Human Rights Commission Appointment
To Mayor Duggan and City Council Members:
I am withdrawing my application from the Human Rights Commission
appointment. I would like nothing more than to see applicant Anthony
Allen receive this appointment. He is an intelligent African American
man who moved here from Chicago. I think he would make an excellent
commissioner by offering an "outsider's" perspective. Please consider

HUMAN RELATIONS
ARTICLE I. IN GENERAL
Sec.27-1. Definitlol1ll':
When used in this chapter, the following
terma shall have the meanings ascribed herein
unless the context otherwise requires:
Commission: The Dubuque human rights
commission created by article II of this chapter.
Court: The Iowa district court in and for
Dubuque County.
Covered Entity: An employer, employment
agency, labor organization, or joint labor man-
agement committee.
Direct Threat: A significant risk to the health
or safety of others that cannot be eliminated by
reasonable accommodation.
Disability: With respect to a peraon:
(1) A physical or mentel impairment which
substantially limits one or more of such
person's major life activities, and the
condition of a person with a positive
human immunodeficiency virus test re-
Bult, a diagnosis of acquired immune
deficiency syndrome, a diagnosis of ac-
quired immune deficiency syndrome
related complex, or any other condition
related to acquired immune deficiency
syndrome. The inclusion of a condition
related to a positive human immunodefi-
ciency virus test result in the meaning of
"disability" under the provisions of this
chapter does not preclude the application
of the provisions of this chapter to condi-
tions resulting from other contagious or
infectious diseases;
(2) A record of having such an impairment;
or
(3) Being regarded as having such an im-
pairment, but such term does not include
current, illegal use of or addiction to a

controlled substance as defined in section
102 of the controlled substances act (21
USC 802) or chapter 204 of the Iowa
Code.
Drug: A controlled substance, as defined in
schedules I through V of section 202 of the
controlled substences act.
Employee: An individual employed by an
employer.
Employer: The stete or any political subdivi-
sion, board, commission, department, institu.
tion, or school district thereof, and every other
person employing employees within the state.
Employment Agency: Any person undertaking
to procure employees or opportunities to work
for any other person or any person holding such
person or iteelf to be equipped to do so.
Familial Status: One or more individuals
(who have not attained the age of 18 years)
being domiciled with:
(1) A parent or other person hs,ving legal
custody of such individual or individuals;
(2) The designee of such parent or other
person having such custody, with the
written permission of such parent or
other person; or
(3) The protections afforded against discrim-
ination on the baeis of familial status
shall apply to any person who is preg-
nant or is in the process of securing legal
custody of any individual who has not
attained the age of eighteen (18) years.
Labor Organization: Any organization which
existe for the purpose in whole or in part of
collective bargaining, of dealing with employses
concerning grievances, terms or conditions of
employment, or of other mutual aid or protec-
tion in connection with employment.
Person: An individual, partnership, associa.
tion, corporation. legal representative, trustees,

receiver, any othar legal entity and the state
and all political subdivisions and agencies
thereof.
Public Accommodation: Each and every place,
establishment, or facility of whatever kind,
nature, or class that caters or otTers services,
facilities, or goods for a fee or charge to non-
members of any organization or association
utilizing the place, establishment, or facility;
provided, that any place, eatablishment, or
facility that caters or offers services, facilities,
or goods to the nonmembers gratuitously shall
be deemed a public accommodation if the ac-
commodation receives any governmental BUp-
port or subsidy. "Public accommodation" shall
not mean any bona fide private club or other
place, establishment, or facility which is by its
nature distinctly private, except when such
distinctly private place, establishment, or facili-
ty caters or offers services, facilities. or goods to
the nonmembers for a fee or charge or gratu.

Readily Achievable: Easily accomplisbable
and able to be carried out without much diffi-
culty or expense. In determining whether an
action is readily achievable, factors to be con-
sidered include:
(1) The nature and cost of the action needed
under this chapter.
(2) The overall financial resources of the
facility or facilities involved in the ac-
tion; the number of persons employed at
such facility; the effect on expenses and
resources, or the impact otherwise of

