The application, staff report and related materials are attached for your review. Discussion Commissioner Norton abstained due to a conflict as an employee of the land surveyor. The applicant, Deron Muehring, spoke in favor of the request, reviewing the need for the plat is for the City to purchase additional land for improvements to the Bee Branch Creek Restoration Project. Staff reviewed the staff report, noting that the submitted Plat of Survey facilitates construction of a permeable alley, but creates a substandard lot that requires a waiver of lot area and lot frontage for Lot 2. There were no public comments. The Zoning Advisory Commission discussed the request, and found it appropriate. Recommendation By a vote of 4 to 0, with one abstention, the Zoning Advisory Commission recommends that the City Council approve the request subject to waiving lot frontage and lot area for Lot 2. A simple majority vote is needed for the City Council to approve the request. SUBJECT: Plat of Survey of Lot 1 and 2 of Bee Branch Subdivision No. 8 Dubuque blend All-America City HI H 2007 April 25, 2012 INTRODUCTION The submitted Plat of Survey of Lot land 2 of Bee Branch Subdivision No. 8 subdivides an existing 3,474 square foot lot into two parcels. The Zoning Advisory Commission is reviewing the Plat of Survey as Lot 2 does not have frontage on a public or private street, and is only 676 square foot in lot area where 2,500 square foot of lot area is required in the R -2A Alternate Two - Family Residential District. DISCUSSION The submitted Plat of Survey subdivides the existing parcel of land into two lots. Lot 2 has insufficient lot area and lot frontage. The lot split is being done by the City of Dubuque as part of the Bee Branch Restoration Project, and includes the construction of a new permeable alley in this location. RECOMMENDATION Planning staff recommends the Zoning Advisory Commission approve the Plat of Survey of Lot 1 and 2 of Bee Branch Subdivision No. 8 subject to waiving the lot frontage requirement and lot area requirement for Lot 2. The submitted Plat of Survey is in all respects compliant with the Unified Development Code.
