'j Gus Psihoyos, City Engineer..~ ---- < SUBJECT: 2440 Samantha Drive Culvert INTRODUCTION The purpose of this memo is to present the findings of the engineering analysis, performed by IIW Engineers, outlining the impacts of the 18-inch diameter culvert at 2440 Samantha Drive. BACKGROUND In 2000, Moore Development, L TD submitted improvement plans for the development of the subdivision along the Northwest Arterial that includes Samantha Drive. As part of the development the City of Dubuque required that the developer hire an engineer to design a drainage channel to adequately handle storm water runoff from upstream. The channel crosses eight privately owned lots on Samantha Drive, terminating at the NW Arterial Detention Basin. As is the case with the majority of drainage ditches, creeks, etc. within the City, there is no public easement for the channel because the channel is the responsibility of the owner of the property that it crosses and common law requires property owners to allow upstream stormwater to pass through his or her property. Homeowners, Joyce and Aren Merrick, installed a small diameter (18-inch) drainage pipe and filled in the remaining portion of the private drainage channel that runs through their property at 2440 Samantha Drive. Several neighbors are concerned that flooding will occur because of the culvert and asked the City to look into the matter. City staff from the Engineering and Legal Departments visited the site and met with several of the concerned neighbors. City staff conveyed to the concemed property owners that installing a culvert on private property does not constitute an ordinance violation. However, a restrictive covenant exists that prohibits "adding any permanent or semi-permanent structure that would obstruct the drainage way or create an erodible situation." Although the City cannot bring the case of the covenant violation, the homeowners have it within their power to utilize small claims court to address the breach of contract and compel the Merrick's to remove the culvert and return the waterway "to the state it was in when the Merrick's purchased the land." Neighboring citizens raised concerns with the culvert and asked at the September 6th and October 3'd City Council meetings that the City intervene on their behalf to have the culvert removed and the waterway restored. On October 3, 2005, the City Council directed City staff to commission an engineering analysis to quantify the impacts to surrounding properties due to the culvert installed at 2440 Samantha Drive and help determine if the existence of the culvert constitutes a public nuisance. DISCUSSION On October 4, 2005, Dennis Waugh, of IIW Engineers and Surveyors, and I visited the site to observe the condition of the drainage ditch and culvert and refine the scope of the engineering analysis. It focuses on the potential basement flooding of the upstream property owner (2465 Samantha Drive) and potential yard flooding and erosion to the downstream properties due to the installation of the 18-inch diameter culvert installed at 2440 Samantha Drive. The site visit and survey revealed the existence of a second culvert approximately 100feet upstream of the 18-inch diameter culvert. The second culvert, a 36-inch diameter concrete culvert approximately 30 feet in length, appears to be the property at 2465 Samantha. It too is a private culvert on private property, not shown in the subdivision improvement plans. However this culvert was placed in the natural drainage channel, not the improved channel as built as part of the subdivision improvements. Therefore, the analysis looks at three conditions: the ditch as designed with no culverts, the ditch with the 36-inch culvert, and the ditch with both the 36-inch and 18-inch culverts. Specifically, it predicts the water surface elevation (flood elevation) upstream, through, and downstream of 2440 Samantha Drive for the 2-year, 5-year, 10-year, 25-year, 50-year, and 1 OO-year rainstorms. Based on the analysis, the predicted peak water surface elevation at 2465 Samantha (upstream of the culverts), with both the 36-inch culvert and the 18- inch culvert in place, would be 1.3 feet below the lowest point of entry for the 100-year storm. In fact, the existence of the 18-inch culvert has little or no effect on the water surface elevation at 2465 Samantha. However, the analysis did indicate that the 36-inch culvert raises the predicted water surface elevation by 8 inches and additional fill placed over the 36-inch culvert on 2465 Samantha property would likely result in flooding at 2465 Samantha. While the existence of the 36-inch culvert effects the predicted water surface elevation at 2465 Samantha, it has no effect at 2440 Samantha. However, the analysis predicts that the existence of the 18-inch culvert at 2440 Samantha will likely result in flooding at 2440 Samantha for even the 5-year rain. Downstream properties will be impacted because the 18-inch culvert is not large enough to pass even the 2-year rain, the smallest storm typically modeled. And as a result of the grading over and around the culvert, runoff that flows over the culvert will not re-enter the ditch immediately downstream of 2440 Samantha. IIW asserts that the runoff that exceeds the culvert may flow over between 100 to 200 feet of downstream property before it will return to the channel. Therefore, IIW Engineers suggests that erosion may occur downstream of the 18-inch culvert. The engineering analysis concludes that: 1. If additional fill is placed over the private culvert at 2465 Samantha Drive, it may cause flood damage at 2465 Samantha. 