Appeal of Sidewal Installation at 449 Lowell StreetMayor Rou Buol & City Council Members City of Dubuque City Hall 50 West 13th St. Dubuque, IA 52001 May 29, 2012 To Whom It May Concern, RECEIVED 12MAY3I AM 9 :24 City Clerk's Office Dubuque, IA Recently we built a new garage at our house in the back yard. We do live on the corner of Lowell and Rosaline streets. When we did get the permit for the garage, we were informed that we may have to put in a sidewalk on the Rosaline side of our home. We are asking for your consideration on this matter, to not have us put the sidewalk in at this time. One of the reasons is there are no sidewalks on Rosaline, our garage does face Rosaline St. This street is between Lowell and Klingenberg Terrace. There are no sidewalks on Klingenberg Terrace either. Right now it does not make sense to us to put in this expensive sidewalk, and to have the upkeep for a sidewalk that will lead to nowhere. No one will walk down the sidewalk on our property and then when they reach the end of our property they will have to step over and walk out on the street. The City a few years back put up a very expensive and beautiful wall on the north side of Klingenberg Terrace this was a major improvement and they did not put in a sidewalk. I know the City is facing some issues with drainage in this area, and I know everyone is thinking "Green ". I do think the sidewalk will add to the drainage going down to Kaufmann Ave. and down to the Central and 22nd Street intersection. We are asking you to please take our matter into consideration at this time. Right now it does not make sense to us to put in this expensive sidewalk at this time. We would agree with the City and put the sidewalk in if it would lead to other sidewalks. We would agree to put in a sidewalk when the Rosaline properties along with the Klingenberg Terrace properties do. At that point it would make sense to put it in. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer RE: Sidewalk Install Waiver Request — 449 Lowell St. DATE: April 18, 2012 INTRODUCTION Dubuque kraal A IAmedcaC; 2007 This memo is to request concurrence with the Engineering Department recommendation regarding a sidewalk installation waiver request from the owners at 449 Lowell Street. DISCUSSION On November 2, 2011 a building permit was issued to Mr.& Mrs. Rodney Chapman to erect a 24' x 30' detached garage. At that time the owner was aware of the requirement to install sidewalks but could delay until the spring of 2012. The Lowell Street side of their property does have walks installed. After review of the area Mr. & Mrs. Chapman have submitted a request of waiver for the walk installation on the Rosaline Street side of their property. The owners reasons for the request to waive the requirement include: no walk on the property that abuts 449 Lowell on the Rosaline Street side, only partial walks on the opposite side of Rosaline Street and no sidewalks on the very limited right of way of Klingenberg Terrace. Rosaline Street has a 50 foot right of way with the roadway shifted to the east. Klingenberg Terrace has a right of way varying from 15 foot to 40 foot with a large retaining wall and guardrail on the north side with the roadway shifted to the south. Mr. & Mrs. Chapman have agreed that if and when the Klingenberg Terrace would be improved with walk, which then their walk would lead to, they would install at that time. RECOMMENDATION Upon City Engineering review it was determined that physically the walk could be installed with additional grading. If anyone were to park along the curbing at this residence, walk would then be available to access Lowell Street in the one direction, however, in the other direction it would lead to a second property without walk and then to Klingenberg Terrace that does not have walk. ACTION TO BE TAKEN Please review the attached map showing the sidewalks currently installed in the area of 449 Lowell Street and consider the Engineering Department recommendation to require installation. If you do not agree, have other alternatives or wish to discuss please let me know.
