Dear Mayor and City Council Members: May 9, 2012 The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion Commissioner Norton abstained due to a conflict, as an employee of the land surveyor. The applicant, Deron Muehring, spoke in favor of the request, reviewing the purpose of the plat is for the City to purchase additional land for improvements to the Bee Branch Creek Restoration Project. Staff reviewed the staff report, noting that the submitted Plat of Survey facilitates construction of a new permeable alley, but creates a substandard lot that requires a waiver of area for Lot 2. There were no comments. The Zoning Advisory Commission discussed the request, and found it appropriate. Recommendation By a vote of 4 to 0, with one abstention, the Zoning Advisory Commission recommends that the City Council approve the request subject to waiving the lot area requirement for Lot 2. A simple majority vote is needed for the City Council to approve the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. SUBJECT: Plat of Survey of Lot 1 and 2 of Bee Branch Subdivision No. 7 Dubuque All Amenca City 2007 April 25, 2012 INTRODUCTION The submitted Plat of Survey of Lot land 2 of Bee Branch Subdivision No. 7 subdivides an existing 5,519 square foot lot into two parcels. Lot 2 is substandard in that it is comprised of 2,439 square foot where the Unified Development Code requires 2,500 square foot of lot area. DISCUSSION The submitted Plat of Survey resubdivides an existing parcel of land into two parcels. Lot 2 is substandard in terms of its lot area. The submitted Plat of Survey is necessary to facilitate the Bee Branch Restoration Project, including the construction of a permeable alley. Lot 2 will be owned by the City and be part of the new alley. RECOMMENDATION Planning staff recommends the Zoning Advisory Commission approve the Plat of Survey of Lot 1 and 2 of Bee Branch Subdivision No. 7 subject to waiving lot area requirement for Lot 2. The submitted Plat of Survey is in all respects compliant with the Unified Development Code.
