Maintenance)
On August 12, 2005, a section of pavement on Stoneman Road collapsed. The
preliminary estimate to make the necessary storm sewer and street repairs is just under
$75,000, but in excess of the $25,000 threshold that, by Iowa Code, necessitates that
the bidding and award proceed through the City Council. However, Iowa Code
9384.103(2) provides an exception for emergency repairs.
If the project proceeds through the City Council under non-emergency status, the
expected completion date would be November 4, 2005. If the project proceeds under
emergency status, the expected completion date would be October 7,2005.
City Engineer Gus Psihoyos is recommending City Council approval of a resolution
finding that the delay of a public letting might cause serious loss or injury to the City,
thereby necessitating the institution of emergency proceedings under Iowa Code
9384.103(2).
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memo is to recommend that you request authorization from the City
Council to repair the collapsed storm sewer under Stoneman Road and John F.
Kennedy Road under the emergency repair provisions of the Iowa Code. This will allow
the repairs to be completed within the next 30 days.
BACKGROUND
On August 12, 2005 a section of pavement on Stoneman Road collapsed. Our
investigation revealed that the 36-inch diameter corrugated metal storm sewer at
Stoneman Road running under John F. Kennedy Road has large voids. As the
stormwater from the August 11 rain flowed through the storm sewer pipe, the soil above
the pipe was taken through the pipe. Without the supporting soil, the pavement
collapsed.
DISCUSSION
The repair consists of replacing the existing 135 feet of corrugated metal pipe that is
over 25 feet deep under John F. Kennedy Road. The storm sewer has been
redesigned at a depth of 10 feet and will be replaced with reinforced concrete pipe.
The repair will necessitate crossing John F. Kennedy Road from Stoneman Road to the
parking lot of the Long John Silver's restaurant. Night work only is being considered to
install the pipe under John F. Kennedy Road.
The preliminary estimate to make the necessary storm sewer and street repairs is just
under $75,000, but in excess of the $25,000 threshold that, by Iowa Code, necessitates
that the bidding and award proceed through the City Council. However, Iowa Code sec.
384.103(2), which provides an exception for emergency repairs, states:
When emergency repair of a public improvement is necessary and
the delay of advertising and a public letting might cause serious loss
or injury to the city, the governing body shall, by resolution, make a
finding of the necessity to institute emergency proceedings under this
section, and shall procure a certificate from a competent registered
professional engineer or architect, not in the regular employ of the
city, certifying that emergency repairs are necessary. In that event
the governing body may contract for emergency repairs without
holding a public hearing and advertising for bids, and the provisions
of sections 384.96 to 384.102, do not apply.
Attached is a letter from Tony Zelinskas, a Professional Engineer registered in the State
of Iowa, certifying that the emergency repairs are necessary.
If the project proceeds through the City Council under non-emergency status and the
City Council passes a resolution to initiate the bidding process and authorizing the City
Clerk to advertise for bids at the September 6th City Council meeting, the schedule
would be as follows:

RECOMMENDATION
I recommend adoption of the attached resolution, finding that the delay of a public
letting might cause serious loss or injury to the City thereby necessitating the institution
of emergency proceedings under Iowa Code sec. 384.103(2).

General Storm Sewer Repair appropriation (CIP 7201066) in the amount of $80,000;
the Fiscal Year 2006 Storm Sewer Improvements/Extensions appropriation in the
amount of $97,784 (CIP 3501008); and the Fiscal Year 2006 Catch Basin Maintenance
appropriation in the amount of $25,000 (CIP 7201081).

RESOLUTION AUTHORIZING EMERGENCY REPAIRS TO THE STONEMAN
ROAD/JOHN F. KENNEDY ROAD STORM SEWER
Whereas, the pavement on Stoneman Road has collapsed as the result of a
deteriorated storm sewer under Stoneman Road and John F. Kennedy Road; and
Whereas, Iowa Code ~ 384.103 provides that when emergency repair of a public
improvement is necessary and the delay of advertising and a public letting might cause
serious loss or injury to the city, the governing body shall, by resolution, make a finding
of the necessity to institute emergency proceedings and shall procure a certificate from
a competent registered professional engineer or architect, not in the regular employ of
the City, certifying that emergency repairs are necessary, and that in that event the
governing body may contract for emergency repairs without holding a public hearing
and advertising for bids; and
Whereas, the City Council finds that the emergency repair of the storm sewer is
necessary and the delay of advertising and a public letting might cause serious loss or
injury to the city; and
Whereas, the City has procured a certificate from a competent professional
engineer registered in the State of Iowa, not in the regular employ of the City, certifying
that emergency repairs to the sewer are necessary.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council finds that it is necessary to institute emergency
proceedings to repair the Stoneman Road/John F. Kennedy Road storm sewer.
Section 2. The City Manager is hereby authorized to proceed with instituting such
emergency repairs as provided by law.

Emergency Repair Certificate
Dear Mr. Muehring:
Per our discussion and a site visit by me on August 23, 2005, we have observed that a
storm sewer has collapsed at Stoneman Road and JFK Road. The collapse appears to
be caused by the failure of an existing 36" diameter CMP that is under the collapsed
storm sewer, causing a sink hole to develop. The City has televised the existing 36"
diameter CMP that runs from Stoneman Road across JFK, through the Long John Silver
restaurant parking lot. The resulting videotape indicates that the 36"diameter CMP is
approximately 25 feet deep, with voids in the pipe, and that the top of the pipe is
sagging. Additionally, the 36" diameter CMP appears to have collapsed at some
location, since the entire length could not be televised. Because of the high traffic
volume on JFK Drive and the existing sink hole at Stoneman Road, it is our opinion that
an emergency repair of the 36 "diameter CMP storm sewer line, the related storm sewer
system and affected roadway pavements are essential and must be undertaken
immediately, and that the delay of going through the contract letting procedure threatens
serious loss to the City.
