Dear Mr. Lindahl:
I wanted to provide you with an update on the above-referenced matter, which just
recently settled.
By way of background, this matter involves a pedestrian slip and fall claim in the City of
Dubuque 8th Street Parking Ramp. On the day before the accident, there was
considerable rainfall followed by rapidly falling temperatures causing ice to form. While
the ramp was sanded, patches of ice remained. While walking in the ramp, Julie
Heiderscheit slipped on a patch of ice and fell.
Ms. Heiderscheit severely fractured her ankle, which required surgery to repair. Medical
specials exceeded $20,000 and lost wages exceeded $3,000.
This matter was mediated on October 17, 2005. Pre-mediation demand was $120,000
and offer was $20,000. The claim with Julie Heiderscheit and her husband, Patrick, was
ultimately settled for $48,000.
