Duggan and members of the City Council Date: November 18, 1999 Re: Claim of Larry Hurst Claimant Date of Cla~ Date of Loss Nature of Claim Larry Hurst 5/25/99 4/7/99 property damage This is a claim for reimbursement of expenses (construction and Roto-Rooter) the claimant incurred as a result of a sewer backup, which he claims resulted from an improperly installed sewer. According to the report of Gus Psihoyos, Assistant City Engineer, poor construction practices caused the pipe to collapse. He recommends payment of the claim from the Sanitary Sewer Construction Fund, and the Legal Department concurs with his recommendation. Q \II) \,Q!.AA "'V Larry Hurst Claim SUBJECT: The noted claim of Larry Hurst relates to the City sanitary sewer construction project done by W. C. Stewart Construction Company. The contract called for the standard form of contracts and bonds with the City, which require the contractor to hold the City harmless from any claims of damages resulting from their work. The sanitary sewer lateral in question was installed by a City contractor. During the uncovering of the problem area, it was found that poor construction practices caused the pipe to collapse.
