway 20, the site development standards will address storm water runoff, erosion and flood plain impacts. CIP Investments: A 12-inch water main was installed along Highway 20 in 1998. An 8-inch sanitary sewer interceptor will be extended along the South Fork of Catfish Creek in 1999. . REZONING STAFF REPORT Page 3 . Staff Analysis: The Siegerts have requested annexation concurrent with C-3 rezoning for the purposes of future commercial development. The City Council will decide upon annexation. The Zoning Advisory Commission's task is to evaluate the requested rezoning for this property as if it were in the City limits, and then provide a recommendation to the Council. The C-3 General Commercial District is intended for highway-oriented businesses along arterials and highways. Presently, there are a number of C-3 zones along Highway 20 to the east and along the Northwest Arterial. The Comprehensive Plan includes objectives for annexation of additional land for commercial development. The Siegert property is identified on the Future Land Use Map as growth areas 18 and 19. The Plan recommends a mix of industrial and commercial development, with "gateway" design and controlled access. . The Transportation Element of the Comprehensive Plan includes an objective to: "Plan for aesthetically appealing streets and highways, with particular focus on gateway opportunities". The Land Use and Urban Design Element of the plan includes goals and objectives to: "Define and enhance city gateways and focal points to create a sense of place", and "Promote principles of good urban design as part of all development." Presently, the City is working with a consulting firm to develop gateway treatments at the Dodge Street/Locust Street intersection, the Locust Street connector, and the 9th Street/11 th Street intersection. Access to Highway 20 likely will be via frontage roads, without direct access to Highway 20; however, the final configuration of any intersections or controlled access rest with the lOOT. Planning for development on the Siegert property, therefore, is dependent on the results of the lOOT Highway 20 corridor study. Once the lOOT's access plans are finalized as part of this Highway 20 corridor study in the Summer of 1999, then development options for the Siegert property can be laid out with the knowledge of the access configurations that lOOT will allow. Van Milligen, City Manager SUBJECT: Annexation and Rezoning Request of William and Janet Siegert William and Janet Siegert have requested rezoning of their 179 acres to C-3 General Commercial concurrent with the voluntary annexation of their property into the City of Dubuque. This request is part of a 1,000 acre annexation that includes voluntary and involuntary annexation of property along Highway 20. I would like to share my thoughts with the Zoning Advisory Commission on the work that led up to this request, and the potential that this request brings the community. I believe that the staff, the commission and the City Council share a common goal, which is to promote opportunities for planned and orderly growth outside the City's existing boundaries. The City understands that it must balance the demand for new development on the community's fringe with the benefits of infill development and reuse of existing infrastructure in a cost effective manner. However, the needs of new development for larger sites, highway frontage, etc. also must be addressed if the community is to grow and provide opportunities for new investment and new jobs. According to recent Chamber of Commerce job creation surveys, thousands of jobs are being created in our community each year. In addition, the City is constructing 900 acres of industrial parks that will create over 10,000 new jobs in the next 10 to 20 years. Growth in housing and commercial development will occur during this time period. This can be accomplished through projects in the existing city limits and through utility extensions and annexation. Over a 5 year period, the City will invest about $20 million to develop land and extend water, sewer and improved streets to our new industrial parks. These investments are not solely for the development of these industrial parks. These investments also are intended and expected to open up the adjacent land for development. In addition, to facilitate growth through annexation, the City Council last year arrrended the Zoning . Zoning Advisory Commission January 28, 1999 Ordinance to allow concurrent annexation and rezoning requests like the one the Siegerts have filed. Annexation of the Siegert property is a key component of a Highway 20 annexation plan that the City Council directed staff to develop and implement. The Highway 20 annexation plan is a result of the City's Annexation Study, which was based on the Development Needs Study and the Comprehensive Plan. The Development Needs Study projected that the community needs a 20-year reserve for single-family residential, multi-family residential, commercial, industrial and park/open space. These land use needs were allocated to 38 growth areas depicted in the Future land Use Map of the Comprehensive Plan. The Comprehensive Plan includes goals and objectives related to the annexation and orderly development of