issue a license to the applicant upon the pay-
ment of five dollars ($5.00). Such license shall
be in effect for the remainder of the calendar
year. A license for every calendar year thereaf-
ter shall be issued upon the payment of five
dollars ($5.00) unless the license for the preced-
ing year is in suspension or has been revoked.
(b) The license shall be worn upon the cloth-
ing of the driver. (1976 Code, ~ 38-43)
Sec. 46-44. Failure To Comply With City,
State And Federal Laws:
Every driver licensed under this Article shall
comply with all City, State and Federal laws.
Failure to do so will justify the City Manager
suspending or revoking a license. (1976 Code,
~ 38-44)

Sec. 46-45. Suspension And Revocation Of
License:
The City Manager is hereby given the author-
ity to suspend any driver's license issued under
this Article for a driver failing or refusing to
comply with the provisions of this Article, such
suspension to last for a period of not more than
thirty (30) days. The City Manager is also given
authority to revoke any driver's license for
failure to comply with the provisions of this
Article. Prior to the suspension or revocation,
the driver shall be given written notice of the
proposed action to be taken and shall have an
opportunity to be heard by the City Council,
which shall affirm or reverse the suspension or

DIVISION 2. TRANSIT AUTHORITYl
Sec. 46-66. Established:
The City does hereby create and establish a
Transit Authority in and for the City, effective
July I, 1975. (1976 Code, ~ 38-66)
Sec. 46-67. Qualifications Of Trustees:
The trustees of the Transit Authority shall
qualify by taking their respective oaths of of-
fice. (1976 Code, ~ 38-67; Ord. 94-95, ~ 1,
12-18-1995)
Sec. 46.68. Organization, Election Of Offi-
cers; Adoption Of Rules;
Terms:
(a) The Board of Trustees of the Transit Au-
thority shall organize for its transaction of
business, elect from its own number a chairper-
son and a secretary who shall serve for such
terms as the Board shall determine, not exceed-
ing their terms of office as members of the
Board, and abide by all rules and regulations
that govern the proceedings of the Board.
(b) The Board of Trustees of the Transit Au-
thority shall comprise five (5) trustees appoint-
ed by the City Council. Three (3) of the initial
appointments shall be for terms expiring July
30, 1984; one of the initial appointments shall
be for a term expiring July 30, 1983; and one of
the initial appointments shall be for .a term
expiring July 30, 1982. Thereafter, all appoint-
ments shall be for 8 term of three (3) years or
until a successor has been appointed and quali-
fied. (1976 Code, ~ 38-68)

VEHICLES FOR HIRE AND PUBLIC TRANSPORTATION
the Transit Authority shall constitute a quorum
for the transaction of business. All action of the
Board shall be by resolution and the affirmative
vote of at least three (3) members shall be nec-
essary for the adoption of any resolution. (1976
Code, ~ 38-69)
Sec. 46-70. Records Of The Board Of
Trustees:
All resolutions, documents and records of the
Board of Trustees shall be governed by the Iowa
Examination of Public Records Act. (1976 Code,
~ 38-70)
Sec. 46-71. Powers, Duties Of Board:
The Board of Trustees of the Transit Authori-
ty shall have:
(1) The power to execute agreements and act
as the applicant and recipient of Federal
and State grants relating to the transit
system operation and the purchase of
new equipment.
(2) The power from time to time to fix and
establish routes and schedules and
change the same whenever it is deemed
advisable and to fix, maintain and regu-
late rates, fares or charges for the trans-
portation of passengers and any inciden-
tal services and the rates or charges to
be made for advertising in buses or any
other facility under the control of the

Sec. 46-72. Deposit Of Funds:
All funds derived from taxation, Federal and
State grants, fares, or funds collected otherwise
for transit system purposes shall be deposited
with the Treasurer of the City to the credit of

Sec. 46-73. Contracts And Agreements:
Contracts, grant applications and agreements
entered into wherein the City Transit Authority
is a party shall be subject to review and approv-
al by the City Council. (1976 Code, ~ 38-73)
Sec. 46-74. Meetings:
(a) The Transit Authority shall meet not less
than bimonthly on a regularly scheduled day.
(b) Members of the Board of Trustees of the
Transit Authority shall attend at least two-
thirds CZ/3) of all regularly scheduled meetings
within any twelve (12) month period. If any
member does not attend such prescribed num-
ber of meetings, it shall constitute grounds for
the Board to recommend to the City Council
that said member be replaced. Attendance of all
members shall be entered on the minutes.
(c) All meetings shall be held in conformance
with the provisions of the Iowa Open Meetings
Law.
(d) The Board of Trustees of the Transit Au-
thority shall file with the City Council a copy of
the minutes of each regular and special meeting
of the Board within ten (10) working days after
each such meeting. (1976 Code, ~ 38-74)
Sec. 46-75. Procedures For Operations:
All administrative, personnel, accounting,
budgetary and procurement policies of the City
shall govern the Transit Board of Trustees in
all of its operations. (1976 Code, ~ 38-75)

