This is a claim in which claimant alleges that City of Dubuque police officers used forced
entry to gain entrance to claimant's rental property while responding to a domestic
disturbance, causing damage to the door.
This claim has been referred to Public Entity Risk Services of Iowa, the agent for the Iowa
Communities Assurance Pool.

Dubuque, IA 52001. It will then be referred to the appropriate department for
investigation and to the City Attorney's Office. Once that investigation is
completed, a report and recommendation will be submitted to the City Council.
You will be provided with a copy of that report and recommendation.
The final decision on all claims is made by the City Council. No employee of the

The City of Dubuque Police Dept. responded to a call of domestic disturbance at 532
Rhomberg #4 on Saturday, June 2nd. The case # is 12 -26826 and the lead officer was Lt.
Messerich. There was no evidence of disturbance when police arrived and no answer
when police knocked on the door. All indications were that no one was home. At that
point, instead of calling me at the phone # on file at the police station they broke down
the door to gain access, only to find the apartment empty. I am submitting the following
expenses I incurred as a direct result of their lack of judgement,
