DISCUSSION The attached Easement Modification Exhibit shows the area of the storm sewer easement to be vacated and indicates the location of a new access easement over and across Lot 1 Dubuque Industrial Center North Second in the City of Dubuque. The property is owned by 2013 Dubuque, LLC. The developer has agreed to regrade the northwesterly corner of their site to accommodate access to the reduced storm sewer easement area at their expense and provide an additional access easement on the south side of the Lot for access to remaining City properties. RECOMMENDATION would recommend to vacate and release a portion of the storm sewer easement and the blanket access easement for the cost of publication and filing fees, with the owner agreeing to pay the cost to regrade a portion of their site for access to the storm sewer easement as shown on a site plan approved by the Engineering Department.
