Water Department Manager Bob Green is recommending acceptance of the Phase I
Fire Hydrant Painting Program completed by Ted Stackis Construction in the amount of
$57,476.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to request the final payment of $2 873.80 to Ted Stackis Construction for the completed
painting contract for phase 1 of the Fire Hydrant Painting Program.
BACKGROUND
This project was for the execution of the services required to paint 700 public fire hydrants in this phase of a four phase
program.
DISCUSSION
Phase 1 of the Fire Hydrant Painting Program has been completed by Ted Stackis Construction of Dubuque, Iowa for the
final contract amount of $57,476.00. The original contract amount was $59)800.00 and there was one change order reducing
the total amount by $2 324.00.
RECOMMENDATION
I recommend that the City council accept the improvements and authorized the final payment of $2,873.80 to Ted Stackis
Construction of Dubuque, Iowa. The final contract amount is approximately 4% less than the original contract amount of
$59)800.00.

Dear Mike:
Based on Water Distribution Division inspections, the Fire Hydrant Repainting Project 2011 project
has been completed.
We hereby certify that Ted Stackis Construction of Dubuque, Iowa, has completed the above
referenced project in compliance with the drawings and specifications and the project is ready for
acceptance. The final project construction cost is $57,476.00.
We have enclosed an unsigned copy of Contract Payment No. 8 in the amount of $6,287.10 and a
copy of Change Order No. 1 Final. Ted Stackis will be delivering the three signed copies of each.
The change order documents the differences between the original unit price contract quantities and
the final approved quantities.
We recommend that the City of Dubuque approve Contract Payment No. 8 and Change Order No. 1
Final. After the City has approved and signed the forms, one signed copy of each form should be
sent to Ted. Stackis Construction along with payment, one copy of each form is for City records, and
one copy of each is for IIW.
We also recommend that the City of Dubuque approve and accept the Fire Hydrant Repainting
Project 2011 work. Retainage in the amount of $2,873.80 must be held for 30 days after
acceptance and paid at that time provided no claims from others are filed. We will prepare Contract
Payment No. 9 Final for the retainage due the contractor at the appropriate time.
Approval and acceptance starts the 2 year warranty period.

RESOLUTION NO. 245 -12
ACCEPTING PHASE 1 OF THE FIRE HYDRANT PAINTING PROGRAM AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for Phase 1 of the Fire Hydrant
Painting Program (the Project) has been completed and the City's Consultant Engineer,
IIW Engineering of Dubuque, Iowa has examined the work and filed a certificate stating
that phase 1 of the program has been completed according to the terms of the Public
Improvement Contract and that the Consultant Engineer recommends that the Project
be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Consultant Engineer is approved and
the Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Fire Hydrant Painting Program appropriation for the phase 1 contract amount of
$57,476.00 less any retained percentage provided for therein as provided in Iowa Code
chapter 573, and to pay such retainage only in accordance with the provisions of Iowa
Code chapter 573.