To City Counsel Members,
I am writing to each of you to introduce myself, James (Jim) P. Kieffer. I have completed an application for the
Zoning Advisory Commission and would like for you to consider me when you make your appointment to the
commission. I understand that I missed the last City Counsel meeting and others were given the chance to be
interviewed. I hope this letter will help to inform you of whom I am and why I want to be the next member of the
Zoning Advisory Commission. I will be at your next meeting and eligible for interviewing if you so desire.
I am a native "Dubuquer" and have lived here for 36 of my 40 years on this earth. I am a graduate of Loras
College with a Bachelors Degree in Business Administration. My wife is Julie and we have two grade school
aged children, Katie and Cody. I am the Vice President of ENTEGEE, Engineering Technical Group. ENTEGEE
specializes in providing engineering services to hundreds of companies across the United States. I have been
with ENTEGEE since 1989 and helped grow the professional staff in the Dubuque operation from six employees
to over 65. Additionally, I have completed the Dubuque Area Chamber of Commerce's Leadership Dubuque
program. In going through the Leadership Program I made a commitment that I would volunteer and give back to
Dubuque. I am now at a junction in my life where I am ready and willing to help make our community a better
place.
My goal is to make the city of Dubuque a place that my children and their children will think of as an option to
have a career and raise their families. As a hiring manager of professionals I find it very challenging to attract
people to work in Dubuque. I am constantly trying to find former "Dubuquers" and attract them to come home. I
want to change the impression that our well educated youth have to leave DUbuque to have a career.
I ask that you consider me as the next board member for the Zoning Advisory Commission. I am dedicated and
committed to making the right decisions and I will help others understand the impact of zoning issues to our
community.

Sec. 36-10. Zoning Advisory Commission
Created; Composition; Ap-
pointment:
There is hereby created a City Zoning Adviso-
ry Commission, which shall consist of seven (7)
residents of the City, appointed by the City
Coun":- : '.., shall be qualified by knowledge,
experience and ability to act in matters pertain-
ing to short-range planning and zoning, none of
whom shall hold an elective position in the

Sec.36-10.1. Appointment To Airport
Zoning Commission:
Two (2) members of the Commission shall be
appointed by the City Council to serve on the
Airport Zoning Commission. A member shall
serve out the term on the Airport Zoning Com-
mission even if the member's term on the Zon-
ing Commission has expired. (Ord. 86-95,

Sec. 36-11. Application And Appointment
Process:
The appointment process to the Commission
by the City Council shall include at least the
following:
(1) An application form requesting basic
information on the education, training,
experience, expectations and other quali-
fications of the applicant;
(2) Notice to and an opportunity for the
general public to comment in writing on
the qualifications of each applicant; and
(3) A formal interview by the Cit.y Council to
determine the applicant's qualifications
and ability to effectively serve on the

Sec. 36.12. Terms; Filling or Vacancies;
Com pensation:
The term of office for members of the Zoning
Advisory Commission shall be three (3) years or
until a successor is duly appointed. Two (2) of
the initial terms shall be for a term of one year;
two (2) of the initial terms for two (2) years;
and three (3) of the initial terms for three (3)
years.
A Commission member may be. removed at.
any time with or without cause by a vote of two-
thirds (%/J) of all members of the City Council.

A vacancy occurring on the Commission

filled by appointment by the City Council for
the remainder of the unexpired term.
All members of the Commission shall serve
without compensation except for actual expens-
es, which shall be subject to approval by the

Sec. 36-13. Powers:,
The Zoning Advisory Commission shall con-
cern itself with short-range physical planning
and shall have and possess the following pow-
ers, duties and responsibilities:

(1) To prepare and recommend a Zoning
Ordinance by exercising the powers con-
ferred by Iowa Code chapter 414, "Munic-
ipal Zoning". Such Zoning Ordinance
shall include the boundaries of the vari-
." I -(lning districts; the height, number
of stories and size of buildings and other
structures in each district; the percent-
age of ground that may be occupied;
se~back requirements; the size of yards,
courts and other open space; the density
of population; the location and use or
buildings, structures, and land for trade,
industry, commerciaJ, residential or
other purposes; and such regulations and
restrictions necessary to enforce such
zoning provisions. To this end the Zoning
Advisory COmmission shall prepare a
preliminary Zoning Ordinance and hold
public hearings thereon and after such
hearings have been held, shall submit a
final Zoning Ordinance and its recom-
mendations to the City Council;
(2) To recommend to the City Council, from
time to time, as conditions require,
amendments, supplements, changes or
modifications to the Zoning Ordinance

(3) To make such surveys, studies, maps,
plans or plats of the whole or any portion

of the City and of any land outside there-
of, which in the opinion of the Zoning
Advisory Commission are consistent with
the Comprehensive Plan and are neces-
sary to carry out the purposes of the
Commission;
(4) To make recommendations to the City
Council upon plans, plats or replats of
subdivisions or resubdivisions within the
City which show streets, alleys or other
portions of the same intended to be dedi-
cated for public use;
(5) To make recommendations to the Long-
Range Planning Advisory COmmission on
the preparation and maintenance of the
Comprehensive Plan;
(6) To fulfill those duties and responsibili-
ties assigned to a City Planning Commis-
sion in Iowa Code chapter 409, "Plats";
and
(7) To undertake from time to time other
specific short-range planning projects
which may be referred to it by the City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Com."'Ilis-

Sec. 36-14. Organization; Meetings:
(a) The Zoning Advisory Commission shall
choose annually, at its first regular meeting of
the fiscal year, one of its members to act as
chairperson, and another of its members to act
as vice-chairperson, to perform all of the duties
or the chairperson during the chairperson's
absence or disability. The Commission shall
adopt such rules and regulations goyerning its
operation and procedure as may be deemed
necessary.
(b) The Zoning Advisory Commission shall
hold a regular meeting at least monthly.
