HUMAN RELATIONS
ARTICLE I. IN GENERAL
See. 27.1. Definitions',
When used in this chapter, the following
terms shall hsvs the meanings ascribed herein
unless the context otherwise requires:
Commission: The Dubuque human rights
commission created by article II of this chapter.
Court: The Iowa district court in and for
Dubuque County.
Covered Entity: An employer, employment
agency, labor organization, or joint labor man-
agement committee.
Direct Threat: A significant risk ta the health
or safety of others that cannot be eliminated by
reasonable accommodation.
Disability: With respect ta a person:
(1) A physical or mental impairment which
substantially limits ODe or more of Buch
person's major life activities, and the
condition of a person with a positive
human immunodeficiency virus test re-
sult, a diagnosis of acquired immune
deficiency syndrome, a diagnosia of ac-
quired immune deficiency syndrome
related complex, or any other condition
related to acquired immuns deficiency
syndrome. The inclusion of a condition
related. to a positive human immUliodefi-
ciency virus test result in the meaning of
"disability" under the provisions of this
chapter does not preclude the application
of the provisions of this chapter ta condi-
tions resulting from other contagious or
infectious diseases;
(2) A record of having such an impairment;
or
(3) Being regarded aa having such an im-
pairment, but BUch term does not include
current, illegal use of or addiction to a

controlled substance as defined in section
102 of the controlled substances act (21
USC 802) or chapter 204 of the Iowa
Code.
Drug: A controlled substance, as defined in
schedules I through V of section 202 of the
controlled substances act.
Employee: An individual employed by an
employer.
Employer: The state or any political subdivi-
sion, board, commission, department, institu-
tion, or school district thereof, and every other
person employing employees within the state.
Employment Agency: Any person undertaking
to procure employees or opportunities to work
for any other person or any person holding such
person or itself ta be equipped to do so.
Familial Status: One or more individuals
(who have not attained the age of 18 years)
being domiciled with:
(1) A parent or other person hl\ving legal
custady of such individual or individuals;
(2) The designee of such parent or other
person having such custody, with the
written permission of such parent or
other person; or
(3) The protections afforded against discrim-
ination on the basis of familial status
shall apply ta any person who is preg-
nant or is in the process of securing legal
custady of any individual who has not
attained the age of eighteen (18) years.
Labor Organization: Any organization which
exists for the purpose in whole or in part of
collective bargaining, of dealing with employees
concerning grievances, terms or conditions of
employment, or of other mutual aid or protec-
tion in connection with employment.
Person: An individual, partnership, associa-
tion, corporation, legal representative, trustees,

receiver, any other legal entity and the state
and all political subdivisions and agencies
thereof.
Public hcommodation: Each and every place,
establishment, or facility of whatever kind,
nature, or class that caters or offers services.
facilities, or goods for a fee or charge to non.
members of any organization or association
utilizing the place, establishment, or facility;
provided, that any place, establishment, or
facility that caters or offers services, facilities,
or goods to the nonmembers gratuitously shall
be deemed a public accommodation if the ac-
commodation receives any governmental BUp-
port or subsidy. "Public accommodation" shall
not mean any bona fide private club or other
place, establishment, or facility which is by its
nature distinctly private, except when such
distinctly private place, establishment, or facili-
ty caters or offers services. facilities, or goods to
the nonmembers for a fee or charge or gratu-
itously, it shall be deemed a public accommoda-
tion during such period.
"Public accommodation" includes each state
and local government unit or tllJ[ supported
district of whatever kind, nature, or class that
offers services, facilities, benefits, grants or
goods to the public, gratuitously or otherwise.
This paragraph shall not be construed by nega-
tive implication or otherwise to restrict any
part or portion of the preexisting definition of
the term "public accommodation" (contained in
the definition above).
Readily Achievable: Easily accomplishable
and able to be carried out without much diffi-
culty or expense. In determining whether an
action is readily achievable, factors to be con-
sidered include:
(1) The nature and cost of the action nesded
under this chapter.
(2) The overall financial resources of the
facility or facilities involved in the ac-
tion; the number of persons employed at
sucb facility; the effect on expenses and
resources, or the impact otherwise of

