Van Milligen, City Manager ,,~, SUBJECT: Sidewalk Near Arboretum Drive Entrance Gate (Response to August 18, 2005 Letter from Mr. Jack Frick) On November 15, 2004, the City Council reviewed a petition from Kivlahan Farms requesting that sidewalk not be required on Arboretum Drive and West 32nd Street. The City Council approved the installation of the sidewalks on both sides of Arboretum Drive. On August 18, 2005, Mr. Jack Frick, Board President of the Dubuque Arboretum & Botanical Gardens, directed a letter to the Mayor and City Council requesting consideration that the "sidewalk on the west side of Arboretum Drive be ended at the Dennis Hoyer driveway," Mr. Frick would prefer that pedestrians not use the west side sidewalk since there is a limestone entrance pillar that could block motorist vision. They would prefer that the pedestrians and bikers use the east sidewalk entrance. City Engineer Gus Psihoyos recommends that the sidewalk be installed. With respect to concerns for visibility, there will be 41 feet of clearance prior to the sidewalk and the speed limit is 15 mph. Van Milligen, City Managh Gus Psihoyos, City Engineer ~ V TO: SUBJECT: Sidewalk Near Arboretum Drive Entrance Gate (Response to August 18, 2005 Letter from Mr. Jack Frick) BACKGROUND On August 18, 2005, Mr. Jack Frick, Board President of the Dubuque Arboretum & Botanical Gardens, directed a letter to the Mayor and City Council requesting consideration that the "sidewalk on the west side of Arboretum Drive be ended at the Dennis Hoyer driveway". Mr. Frick would prefer that pedestrians not use the west side sidewalk since there is a limestone entrance pillar that could block motorist vision. They would prefer that the pedestrians and bikers use the east sidewalk entrance. DISCUSSION On November 15, 2004 the City Council reviewed a petition from Kivlahan Farms, LC requesting that sidewalk not be required on Arboretum Drive and West 32nd Street. The City Council approved by a 7-0 vote the installation of the sidewalk on both sides of Arboretum Drive. This directive was in compliance with City Code Sec. 42-24 (e) and Sec. 42-20-(K) (1) Subdivision Regulations: "Sidewalks shall be required on all public street frontages" and in compliance with the resolution approving the final plat. Phase I of the Arbor Estates Subdivision, which includes the Arboretum Drive and Arrowwood Lane, consists of 36 lots. Of those 36 lots, 30 (83.3%) have been built on or are in process. This development is over the 80% ruling which requires sidewalk installation on all lots, even those lots that are vacant. It is our opinion that the sidewalk is required to be installed on the remaining portion of the property in question from Mr. Frick's letter, as well as those lots not in compliance with the subdivision ruling. It is proposed to notify all property owners of the requirement for sidewalk installation with compliance no later than June 1, 2006. Completion of this sidewalk installation will increase pedestrian safety and continuance of the sidewalk network. With respect to Dubuque Arboretum's concern for visibility and the existing limestone entrance pillars, there is 50 feet from the curb line to the pillars. When the sidewalk is installed through the drive, there would still remain 41 feet of clearance prior to the vehicles crossing the sidewalk. The speed limit in the park is 15 MPH. The continuance of sidewalk around the Arboretum Drive cul-de-sac would facilitate visitors to the Arboretum and the general walking public. City Code requires vehicles to stop and yield the right-of-way before entering a public street. To re-enforce the ordinance, staff would propose the installation of a STOP sign at the point where traffic exiting the Arboretum is required to yield to pedestrians and vehicles on Arboretum Drive. A STOP AHEAD sign could also be installed to alert motorists of the STOP requirement. The Arboretum has recently installed some small trees in close proximity to the location of the sidewalk. These trees could be easily relocated, if necessary, as part of the sidewalk installation. ACTION TO BE TAKEN It is recommended that sidewalk installation be required on both sides of Arboretum Drive and all impacted property owners be notified that sidewalk installation be required no later than June 1, 2006. The sidewalk has been designed so motorcycles and 4 wheelers cannot enter, only walkers. We are asking that the sidewalk on the west side of Arboretum Drive be ended at the Dennis Hoyer driveway. We do not want people entering on the west side. There is a tall limestone entrance pillar obstructing their view of oncoming traffic. For safety's sake we would like to encourage walkers and young children on bikes to use the east sidewalk entrance. We have planted "Golden Raindrop" Flowering Apple trees around the cul-de-sac as we would like a mass of flowering trees each spring. The area we are talking about is approximately 120 feet long. We have talked to Dennis Hoyer of 3318 Arrowwood Lane and he would like the same ending of the sidewalk. We would like to have a beautiful and safe entrance to the Dubuque Arboretum & Botanical Gardens. Enclosed is a map showing the entrance road and where the trees are planted. We would appreciate any assistance you can give to the arboretum.
