Partial Release of Mortgages_2264 Washington Street TO: The Honorable Mayor and City Council Members FROM: Michael C. Van Milligen, City Manager SUBJECT: Bee Branch - Property Acquisition Eichman - Partial Release of Mortgage DATE: October 1, 2012 The easterly 27 feet of the Jayson D. Eichman property located at 2264 Washington Street is being purchased for the construction of a permeable alley between 2264 Washington Street and the Bee Branch Creek Restoration Project. The dwelling will remain on the balance of the lot. As part of the Lead Paint Hazard Reduction Program and Homeowner Rehabilitation Loan Program, mortgages in the amounts of $4,940, $19,000 and $2,243 were filed against the property to secure loans and grants offered by the City for completion of the work. City Engineer Gus Psihoyos recommends City Council approval of the release of mortgages held by the City of Dubuque on the easterly 27 feet of the Eichman property. Eichman at 2264 Washington Street. The dwelling will remain on the balance of the lot. DISCUSSION The City is in the process of obtaining releases of mortgages on the portion of the Eichman property being purchased for a new permeable alley as part of the Bee Branch Creek Restoration Project. The property owner has complied with the Lead Paint Hazard Reduction Program, so a full release is being provided on the lead loan. A partial release is being obtained from Bank of America, the primary lender. Partial releases are needed from the City which releases the rehabilitation mortgages against the portion of the property being purchased by the City. The City hopes to close on the sale in October. RECOMMENDATION I recommend that the mortgages held by the City of Dubuque on the easterly 27 feet of former Lot 2 of Lot 103 of L.H. Langworthy's Addition, now platted as Lot 2 of Bee Branch Subdivision No. 8 be released.