land to meet the community's development needs. For the Siegert property, the Comprehensive Plan recommends a mix of commercia~ and industrial uses. Based on the location of their property, the purpose and intent of the C-3 General Commercial District for business uses along arterials and highways. and the recommended land uses of the Comprehensive Plan, their rezoning request appears to concur with the Comprehensive Plan and the Zoning Ordinance. . While I know it has been the preference of the Zoning Advisory Commission to consider planned unit developments over straight rezonings, I do not believe that will always be practical when it comes to annexations. I especially believe that to be true in this case. This is a large annexation, and this property is one of the keys to making many of the properties included in the Highway 20 annexation plan contiguous with the City of Dubuque. The application, staff report and related materials are attached for your review. Discussion Planning Services Manager Laura Carstens, speaking on behalf of William and Janet Siegert, reviewed that the rezoning request comprises 179 acres on the north and south side of U.S. Highway 20, and that the property is also included as part of an annexation request. Carstens stated that the subject parcel meets the intent and purpose of the C-3 General Commercial District, in that it is along a highway and will provide a good location for commercial uses that serve the motoring public. Carstens reviewed with the Commission that there is a ongoing study funded by the Iowa Department of Transportation looking at alternatives to improve traffic flow through the Highway 20 corridor. She noted the request is consistent with the Comprehensive Plan and the Future Land Use Map of the Comprehensive Plan. City Manager Michael Van Milligen spoke in favor of the Siegert's rezoning request. Van Milligen reviewed with the commission the investment the Dubuque community has made in the development of the Industrial Parks and the extensions of utilities and streets to serve them, and noted that as existing businesses and new firms build facilities in these industrial parks, new employment opportunities will create demand for new residential and commercial developments. Van Milligen reviewed with the Commission that the Siegerts' request is an important component of a current annexation request that encompasses approximately 1,000 acres. He noted that the Siegerts' joined in the annexation, at the request of the City, with the condition that their property was rezoned to C-3 General Commercial. The Honorable Mayor and City Council Members February 25, 1999 Page 2 zoning controls are sufficient to ensure that Siegerts' property will be developed in a manner that benefits the community and protects adjacent property from adverse impacts. Walt McFadden, 5580 Pennsylvania Avenue, stated he was not opposed to the Siegert rezoning request, only that he wanted to point out to the Commission that rezoning of 179 acres to C-3 General Commercial without a Planned Unit Development is a departure from their established policy. . The Zoning Advisory Commission discussed the request reviewing existing policies and procedures regarding access request to Highway 20. The Commission reviewed the status of the lOOT's Highway 20 Corridor Study and the potential for new frontage roads and interchanges. Commissioners questioned staff on existing developments anticipated in the area of the rezoning request and on the property included in the proposed 1,000 acre annexation request along Highway 20. The Commission discussed the appropriateness of C-3 zoning along Highway 20 and stated that commercial zoning was consistent with the 1995 Comprehensive Plan. The Commission discussed the inclusion of a condition limiting access to Highway 20 to a frontage road system to be designed and approved by lOOT and the City of Dubuque prior to development. Recommendation Bya vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request with one (1) condition. The condition recommended by the Commission is that prior to development, a frontage road system for access to Highway 20 is planned and approved by the lOOT and the City of Dubuque for the north and south sides of U.S. Highway 20. A simple majority vote is needed for the City Council to approve the request. Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager~ SUBJECT: Highway 20 Annexation - City Property and Public Right-of-Way This memo constitutes the City of Dubuque's petition for the voluntary annexation of approximately 288 acres of land purchased by the City of Dubuque for development of an industrial park, located between Cousins Road and Cottingham Road and adjoining the Dubuque County landfill on the south, in accordance with Chapter 368 of the Iowa Code. To provides this land with the required 50-foot adjacency with the Dubuque corporate limits, this annexation request also includes the annexation of the U.S. Highway 20 public right-of-way from the Northwest Arterial to Cousins Road, as well as annexation of the right-of-way of Cousins Road from to the northeast corner of the City's property, in accordance with Section 368.5 of the Iowa Code. The area to be annexed is shown on the attached map.
