Van Milligen, City Manager SUBJECT: Mystique Casino Re- Roofing of Original Structure DATE: September 10, 2012 Dubuque AII- America City I I., 2012 Budget Director Jennifer Larson recommends approval of Mystique Casino's request to re -roof the original structure of the Mystique Casino. As required by Section 13 in the Amended and Restated Lease Agreement between the City of Dubuque and the Dubuque Racing Ltd., the Dubuque Racing Association shall not commence alterations to any structure or structures or make additional to any existing structure or facilities in an amount exceeding $10,000 without prior written approval of the plans and specifications by the City. The written request by Mystique Casino is in accordance with the Amended and Restated Lease Agreement. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen, City Manager FROM: Jennifer Larson, Budget Director SUBJECT: Mystique Casino Re- Roofing of the Original Structure DATE: September 10, 2012 INTRODUCTION Dubuque All- America City II I I I.F 2012 The purpose of this memorandum is to recommend approval of Mystique Casino's request to re -roof the original structure of the Mystique Casino. DISCUSSION As required by Section 13 in the Amended and Restated Lease Agreement between the City of Dubuque and the Dubuque Racing Ltd., the Dubuque Racing Association shall not commence alterations to any structure or structures or make additional to any existing structure or facilities in an amount exceeding $10,000 without prior written approval of the plans and specifications by the City. Any improvements, modifications, or additions to Mystique Casino wheresoever located or however financed shall become part of the real estate and owned by the City. City consent is not required for any items in Association's capital improvement program budget except for items costing $10,000 or more or for capital improvements to be purchased by incurring debt. City consent is not required for Association's expenditures for ongoing replacement of slot machines and other video games or for equipment replacement in the normal course of business. Association shall expend all funds in Depreciation and Improvement Fund and all of its reserve funds (except for a 5% operations reserve in the reserve fund) prior to using any other funds for capital improvements. Jesus Aviles, President and CEO of Dubuque Racing Association has requested in writing to re -roof the original structure of Mystique Casino, which was built approximately in 1984 (attachment 1). The cost of the new roof is estimated to be $860,600 and comes with paint and finish guarantee of twenty years and a life expectancy of seventy years. This written request is in accordance with the Amended and Restated Lease Agreement. RECOMMENDATION I respectfully recommend the approval of re- roofing of the original structure for Mystique Casino. Mayor and City Council Members As required in the Amended and Restated Lease Agreement between. the City of Dubuque and the Dubuque Racing Ltd., I am formally= requesting City approval to re -roof the original structure of Mystique Casino, which was built hi the 1984 / 1985 time flame. My recommendation for this expenditure of $860,600 is fully supported by 11W, P,C. in. terms of the need for the roof replacement along with and in accordance with the plans and specifications developed by I1W. The new roof comes with paint and finish guarantee of 20 years and a life expectancy of 70 years. The new roof will protect the City's structure, the contents, and will alleviate -disruption to serving Mystique Casino's customers due to roof leaks. Additional benefits relative to green attributes are as follows- 1 . By retaining the existing roof, additional energy, effort, and transportation for removal will be conserved. 2. Additional insulation will reduce energy consumption. 3. Removal of the cupolas will enhance the integrity of the building envelope by reducing the problematic roof/wall transition and termination details, thus contributing to the life of the proposed roof installation.