2. The private culvert at 2440 Samantha Drive will likely result in flood damage at 2440 Samantha Drive; and 3. The private culvert at 2440 Samantha Drive may cause erosion damage to three downstream properties. ACTION TO BE TAKEN Attached is a copy of Corporation Counsel Barry Lindahl's memo regarding private and public nuisances. Based on the attached memo and engineering analysis, the City Council should determine if the culvert installed at 2440 Samantha Drive constitutes a public nuisance. , BAR R Y A. Van Milligen City Manager DATE: September 22, 2005 RE: Samantha Drive At the September 6, 2005 City Council meeting, a representative of the Samantha Drive Neighborhood Association provided the Mayor and City Council with a copy of Resolution No. 270-00. I have reviewed Resolution No. 270-00 with City Engineer Gus Psihoyos. The resolution approved the final plat of certain lots in Embassy West NO.3 and required the developer to construct certain public improvements and other work. The developer, Moore Development, Ltd., completed the construction of the required improvements in accordance with the resolution. I do not find any basis in the resolution for the City to take any action with respect to the filling of the drainage swale by one of the property owners. The only potential remedy available to the City, in my OpiniOn, would be a legal proceeding against the property owner who filled the swale to declare the obstruction a nuisance and request the Court to order that the owner abate the nuisance by removing the obstruction. The following is a short summary of the law of nuisance. The law of nuisance is based on the motion that one must use one's own property so that the neighbor's comfortable and reasonable use and enjoyment of their property will not be unreasonably interfered with or disturbed. Iowa Code S 657.1 (1) defines a nuisance as follows: Whatever is injurious to health, indecent, or unreasonably offensive to the senses, or an obstruction to the free use of property, so as essentially to interfere unreasonably with the comfortable enjoyment of life or property, is a nuisance, and a civil action by ordinary proceedings may be brought to enjoin and abate the nuisance and to recover damages sustained on account of the nuisance. There are two kinds of nuisances: private and public. A private nuisance is an actionable interference with a person's interest in the private use and enjoyment of the person's land. Examples include vibrations, blasting, destruction of crops, flooding, pollution, and disturbance of the comfort of the plaintiff, as by unpleasant odors, smoke, or dust. A public or common nuisance is a species of catchall criminal offenses, consisting of an interference with the rights of a community at large. This may include anything from the obstruction of a highway to a public gaming house or indecent exposures. The same circumstances may create both a public and private nuisance. The facts may create a nuisance to the general population and also a nuisance to individual plaintiffs. The elements of public nuisance are: (1) unlawful or anti-social conduct that (2) in some way injures (3) a substantial number of people. The determination of private nuisance rests upon whether there has been "an actionable interference with a person's interest in the private use and enjoyment of his land." Iowa Code S 364.12(3) provides that "A city may. . . Require the abatement of a nuisance, public or private, in any reasonable manner." Section 657.1 can also be used as the basis of both public and private nuisance actions. I would suggest that it would be inappropriate for the City Legal Department to take on the responsibility for prosecuting private nuisance actions for a nuisance that affects only an individual or small number of property owners when the property owners are capable of bringing such an action on their own. This would also put the Legal Department in the unusual position of representing private property owners. Thus, the question is whether the filling of the drainage swale on Samantha Drive constitutes a public nuisance - whether it in some way "injures a substantial number of people" - and, if so, whether the City should bring a public nuisance action. There is authority in Iowa that the obstruction of a water course constitutes a