Kritz, Associate Planner 1• x• SUBJECT: Final Plat of Peterson Addition in Dubuque County, Iowa Dubuque kiltA All-America City 2007 April 24, 2012 INTRODUCTION The submitted Final Plat of Peterson Addition is located in Dubuque County at 12647 North Cascade Road. The submitted Final Plat is being reviewed jointly by both the City and County of Dubuque as the property is within two miles of the corporate limits. The property is also within the Southwest Arterial Moratorium Area as well as located in a primary growth area as established by the city of Dubuque Fringe Area Policy. DISCUSSION The Ordinance establishing the Southwest Arterial Moratorium provides for the City Council review of plats within the corridor. The City Council may approve a proposed plat upon a determination that the proposed subdivision will not negatively impact the acquisition of right -of -way along the preferred alignment of the Southwest Arterial corridor. The applicants received a driveway permit from the County in March of 2011. This new access was reviewed jointly between the City and County as well as the Southwest Arterial Technical Committee. Information regarding this request is attached to this memorandum. The City and the Southwest Arterial Technical Committee did not have any objection to the proposed driveway as requested by the applicant, Mr. Peterson. In addition, as part of the acquisition of right -of -way for the Southwest Arterial, the City purchased a strip of land in front of Mr. and Mrs. Peterson's property. This area is shown on the plat as right -of -way line per recorded Acquisition Plat No. 2010 - 10274. The subject property is also located within a primary growth area as established by the City of Dubuque's Fringe Area Development Policy. The Policy states that for subdivisions in primary growth areas, "the city shall require pre- annexation agreements setting froth any and all of the above fringe area development standards, and any Memo to Zoning Advisory Commission Page 2 additional standards unless the need for a pre- annexation agreement is waived by the City." Attached to this memorandum are the fringe area development standards for the primary growth areas and a map of the growth areas. Because the submitted Final Plat splits an existing parcel of land into two and only allows for the construction of an additional single - family residence, the subdivision standards outlined in the fringe area development standards are not applicable. RECOMMENDATION Planning staff recommends that the Final Plat of Peterson Addition in Dubuque County, Iowa be approved to subject to waiving lot frontage requirements for Lot 2 whereby 24.3 feet of frontage is allowed where 50 feet is required. The submitted Final Plat is in all other respects is in compliance with the Unified Development Code. The following are our observations and comments on the proposed driveway location for David Peterson at 12647 N Cascade Road. Driveway spacing: The County is correct that the proposed driveway location does not meet their standard spacing of 560'. Our comments are as follows: 1. The proposed entrance would be at least 300' from the center of the future north intersection connection for access to the North Cascade / English Mill Road Interchange. I don't believe that a residential drive would significantly impact the traffic operations at this future intersection. 2. The forecast traffic on this leg of N. Cascade Road is 1,600 vehicles per day (2030 forecast). From a traffic standpoint, it doesn't appear that another residential driveway would be a significant traffic issue. 3. North Cascade Road is currently classified as a collector street/road. Normally there should be some level of access management on collector streets. 4. There are several other access points along North Cascade Road which do not meet the County's 560' access spacing. So this variance would not be setting a new precedent. 5. In my opinion, adequate sight distance is the most critical consideration. Upon review, sight distance appears to be adequate based on current County standards. Upon our review, the City does not have an objection to the proposed driveway as requested by David Peterson. O'SHEA Administrator This memo is in regard to a request by David & Joyce Peterson to be allowed to obtain a new entrance for a residential lot that is proposed to be 138' NE of their current driveway. The new entrance will meet site distance requirements but will not meet the spacing requirements. Mr. Peterson has 138' of spacing to the right of his proposed driveway but needs 560' minimum. The left side spacing meets requirements at 822 feet. For background, this property is approximately 4.66 acres and is zoned R -1, Rural Residential. There is one home on the property and Mr. Peterson wants to split off one or two additional lots for future residential development. The current home was placed close to the road in the center of the lot so there appears to be adequate room for at least one or two additional houses. Some of this property along North Cascade Road was purchased for right of way for the Southwest Arterial project. The new entrance is does not appear to be planned based on the line drawings we have for the Southwest Arterial. The Moratorium addresses Zoning Certificates, Rezoning Applications, Subdivisions, Wells and Septic Systems through July 1, 2011. Entrance Permits are not required to be reviewed, but since this will eventually require a subdivision plat, I am sending this on to you for comment. Also, since the spacing cannot be met, the Board of Supervisors will need to approve a variance for the spacing to allow the new driveway. Fringe Area Development Standards The parties agree to apply the following Fringe Area Development Standards to subdivisions and developments over two (2) acres in the Fringe Area: 1. Pr nary Growth Areas a. Annexation 1) These areas can be serviced by City utilities. They represent areas that could at any time be under active development. This agreement will allow greater control over land use and development standards to help ensure more orderly development patterns. 2) As set forth in the City of Dubuque's Comprehensive Plan and Annexation Study, the City will likely annex land within these primary growth areas. New subdivisions and developments within these areas shall be required to meet the City Standards and utilize good Access Management principles. 3) The City shall require a pre - annexation agreement setting forth any and all of the above Fringe Area Development Standards and any additional standards unless the need for a pre - annexation agreement is waived by the City. 4) The City, concurrent with annexation and based on available funding, shall consider reimbursing the County for improvements made to County roads prior to annexation based on an amortization schedule agreed upon by the parties, with the following conditions: a) If the roadway fronts property for which a pre - annexation agreement with the City of Dubuque has been filed; and b) If based on the lifecycle of the roadway, not to exceed 25 years. 5) The City, concurrent with annexation and contingent upon available funding, may consider providing financial incentives to developers of new owner occupied residential subdivisions that meet the City's criteria for affordable housing in these areas to encourage compliance with the City Standards. b. Zoning 1) Any zoning changes in the primary growth areas shall consider the County's Comprehensive Land Use Development Plan and Future Land Use Map as well as the City's Comprehensive Plan and Proposed Land Use Map. 6 2) Land in the primary growth areas may develop in conformance with existing zoning. c. Subdivision /Development Review 1) Subdivisions and developments which are approved prior to annexation shall provide easements for future connections to City utilities and provide a mechanism for transfer of public right -of -way (ROW) ownership for County roads to the City upon annexation. 2) Private roads and streets in subdivisions and developments that are not under the County's ownership prior to annexation shall remain as private roads and streets upon annexation to the City, unless and until such time as they are brought into compliance with City Standards and accepted by the City as public streets. 3) New subdivisions and new developments shall conform to City Standards, including but not limited to City specifications for streets, sanitary sewer lines, stormwater management, erosion control measures, stormwater retention /detention facilities, fire protection and suppression, and water lines. 4) Developers may be required to use shared wells and shared or central sewage treatment systems where appropriate. 5) Developers shall be required to utilize stormwater management and erosion control measures, and stormwater retention /detention facilities where appropriate in accordance with applicable National Pollutant Discharge Elimination System (NPDES) regulations. 2. Secondary Growth Areas a.