such action upon the operation of the
facility;
(3) The overall financial resources of the
covered entity; the overall size of the
business of a covered entity with rsspect
to the number of its employees; the num-
ber, type, and location of ite facilities;
and
(4) The type of operation or operations of the
covered entity, including the composi-
tion, structure, and functions of the work
force of such entity; the geographic sepa-
rateness, administrative or fiscal rela-
tionship of the facility or facilities in
question to the covered entity.
ReoBonable Accommodation: May include:
(1) Making existing facilities used by em-
ployees readily acce..ible to and usable
by individuals with disabilities; and
(2) Job restructuring, part time or modified
work schedules, reassignment to a va-
cant position, acquisition or modification
of equipment or devices, appropriate
adjustment or modifications of examina-
tions, training materials or policies, the
provision of qualified readers or inter-
preters, and other similar accommoda-
tions for individuals with disabilities.
Undue Hardship: An action reqniring signifi-
cant diffieulty or expense. In determining
whether an accommodation would impose an
undue hardship on a covered entity, factors to
be considered include:
(1) The nature and cost of the accommoda-
tion needed under this chapter;
(2) The overall financial resources of the
facility or facilities involved in the provi-
sion of the reasonable accommodation;
the number of persons employed at such
facility; the effect on expenses and re-
sources, or the impact otherwise of such
accommodation upon the operation of the
facility;

PlanDing Advisory Commission, which shall
consist of nine (9) members including a m_ber
of the City Council designated by the City
Council, a l11ember of the Zoning Advisory Com-
mission dA.;groAted by the Zoning Advisory
Commission and seven (7) residents of the City
appointed by the City Council who shall be
qualified by their ImowIedge, uperience' and
ability to contrihote to the City's long-range
plAnning and devalopment efforts.
The City Council shaIl annually designate a
Council member to serve as an alternate in the
absence of the Council's designated representa-
tive and the ZoDing Advisory Commission shall
annually designate a Commission member to
serve as an alternate in the absence of the
Commission's designated representetive.
Notwithstanding the foregoing, during the
period from the adoption of this Ordinance until
September 1, 2001, a member of the Zoning
Advisory Commiesion shaII not be a member of
the Long-Range Planning Advisory Commia.;on.

The appointment process to the COmmission
by the City Council shall include at least the
following:
(1) An application form requesting basic
information on the education, traiDing,
uperience, upeetations and other quaIi_
fications of the applicant;
(2) Notice to and an opportunity for the
general public to comment in writing,. on
the q1U.1H1cstions of each applicant;~and~
(3) A formal interview by the City Council to
determine the applicant's qualifications
and ability to eff'ectivaly serve on the

The term of office for a resident member shall
be three (3) years or until a successor is duly (5)
appointed. Two (2) of the initial terms shall be
for a term of one year; two (2) of the initial
terms shall be for two (2) years; and two (2) of
the initial terms for three (3) years.
A Commission member may be removed at
any time with or without cause by a vote of two-
thirds ('/3) of all members of the City Council.
A vacancy occurring on the Commission
caused by resignation or otherwise, shall be
filled by appointment by the City Council for
the remainder of the unexpired term.
Members of the Commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the City

Sec. 36-7. Powers:
The Commission shall have the following
powers, duties and responsibilities:
(1) To provide a leadership role in the plan-
ning, coordinating and sponsoring of a
periodic community planning process;
(2) To coordinate and supervise the prepara-
tion and maintenance of the Comprehen-
sive Plan;
(3) To provide input to the City Manager in
the preparation of the City Manager's
recommended multi-year capital im-
provement program (CIP);
(4) 'Ib make comprehensive studies of the
present condition and the future growth
of the City to provide input into the
community planning process and to guide
and accomplish a coordinated, consistent
and harmonious development of the City
in accordance with the present and fu-
ture needs thereof to the end that the

health, safety, morals, order, conve-
nience, prosperity and general welfare
may be promoted;
To make or cause to be made such sur-
veys, studies, maps, plans, or charts of
the City with due reprd to its relation
to neighboring territory as may be deter-
mined as necessary to carry out the pur-
poses of the Commission;
(6) To recommend amendments to all or a
part of the Comprehensive Plan in re-
sponse to the community pl$1nniT1g pro..
cess, upon its own initiative or upon
recommendation presented by the Zoning
Advisory Commission, but only after a
public hearing;
(7) To review proposed urban renewal plans
and urban renewal plan amendments
and urban revitalization plans and urban
revitalization plan amendments for con-
sistency with the Comprehensive Plan
for the City;
(8) To undertake public information efforts
to enhance public understanding of the
community planning process generally
and the Comprehensive Plan specifically;
and
(9) 'Ib undertake from time to time other
specific long-range planning projects
which may be referred to it by the City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Commis-

Sec. 38-8. Organisation:
The Commission shall choose annually, at its
llrst regular meeting of the fiscal year, one of
its members to act as chairperson, and another
of its members to act as vice chsirperson, to
perform all of the duties of the chairperson
during the chairperson's absence or dis-mTity.