such action upon the operation of the
facility;
(3) The overall financial resources of the
covered entity; the overall size of the
business of a covered entity with respect
to the number of ite employees; the num-
ber, type, and location of its facilities;
and
(4) The type of operation or operations of the
covered entity, including the composi-
tion, structure, and functions of the work
force of such entity; the geographic sepa-
rateness, administrative or fiscal rela-
tionship of the facility or facilities in
question to the covered entity.
Reasonable Accommodation: May include:
(1) Making existing facilities used by em-
ployees readily accessible to and usable
by individuals with disabilities; and
(2) Job restructuring, part time or modified
work schedules. rea6signment to a va.
cant position, acquisition or modification
of equipment or devices, appropriate
a<\justment or modifications of eu.mina-
tions, training materials or policies, the
provision of qualified readers or inter-
preters, and other similar accommoda-
tions for individuals with disabilities.
Undue Hardship: An action requiring signifi-
cant difficulty or expense. In determining
whether an accommodation would impose an
undue hardship on a covered entity, factors to
be considered include:
(1) The nature and cost of the accommoda-
tion needed under this cbapter;
(2) The overall financial resourcea of the
facility or facilities involved in the provi-
sion of the reasonable accommodation;
the number of persons employed at such
facility; the effect on expenses and re-
sources, or the impact otherwise of such
accommodation upon the operation of the
facility;

There is hereby created a City Long-Range
Supp. No. 47

consist of nina (9) members including a m_ber
of the City Council designated by the City
Council, a mAlDber of the Zoning Advisory Com-
mission dAml!"Ated by the Zoning Advisory
Commission and seven (7) residents of the City
appointed by the City Conncil who shall be
qualified by their knowledge, ezperienco' and
ability to contribute to the City's long.range
plAnn;ng and developlllellt efforts.
The City Council shall annually designate a
Council member to serve as an alternate in the
absence of the Council's designated representa-
tive and the Zoning Advisory Commission shall
annually designate a Commission member to
serve as an alternate in the absence of the
Commission's designated representative.
Notwithstanding the foregoing, during the
period from the adoption of this Ordinance until
September I, 2001, a member of the Zoning
Advisory Commission shall not be a member of
the Long-Range PIlllInina Advisory Comm;..;on.

Sec. 38-5. Application And Appointment
Proeeas:
The appointment process to the Commission
by the City Council shall include at least the
following:
(1) An application form requesting basic
information on the edncation, training,
ezperisnce, ezpectatiODS and other quali_
fications of the applicant;
(2) Notice to and an opportunity for the

(3) A formal interview by the City Council to
determine the applicant's qualifications
and ability to effectively serve on the

Sec. 3!::rm4- Fillin: Of l:eies; Com-
pensation:
health, safety, morals, order, conve-
nience, prosperity and general welfare
may be promoted;
The term of office for a resident member shall
be three (3) years or until a successor is duly (5)
appointed. Two (2) of the initial terms shall be
for a term of one year; two (2) of the initial
terms shall be for two (2) years; and two (2) of
the initial terms for three (3) years.
A Commission member may be removed at
any time with or without canse by a vote of two-
thirds e'3) of all members ofthe City Council.
A vacancy occurring on the Commission
caused by resignation or otherwise, shall be
filled by appointment by the City Council for
the remainder of the unexpired term.
Members of the Commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the City

Sec.36-7. Powers:
The Commission shall have the following
powers, duties and responsibilities:
(1) To provide a leadership role in the plan-
ning, coordinating end sponsoring of a
periodic community planning process;
(2) To coordinate and supervise the prepara-
tion and maintenance of the Comprehen-
sive Plan;
(3) To provide input to the City Manager in
the preparation of the City Menager's
recommended multi-year capital im-
provement program (CIP);
(4) To make comprehensive studies of the
present condition and the future growth
of the City to provide input into the
community planning process end to gnide
and accomplish a coordinl\ted, consistent
and harmonious development of the City
in accordance with the present and fu-
ture needs thereof to the end that the

To make or cause to be made such sur-
veys, studies, maps, plans, or charts of
the City with due reprd to its relation
to neighboring territory as may be deter-
mined as necessary to carry out the pur-
poses of the Commission;
(6) To recommend amendments to all or a
part of the Comprehensive Plan in re-
sponse to the community plAnning pro-
cess, upon its own initiative or upon
recommendation presented by the Zoning
Advisory Commission, but only after a
public hearing;
(7) To review proposed urban renewal plans
and urben renewal plen amendments
end urban revitalization plans and urban
revitalization plan amendments for con-
sistency with the Comprehensive Plan
for the City;
(8) To undertake public information etrorts
to enhance public understanding of the
community planning process generally
and the Comprehensive Plan specifically;
and
(9) To undertake from time to time other
specific long-range planning projects
which may be referred to it by tba City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Commis-

Sec. 36-8. Organization:
The Commission shall choose annually, at its
first regular meeting of the fiscal year, one of
its members to act as chaiIperson, and another
of its members to act as vice chairperson, to
perform all of the duties of the chairperson
during the chairperson's absence or disability.

