SUBJECT: Acceptance of Public Improvements in Hy-Vee Subdivision
(Vacated Railroad Avenue)
As a condition of vacating a portion of Railroad Avenue, Hy-Vee Inc. was required to
relocate sanitary sewer and water main and to dedicate the improvements to the City
upon completion.
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Hy-Vee, Inc., has recently completed in Hy-Vee Subdivision.
Maintenance of said improvements shall be the responsibility of the owner, Hy-Vee,
Inc., for a period of two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in Hy-Vee Subdivision
(Vacated Railroad Avenue)
INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, Hy-Vee, Inc., has recently completed in Hy-
Vee Subdivision.
BACKGROUND
As a condition of the vacating of a portion of Railroad Avenue through Ordinance
No. 71-04, Resolution No. 364-04, and Hy-Vee Subdivision Plat Resolution No.
418-04, Hy-Vee, Inc. was required to relocate sanitary sewer and watermain and
to dedicate the improvements to the City upon completion. Hy-Vee, Inc. has
recently completed the improvements and has formally requested the City's
acceptance of the sanitary sewer and watermain which have been installed.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
On May 16, 2005, IIW Engineers & Surveyors, PC, representing Hy-Vee, Inc.,
requested the City's acceptance of the improvements in Hy-Vee Subdivision.
Upon inspection by the City, it has been determined that all of the public
improvements required by Resolution Nos. 364-04 and 418-04 and Ordinance
No. 71-04 have been completed in accordance with plans approved by City
Engineering and in conformance with City specifications.
RECOMMENDATION
I would therefore recommend that the City Council accept the improvements.
Maintenance of said improvements shall be the responsibility of the owner, Hy-
Vee, Inc., for a period of two years from the date of acceptance by the City
Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

ACCEPTING IMPROVEMENTS IN HY -VEE SUBDIVISION
Whereas, pursuant to Resolution Nos. 364-04 and 418-04 and Ordinance
No. 71-04, certain improvements including sanitary sewer and watermain were
installed by the developer of Hy-Vee Subdivision.
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by City Engineering and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvements in Hy-Vee Subdivision be and the same is hereby
accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the owner, Hy-Vee, Inc., for a period of two years from this date.