public nuisance. In City of Waterloo v. Waterloo, C.F. & N. Ry. Co., 125 N.W. 819, 149 Iowa 129 (1910), a public nuisance action was brought by a city against a railroad for obstructing a stream. The Supreme Court described the conditions created by the obstruction: The petition sets forth the matters and things hereinbefore mentioned, and alleges that the effect of maintaining the fill constructed by defendant is to obstruct a natural water course: that such obstruction tends to increase the height of the floods above the crossing, and thereby fill the low places with water, which remains after the floods have subsided and create stagnant pools; that the debris and foul matter thus deposited create unhealthful conditions, and materially interfere with the health, comfort, and convenience of residents and visitors in that neighborhood; that the floods so caused injure the public highways, and at times extend to the Westfield addition, depositing mud, sand, and other materials in its streets, and that the conditions complained of will continue indefinitely if the defendant is permitted to continue the obstruction of the cut-off. In order to answer the question of whether the filling of the drainage swale constitutes a public nuisance, I would suggest it is first necessary to have an opinion from an engineer as to the scope and extent of the consequences of the obstruction. If there is a basis, based upon an engineer's opinion, for concluding that the obstruction in the drainage swale is a public nuisance, then the two alternatives available would be to bring an action in District Court asking the Court to declare the obstruction a nuisance and ordering that it be abated, or in the alternative, bringing a municipal infraction complaint for the public nuisance and ask the Court to assess a penalty and require that the nuisance be abated. cc: William G. Engineering Department City Hall, 50 West 13th Street Dubuque, Iowa 52001-4864 Re: Drainage Ditch Hydraulic Analysis north of Samantha Drive IIW Project No: 05006-07 Dear Gus: IIW has prepared hydrologic and hydraulic calculations for the conditions of the drainage ditch at the north end of Samantha Drive This letter is a report of our analysis, results, and recommendations. SITE OBSERVATIONS On October 4, 2005, this author accompanied you to the site to observe the existing conditions of a drainage ditch that was constructed as part of the subdivision development of Samantha Drive. The north end of the street ends in a cul-de-sac. The most northerly residence on the west side of the street is 2465 Samantha Drive, and is bordered by a natural drainage ditch along the north side of the lot. The grading around the house has a gentle slope down to the drainage ditch. Of particular concern is a lower level window which faces the drainage ditch. There is only about I' of elevation height above the grade at the window and the top of the bank of the ditch. The elevation of the sill of the window is 861.67 A 36" RCP culvert pipe was placed in the drainage ditch just off the north end of the cul- de-sac. It had the appearance of having been in place for a relatively significant period of time, at least a few years. The grade over the top of the pipe was depressed down to the top of the pipe, providing an overflow capability over the top of the pipe. Apparently, flow over the ground surface above the pipe has occurred often enough to cause erosion to occur alongside of the pipe. A new residence was under construction at 2440 Samantha Drive with a walkout lower level. This included grading of the backyard and the installation of an 18" CPE pipe in the drainage ditch to conduct the flow in the drainage across the lot. The rest of the backyard was filled in to provide a gentle slope in the backyard from the walkout. The lower level elevation is 857.23. The grade next to the house varies from 856.62 to 856.65, only about 7" below the walkout floor elevation. WATERSHED DESCRIPTION - HYDROLOGY The drainage ditch serves the natural drainage for a 28.5 acre watershed that has the northerly limits at Asbury Road. This includes a nearly fully developed area of residential housing of principally Y. acre lots and a nursing home complex. There is an approximate 3.5 acre parcel that is primarily impervious cover, but has the potential for more intense development. The watershed is primarily hydrologic soil group B, and analyzed using an overall runoff curve number (CN) of 75. Stormwater runoff is conducted in the natural drainage ditch along the north side of 2465 Samantha drive, through the culvert at the north end of the street cul-de-sac, into a regraded drainage ditch lined with riprap, then it returns to a natural drainage ditch approximately 400' downstream of the cul-de-sac, which discharges into the detention basin located west of the Northwest Arterial. The design discharge in cubic feet per second (cfs) for this drainage area is summarized as follows: Storm event 2-Yr 5-Yr