issue a license to the applicant upon the pay-
ment of five dollars ($5.00). Such license shall
be in effect for the remainder of the calendar
year. A license for every calendar year thereaf-
ter shall be issued upon the payment of five
dollars ($5.00) unless the license for the preced-
ing year is in suspension or has been revoked.
(b) The license shall be worn upon the cloth-

Sec. 46-44. Failure To Comply With City,
State And Federal Laws:
Every driver licensed under this Article shall
comply with all City, State and Federal laws.
Failure to do so will justify the City Manager
suspending or revoking a license. (1976 Code,

Sec. 46-45. Suspension And Revocation Of
License:
The City Manager is hereby given the author-
ity to suspend any driver's license issued under
this Article for a driver failing or refusing to
comply with the provisions of this Article, such
suspension to last for a period of not more than
thirty (30) days. The City Manager is also given
authority to revoke any driver's license for
failure to comply with the provisions of this
Article. Prior to the suspension or revocation,
the driver shall be given written notice of the
proposed action to be taken and shall have an
opportunity to be heard by the City Council,
which shall affirm or reverse the suspension or

DMSION 2. TRANSIT AUTHORITY'
Sec. 46-66. Established:
The City does hereby create and establish a
Transit Authority in and for the City, effective
July I, 1975. (1976 Code, ~ 38-66)
Sec. 46-67. Qualifications Of Trustees:
The trustees of the Transit Authority shall
qualify by taking their respective oaths of of-
fice. (1976 Code, ~ 38-67; Ord. 94-95, ~ I,

Sec. 46-68. Organization, Election Of Offi.
cers; Adoption Of Rules;
Terms:
(a) The Board of Trustees of the Transit Au-
thority shall organize for its transaction of
business, elect from its own number a chairper-
son and a secretary who shall serve for such
terms as the Board shall determine, not exceed-
ing their terms of office as members of the
Board, and abide by all rules and regulations
that govern the proceedings of the Board.
(b) The Board of Trustees of the Transit Au-
thority shall comprise five (5) trustees appoint-
ed by the City Council. Three (3) of the initial
appointments shall be for terms expiring July
3D, 1984; one of the initial appointments shall
be for a term expiring July 3D, 1983; and one of
the initial appointments shall be for 'a term
expiring July 3D, 1982. Thereafter, all appoint-
ments shall be for a term of three (3) years or
until a successor has been appointed and quali-

Sec. 46.69. Quorum; Majority Vote Re-

for the transaction of business. All action of the
Board shall be by resolution and the affirmative
vote of at least three (3) members shall be nec-
essary for the adoption of any resolution. (1976

Sec. 46.70. Records Of The Board Of
Trustees:
All resolutions, documents and records of the
Board of Trustees shall be governed by the Iowa
Examination of Public Records Act. (1976 Code,

Sec. 46.71. Powers, Duties Of Board:
The Board of Trustees of the Transit Authori-
ty shall have:
(1) The power to execute agreements and act
as the applicant and recipient of Federal
and State grants relating to the transit
system operation and the purchase of
new equipment.
(2) The power from time to time to fix and
establish routes and schedules and
change the same whenever it is deemed
advisable and to fix, maintain and regu-
late rates, fares or charges for the trans-
portation of passengers and any inciden-
tal services and the rates or charges to
be made for advertising in buses or any
other facility under the control of the

Sec. 46.72. Deposit Of Funds:
All funds derived from taxation, Federal and
State grants, fares, or funds collected otherwise
for transit system purposes shall be deposited
with the Treasurer of the City to the credit of

Sec. 46.73. Contracts And Agreements:
Contracts, grant applications and agreements
entered into wherein the City Transit Authority
is a party shall be subject to review and approv-
al by the City Council. (1976 Code, ~ 38-73)
Sec. 46.74. Meetings:
(a) The Transit Authority shall meet not less
than bimonthly on a regularly scheduled day.
(b) Members of the Board of Trustees of the
Transit Authority shall attend at least two-
thirds ('/,) of all regularly scheduled meetings
within any twelve (12) month period. If any
member does not attend such prescribed num-
ber of meetings, it shall constitute grounds for
the Board to recommend to the City Council
that said member be replaced. Attendance of all
members shall be entered on the minutes.
(c) All meetings shall be held in conformance
with the provisions of the Iowa Open Meetings
Law.
(d) The Board of Trustees of the Transit Au-
thority shall file with the City Council a copy of
the minutes of each regular and special meeting
of the Board within ten (10) working days after

Sec. 46.75. Procedures For Operations:
All administrative, personnel, accounting,
budgetary and procurement policies of the City
shall govern the Transit Board of Trustees in
