RESOLUTION NO. 123 -99
RESOLUTION APPROVING THE SURVEY PLAT OF LOT 1 OF CENTER GROVE SCHOOL
ADDITION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a survey plat of Lot 1 of Center Grove School
Addition, in the City of Dubuque, Iowa; and
Whereas, upon said survey plat abuts an existing street known as Center Grove Drive; and
Whereas, the survey plat has been examined by the Zoning Advisory Commission and had its
approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that it conforms
to the statutes and ordinances relating to it; and
Whereas, the City Council concurs in the conditions of approval established by the Zoning
Advisory Commission.
. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That the survey plat of Lot 1 and Center Grove School Addition is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of
the City of Dubuque, Iowa, upon said survey plat, provided the owner of said property herein named,
executes his written acceptance hereto attached.
Section 2. That in the event Charles Burkart shall fail to execute the acceptance within 180
days after the date of this Resolution, the provisions hereof shall be null and void and approval of the
plat shall not be effective.

SUBJECT: Survey Plat of the Subdivision of Lot 1 of Center Grove School addition in
the City of Dubuque, Iowa
Introduction
The applicant, Charles Burkart, has submitted the survey plat that takes an existing
one-acre parcel and subdivides it into three lots. The subject parcel is located on
Center Grove Drive and there are currently three single family residential homes on this
site. The submitted plat provides a separate parcel for each of the existing houses.
Discussion
The subject parcel is located along Center Grove Drive behind the Dubuque Inn
shopping plaza.
The subject property was annexed into the City in the late 1970's and has been zoned
C-3 General Commercial since that time. The three houses were in existence prior to
the annexation of the property into the City of Dubuque and are considered to be legal
non-conformities, or grandfathered uses. The submitted survey plat is considered a
minor final plat as three new lots are being created.
Each of the proposed lots meet minimum requirements in terms of lot frontage and lot
area. Lot 2 of 1, contains an access and utility easement to ensure access to each of
the individual homes.
Recommendation
Staff recommends that as the submitted is in substantial compliance with City of
Dubuque Subdivision regulations that the Zoning Advisory Commission recommend
approval.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant spoke in favor of the request noting that the plat places each of three
existing single family homes on a separate lot with frontage on Center Grove Drive.
Staff indicated that the submitted plat splits a single parcel into three lots. The parcel
contains three single family homes that are legal non-conforming uses, because the
subject parcel is zoned C-3 General Commercial, and single-family homes are not a
permitted use in a C-3 District.
The Zoning Advisory Commission discussed the request noting that the submitted plat
provides a separate lot for each of the existing single-family homes and does not
change the "grandfather" status of the homes.
Recommendation
By a vote 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
