A RESOLUTION APPROVING THE SURVEY PLAT OF WIDMEIER PLACE IN THE CITY OF
DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a survey plat of Widmeier Place in the City of
Dubuque, Iowa; and
Whereas, said plat provides 0 feet of frontage for Lot 1 and Lot 2, where 60 feet is required by
Section 42.19(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory Commission and had its
approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that it conforms
to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:

Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1 and
Lot 2 to have 0 feet of frontage, where 60 feet of frontage is required provided that Lot 1 and Lot 2 have
an access easement to a public street.
Section 2. That the survey plat of Widmeier Place is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa,
upon said final plat.

SUBJECT: Survey Plat of Widmeier Place
Introduction
The submitted survey plat of Widmeier Place is a simple subdivision, however, it
requires review and approval by the Zoning Advisory Commission and City Council as
Lots 1 and 2 do not have frontage on a public or private street. The Zoning Advisory
Commission is being asked to waive the 60 foot lot frontage requirement.
The applicant appeared before the Zoning Advisory Commission as an item from the
public at the Commission's December 2, 1998 meeting. The submitted plat is
consistent with the layout Mr. Widmeier showed the Commission at that meeting.

Discussion
The submitted survey plat subdivides Lot 1 of Lot 1 of Lot 1 of Lot 1 of Lot 8 of
Gillespie's subdivision into two lots. The existing lot did not have frontage on a public or
private street, but is currently grandfathered. The replatting of the lot into two effectively
creates two new lots and thus the frontage requirement must be waived for both Lot 1
and Lot 2 of Widmeier Place.
The existing Lot 1 of Lot 1 of Lot 1 of Lot 1 of Lot 8 of Gillespie's subdivision has
access to Fink Street by way of the balance of the north 50 feet of Lot 2 of Lot 8
Gillespie subdivision. Both parcels are owned by the applicant's father. The submitted
survey plat would split Lot 1 of Lot 1 of Lot 1 of Lot 1 of Lot 8 of Gillespie subdivision
into two lots and provide an access and utility easement over the balance of the north
50 feet of Lot 2 of Lot 8 of Gillespie subdivision.
The submitted survey plat of Widmeier Place allows for the construction of one
additional home, the applicant Joe Widemeier. The Fire Marshal has reviewed access
to the proposed lot and is satisfied that adequate access for emergency vehicles is
available. A paved driveway is required by Section 4-4.2(1) of the Zoning Ordinance.

Staff Recommendation
Staff recommends that as adequate access is available to the site and that the
submitted survey plat is in substantial compliance with City of Dubuque Subdivision
Regulations, that the Zoning Advisory Commission recommend approval of the survey
plat of Widmeier Place subject to the waiving the 60 foot lot frontage requirement for
the R-1 single family residential district.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. the application, staff report and related materials are attached for your review.

Discussion
The applicant spoke in favor of the request stating that his father currently owns the
parcel and that the lot split will allow him to construct a new single-family house.
Staff reviewed the request noting that the Fire Marshal had inspected the property and
found there will be adequate access to the site for emergency vehicles. The Zoning
Advisory Commission discussed the request noting that there will be an access
easement established as part of the plat that will ensure continued access to the
subject lots.
Recommendation
By a vote 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
