SUBJECT: Lot 2 of Whites Place - Acceptance of Warranty Deed
City Engineer Gus Psihoyos recommends City Council approval of the acceptance of
the warranty deed for Lot 2 of Whites Place, a property purchased for the Carter Road
Detention Basin Project in February 2004.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memo is to seek approval to accept the warranty deed for Lot 2 of
Whites Place, a property purchased for the Carter Road Detention Basin Project.
DISCUSSION
Enclosed is a warranty deed for Lot 2 of Whites Place (see picture below). The City
purchased the property for Carter Road Detention Basin.

The payment for the property was made in February, 2004. The purchase can be
finalized once the City Council accepts the warranty and it is recorded by the County
Recorder.
RECOMMENDATION
I recommend acceptance of the conveyance of the property described as Lot 2 of
Whites Place in the City of Dubuque, Iowa, to the City of Dubuque.
BUDGET IMPACT
The property was previously budgeted and purchased as part of the Carter Road
Detention Basin Project. Therefore, there is no current budget impact.
ACTION TO BE TAKEN
I respectfully request adoption of the attached resolution accepting conveyance of the
property described as Lot 2 of Whites Place in the City of Dubuque, Iowa, to the City of
Dubuque.

ACCEPTING A CONVEYANCE OF PROPERTY OF LOT 2 OF WHITES
PLACE TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an Acquisition Agreement with
Steven P. and Michelle R. Whites pursuant to which Steven P. and Michelle R.
Whites agreed to convey Lot 2 of Whites Place, in the City of Dubuque, Iowa, as
shown on the Warranty Deed thereof; and
Whereas, Steven P. and Michelle R. Whites has executed a conveyance
of said property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the City Council of the City of Dubuque, Iowa, hereby
approves of, accepts, and consents to the Warranty Deed from Steven P. and
Michelle R. Whites, copies of which are attached hereto, as required by Iowa
Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection
herewith.