IO-Yr 25-Yr 50-Yr 100-Yr 24-Hour rainfall amount, inches 2.61 3.67 4.31 5.11 104 5.73 126 6.36 Design Discharge, cfs 36 58 78 HYDRAULICS ANALYSIS 148 A field survey was conducted to provide the detailed data necessary for hydraulic analysis. Hydraulic cross sections were developed from the survey data at 14 locations along the drainage ditch, from 230' below the 18" CPE outlet to about 125' above the 36" RCP at the end of the cul-de-sac. These locations were selected to adequately model the downstream (tailwater) conditions for the culverts, the culverts, transitions between the culverts, and affect conditions upstream to the property at 2465 Samantha Drive. Water surface profiles were generated for the storm event discharges described above using the Corps of Engineers water surface program HEC-RAS, v. 3.1.2. HEC-RAS separates differing model runs into Plans. The first plan analyzed was for natural conditions as if there were no culverts there, but with the regraded and riprapped ditch, the second plan is for only the 36" RCP at the end of the cul-de-sac, and the third plan includes both the 36" RCP and the 18" CPE culverts. The 36" RCP was modeled as a 30" due to partial blocking by sediment. The critical cross sections, referred to in the HEC-RAS model as River Station (RS) are at Section 7 for the property at 2440 Samantha Drive (the 18" CPE) for the lower level walkout, and Section 13 for the window sill at 2465 Samantha Drive. The results of this water surface profile analysis are as follows: 2465 Samantha Drive - Water surface elevations at RS 13. Storm event 2-Yr 5-Yr 50-Yr 100-Yr Without either 36" RCP or 18" CPE in place 36" RCP but without 18" CPE in place 858.06 858.51 859.45 859.68 858.55 859.08 859.40 859.78 860.09 860.34 With both 36" RCP and l8"CPE presently placed 858.55 859.08 859.40 859.79 860.09 860.37 These results indicate that the presence of 18"CPE has virtually no effect on the property at 2465 Samantha Drive except an additional 0.03' at the 100-year event (the 0.01' at 25-year is due to rounding). This is because the drainage ditch is relatively steep (varies 2.5% to 3.5%) and some of the flow is at or near supercritical flow regime. The property at 2465 is far enough upstream that the effects of the 18" CPE downstream have tapered to nothing, and the depth of flow is controlled by the ditch cross-section near the cul-de-sac, and especially by the previously existing 36" RCP. These results indicate the elevation of the window sill at 861.67 is about 1.3' above the 100-Yr event water surface elevation of the ditch. The 36" RCP must not have additional fill placed on top ifit, it will radically affect these results and will likely flood the window sill if filled in. However, the results for the residence under construction at 2440 Samantha Drive have significantly different impacts. The upstream 36" RCP culvert has no impact on the downstream property; however the 18" CPE has a very significant effect, raising the normal flow of the water surface by about 2'. This is enough rise in the water surface to actually put water above the lower level floor elevation of 857.23 for any rainfall in excess of a 5-year event. As the overland flow passes over the backyard of the lot at 2440 Samantha Drive, the topography indicates that it will flow parallel to the culvert and then return to the riprap ditch downstream. However, due to the width of flow, it may take 100' to 200' downstream for the full width of the overland flow to return to the riprap channel. This may cause erosion damage on the downstream properties in the flow path of this area. The following exhibits are included for your reference: I) Hydrograph Recap for the stormwater discharges; 2) standard table output of the HEC-RAS analysis giving the water surface elevation for each cross-section (River Sta) for each of 3 Plans (Natural, 36" RCP only, 36" RCP and 18" CPE combined); 3)graphics of hydraulic cross sections at RS 7 and 13, which lists the storm events in descending elevation in the Legend (note the order is changed between the two cross sections); 4) 3 separate water surface profiles showing the changes from the natural condition due to the effects of the 36" RCP culvert and then the combination of both the 36" and 18" culverts (note the RS locations on the bottom scale for orientation; 5) the hydraulic field survey data showing the locations of the street, the residence locations relative to the ditch and the culvert locations; and 6) an overall view of the upstream watershed. The water surface profiles portray the effects of the culverts very clearly. It is our opinion that the 18" CPE culvert must be removed and a channel of the same downstream dimensions replaced into the backyard or 2440 Samantha Drive will likely flood. If the 36" RCP culvert is left in place, it must not have additional fill placed on top of it in order to protect the residence at 2465 Samantha Drive. Contact us if you need more information.
