City Engineer Gus Psihoyos is recommending acceptance of the Pennsylvania Avenue
- Radford Road Sidewalk Installation Project, as completed by Skyline Construction, in
the final contract amount of $6,368.77, which is a 91.5% decrease from the original
contract in the amount of $75,270.55. This difference is because all but two of the
properties put in the sidewalk.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract
for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project.
BACKGROUND
On November 15, 2005 City Council approved installation of sidewalks on the
north side of Pennsylvania Avenue from Iowa 32 (Northwest Arterial) to Radford
Road, the east side of Radford Road from Pennsylvania Avenue to the Asbury
city limits, and from Eleanor Roosevelt Middle School, northerly, on the west side
of Radford Road to the Asbury city limits.
DISCUSSION
The Pennsylvania Avenue - Radford Road Sidewalk Installation Project has
been completed by Skyline Construction of Zwingle, Iowa, in the final contract of
$6,368.77, which is a 91.5% decrease from the original contract in the amount of
$75,270.55.
Property owners were given until June 6, 2005, to install the sidewalks prior to
Skyline Construction performing the work and assessments being placed on the
properties.
Two properties remained after the installation deadline. The total amount of
assessments is $4,680.50, which is being levied against one property owner on
two separate parcels.
Since the sidewalk is an integral part of the overall sidewalk network for safe
passageway for students to the new Middle School, an incentive bonus for the
contractor was included to complete all work prior to the specified completion
date of August 15, 2005.
Since Skyline Construction's work was completed by June 21,2005, an incentive
bonus of $303.27 is being awarded based on a calculation of a maximum five (5)
percent of actual construction cost.
RECOMMENDATION
I would recommend that the City Council accept the improvements, establish the
final contract at $6,368.77, and adopt the preliminary schedule of final
assessments.

The project funding summary is as follows:

The City's share will be funded through the Sales Tax Fund as provided in CIPs
010C89/1001717 (Pennsylvania and Radford Sidewalks) and 350042/3501425
(Sidewalk Program - City-Owned Property).
Property owners who qualify may be eligible for the new sidewalk installation
special assessments assistance program passed by City Council on August 1.
The funding will provide 20% to 100% of the sidewalk assessments for eligible
owner-occupied property.
To allow sufficient administrative time to process financial assistance payments
for low- to moderate-income families, the adoption of the schedule of final
assessments will be delayed approximately 45 days. In its place is a resolution
adopting a preliminary schedule of final assessments. Property owners may use
this period to apply for financial assistance that may reduce the amount of the
assessment payable by the property owner.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the
improvements, establishing the final contract amount, and approving the
preliminary schedule of final assessments.

RESOLUTION NO. .394-05
ACCEPTING THE PENNSYLVANIA AVENUE - RADFORD ROAD SIDEWALK
INSTALLATION PROJECT
Whereas, the contract for the Pennsylvania Avenue - Radford Road Sidewalk
Installation Project (the Project) has been completed and the City Manager has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the contract, plans and specifications and that the City
Manager recommends that the Project be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Manager is approved and the Project
is hereby accepted.
Section 2. The City Treasurer is hereby directed to pay to the contractor from the
Sales Tax Fund in the amount of $6,368.77 the contract amount less any retained
percentage provided for therein as provided in Iowa Code chapter 573, and to pay such
retainage only in accordance with the provisions of Iowa Code chapter 573.

RESOLUTION NO. 395-05
FINAL ESTIMATE
Whereas, the construction contract for the Pennsylvania Avenue - Radford Road
Sidewalk Installation Project has been completed and the City Engineer has submitted
his final estimate showing the cost thereof including the cost of estimates, notices and
inspection and all miscellaneous costs.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be
$12,587.83 and the said amount shall be paid from the Local Option Sales Tax Fund in
the amount of $7,907.33 and special assessments in the amount of $4,680.50.

You are hereby notified that the final schedule of assessments against benefited
properties within the District described as the Pennsylvania Avenue - Radford Road
Sidewalk Installation Project has been adopted and assessments confirmed and levied
by the City Council of Dubuque, Iowa, and that said schedule of assessments has been
certified to the County Treasurer of Dubuque County, Iowa.
YOU ARE FURTHER NOTIFIED THAT ASSESSMENTS MAY BE PAID IN FULL OR
IN PART WITHOUT INTEREST AT THE OFFICE OF THE CITY TREASURER, 50 W.
13TH STREET, DUBUQUE, IOWA, 52001 AT ANY TIME WITHIN 30 DAYS AFTER
THE DATE OF THIS LETTER.
After 30 days, unpaid special assessments of $50.00 or more are payable in 10
annual installments and will draw annual interest at nine (9) percent computed to the
December 1 next following the due dates of the respective installments as provided in
Section 384.65 of the Code of Iowa. Each installment will be delinquent from October 1
following its due date on July 1st of each year. Property owners may elect to pay any
annual installment semiannually in advance.
All properties located within the boundaries of the Pennsylvania Avenue -
Radford Road Sidewalk Installation Project above described have been assessed for
the cost of the making of said improvements, the amount of each assessment and the
amount of any conditional deficiency assessment having been set out in the schedule of
assessments accompanying the same, which are now on file in the office of the County
Treasurer of Dubuque County, Iowa. For further information you are referred to said
schedule of assessments.
This Notice given by direction of the City Council of the City of Dubuque, Iowa, as
provided in Section 384.60 of the Code of Iowa.
